If fired from job can I collect Washington ESD unemployment benefits?

Got terminated from my warehouse job last Friday for what they called 'performance issues' but I think it was really because I complained about safety violations. My supervisor had been documenting everything for the past month even though I'd been there 2 years with no problems. Can I still file for unemployment with Washington ESD if I was fired? I'm really stressed about this because I have rent due next week and need to know if I should even bother applying.

Yes you can definitely apply! Being fired doesn't automatically disqualify you from unemployment benefits in Washington. The key is whether you were fired for 'misconduct' vs performance issues. Document everything about your termination and file your claim ASAP.

Thanks, that's a relief. What counts as misconduct exactly? They said I wasn't meeting productivity standards but I think they were setting me up to fail.

0 coins

Misconduct is usually things like theft, violence, or willful violations of company policy. Poor performance or not meeting standards usually doesn't qualify as misconduct for Washington ESD purposes.

0 coins

File immediately don't wait! Even if Washington ESD initially denies your claim due to the termination, you can appeal and present your side of the story. The burden is on your employer to prove misconduct occurred.

0 coins

How long does the appeal process usually take? I can't go weeks without income.

0 coins

Appeals can take 4-8 weeks unfortunately. That's why it's crucial to file your initial claim right away - even if denied, the effective date goes back to when you first filed.

I had similar situation last year - got fired for 'attitude problems' but really it was retaliation for filing a workers comp claim. Took forever to get through to Washington ESD to explain my situation properly. Ended up using Claimyr to actually reach a real person who could help me navigate the process. Check out claimyr.com - they have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

0 coins

Never heard of that before. Did it actually help you get approved for benefits?

0 coins

Yeah, made a huge difference. I was able to talk to an actual Washington ESD agent who understood my situation instead of just submitting paperwork into the void. Got my claim approved after explaining the retaliation angle.

0 coins

Sounds too good to be true but I'm desperate enough at this point to try anything to reach someone at Washington ESD.

0 coins

whatever u do dont mention the safety complaint thing that might hurt ur case just say performance issues

0 coins

Actually that's bad advice. If it was retaliation for reporting safety issues, that could actually HELP the unemployment case. Washington protects whistleblowers.

0 coins

oh didnt know that my bad

The Washington ESD system is so broken. I was fired from my retail job 3 months ago and STILL waiting for my adjudication to finish. They just keep saying 'under review' with no timeline. It's absolutely ridiculous that people can't get answers.

0 coins

3 months?? That's insane. How are you surviving financially?

0 coins

Barely honestly. Had to move back in with my parents and I'm 28 years old. The whole system needs to be overhauled.

0 coins

For everyone dealing with long adjudication waits - keep filing your weekly claims even while it's under review. If you're eventually approved, you'll get backpay for all those weeks. Don't miss any weekly filing deadlines.

0 coins

Good to know. I was worried I'd be wasting time filing weekly claims if I might get denied anyway.

0 coins

This is correct. I made the mistake of not filing weekly claims during my adjudication and lost out on 6 weeks of backpay when I was finally approved.

Document EVERYTHING from your termination. Save emails, write down conversations, keep your employee handbook. If this goes to an appeal hearing you'll need all that evidence to show it wasn't misconduct.

0 coins

I still have access to my work email for now. Should I save those safety complaint emails I sent?

0 coins

Absolutely! Those could be key evidence that your termination was retaliatory rather than performance-based. Print them out or forward to your personal email before you lose access.

0 coins

Quick question - do you have to wait a certain period after being fired before you can apply for unemployment? Or can you literally file the next day?

0 coins

You can and should file immediately. There's no waiting period to apply, and the sooner you file the sooner your claim can be processed.

0 coins

Thanks! I thought there might be some kind of cooling off period or something.

0 coins

Been through this exact scenario. Washington ESD will contact your former employer to get their side of the story. Make sure you're ready to counter any false claims they make about why you were terminated.

0 coins

How do I know what my employer told them? Do I get to see their response?

