How soon can you file for unemployment after being fired in Washington state?

Got terminated yesterday from my warehouse job for attendance issues (missed 3 days in two months due to car problems). My supervisor said I can file for unemployment but I'm not sure when I'm allowed to start the process. Do I need to wait a certain amount of time after being fired, or can I apply right away? Also worried they might deny my claim since it was for attendance. Has anyone been through this situation with Washington ESD?

You can file immediately - there's no waiting period to submit your initial claim. I filed the day after I got let go and had no issues. The sooner you file, the sooner your benefit year starts. Don't wait around thinking you need to.

Thanks! I was worried there might be some kind of cooling off period or something. Going to start the application today.

Yeah definitely file ASAP. Your weekly benefit amount gets calculated from when you first file, not when you actually start receiving payments.

File as soon as possible but be prepared for potential issues with the attendance thing. Washington ESD will look at whether your termination was for 'misconduct' which could include excessive absences. You'll need to provide your side of the story during the adjudication process if they flag it.

0 coins

What exactly counts as misconduct? I had legitimate reasons for missing work (car breakdowns) and I called in each time.

0 coins

Generally misconduct has to be willful or deliberate. If you can show your absences were due to circumstances beyond your control and you followed proper notification procedures, you have a better chance.

Been trying to get through to Washington ESD for weeks about my own claim issues. Their phone lines are absolutely impossible. If you run into problems reaching them, I just found this service called Claimyr that actually got me through to a real person at https://claimyr.com. They have a demo video at https://youtu.be/7DieNd3C7zQ showing how it works.

How much does that cost? Seems like something you should be able to do yourself.

0 coins

Worth it for me since I was spending hours every day trying to call. Much easier than dealing with the busy signals and getting hung up on constantly.

file right away but gather all your documentation first - termination letter, any warnings you got, evidence of your car problems (repair receipts, tow bills, etc). You might need all of this if your claim goes to adjudication

0 coins

Good point about the documentation. I have the repair receipts and can probably get records from the tow company too.

0 coins

I got fired for attendance too and still got approved for UI benefits. The key is showing that you weren't just skipping work for fun. Medical issues, transportation problems, family emergencies - these can all be valid reasons that don't count as misconduct.

0 coins

That's encouraging! Did you have to go through an appeal process or did they approve you initially?

0 coins

Initial approval took about 3 weeks. I think submitting all my documentation upfront helped - repair bills, work schedule showing I tried to make up hours, etc.

0 coins

3 weeks is pretty good timing for adjudication these days. I've seen people waiting 6-8 weeks for decisions.

Make sure you file online through the Washington ESD website, not by phone. The online system is much more reliable and you'll get confirmation that your application went through.

0 coins

Is it the secure.esd.wa.gov site? Want to make sure I'm using the right one.

0 coins

Yes that's the right one. You'll need to create a SAW account if you don't already have one for other state services.

0 coins

Don't let them intimidate you about the attendance thing. Employers always try to claim misconduct to avoid paying into the unemployment fund. Half the time they don't even show up to the hearings.

0 coins

While employers sometimes don't contest claims, you should still be prepared to defend your case properly. Having good documentation makes all the difference.

0 coins

True, but I'm just saying don't assume you'll get denied just because you got fired. The system is supposed to help people who lose jobs through no fault of their own.

0 coins

Whatever you do, don't lie on the application. They'll ask about the reason for separation and you need to be honest. It's better to explain your situation truthfully than try to hide why you got fired.

0 coins

Definitely planning to be honest. I'm hoping the fact that I called in and had legitimate reasons will help my case.

0 coins

I filed the same day I got let go and it was fine. The Washington ESD system asks for your last day of work, not when you decided to file. You're not gaming the system by filing immediately.

0 coins

That makes sense. I was overthinking it I guess.

0 coins

Yeah there's no advantage to waiting. Your benefit year starts from when you file, so delaying just costs you money.

0 coins

Been there with car trouble causing work issues. The key is documentation - keep those repair receipts, towing bills, anything that shows your absences were due to genuine emergencies. I got approved even though I missed work for similar reasons.

0 coins

How detailed did you have to get with the documentation? Just receipts or did you need statements from mechanics too?

0 coins

Just the receipts and dates were enough for me. Shows you actually had car problems on the days you missed, not just making excuses.

0 coins

File today! I made the mistake of waiting a week thinking I needed time to 'process' getting fired. That was a week of potential benefits I lost for no reason. There's literally no benefit to waiting.

0 coins

Good to know. I'll start the application as soon as I get home from this coffee shop.

Just as a