0 coins

If your claim gets denied and you appeal, you'll get to see the employer's statement as part of the appeal process. That's when you can provide counter-evidence.

0 coins

Just a heads up - even if you get approved for benefits, start job searching immediately. Washington has work search requirements and you need to log your job search activities every week.

0 coins

How many jobs do I need to apply to per week?

0 coins

It's 3 job search activities per week minimum. Can be applications, networking, job fairs, etc. Keep detailed records in WorkSourceWA.

If you're having trouble reaching Washington ESD by phone like most people, I recently discovered Claimyr which actually got me through to a real agent. Was skeptical at first but it worked better than calling for hours getting busy signals.

0 coins

Is that the same service someone mentioned earlier? Might be worth trying if I can't get through to explain my situation.

0 coins

Yeah same one. Really helped me get clarity on my claim status when the online system wasn't showing enough detail.

0 coins

Make sure to file your claim online through the secure Washington ESD website. Don't try to do it over the phone unless you absolutely have to - the wait times are brutal.

0 coins

The online application asks a lot of detailed questions about the termination. Should I write a long explanation or keep it brief?

0 coins

Be thorough but factual. Explain the circumstances clearly without getting too emotional or accusatory in your language.

0 coins

I got denied initially when I was fired but won my appeal hearing. The judge was very fair and really listened to both sides. Don't give up if you get that first denial letter.

0 coins

What was the hearing like? Did you need a lawyer or anything?

0 coins

No lawyer needed. It was by phone and pretty informal. Just had to explain my side clearly and answer the judge's questions honestly.

0 coins

ugh this whole thread is giving me flashbacks to my own nightmare with Washington ESD last year took 3 months to get my first payment

0 coins

3 months?! How did you survive that long without income?

0 coins

credit cards and borrowing money from family it was awful but eventually got all the backpay

0 coins

Here's something people don't always know - you can work part-time while collecting unemployment as long as you report the hours and wages correctly. Might help bridge the gap financially.

0 coins

Really? I thought any work would disqualify you from benefits.

0 coins

Nope, Washington has a partial benefit system. Your unemployment gets reduced based on how much you earn, but you can still collect something if you're working limited hours.

0 coins

File your claim this weekend if possible. Washington ESD processes claims faster when filed Sunday-Tuesday vs later in the week for some reason.

0 coins

Is that actually true or just a rumor? Seems weird that the day would matter.

0 coins

Just my observation from helping several people file claims. Could be coincidence but seemed like Sunday/Monday filers got processed quicker.

0 coins

Whatever you do, don't lie or exaggerate anything on your application. Washington ESD will verify everything with your employer and inconsistencies will hurt your case.

0 coins

Good point. I'll stick to exactly what happened without embellishing anything.

0 coins

Exactly. The truth is usually enough if you weren't fired for actual misconduct. Let the facts speak for themselves.

0 coins

Check if your company has an employee handbook that defines their termination policies. Sometimes they don't follow their own procedures which can help your case.

0 coins

That's smart. I think they were supposed to give me progressive discipline before termination but they skipped straight to firing me.

0 coins

Exactly! If they didn't follow their own documented policies, that strengthens your argument that it wasn't misconduct-based termination.

0 coins

One more thing - if you had any union representation at your job, reach out to them too. They might be able to help with both the unemployment claim and potentially fighting the termination itself.

0 coins

No union unfortunately, but I appreciate all the advice everyone's given. Feeling much more confident about applying now.

0 coins

Good luck with your claim! Remember to file ASAP and don't get discouraged if there are delays. The system is slow but it does work eventually.

0 coins

Just to echo what others said about Claimyr - I used it last month when I couldn't get through to Washington ESD for weeks. Finally got to speak with someone who could check on my claim status and explain the next steps. Worth trying if you're stuck in phone hell.

0 coins

Thanks for the recommendation. If I run into issues reaching someone I'll definitely check it out.

0 coins

The video demo they have really explains how the whole process works. Made me feel more confident about using the service.
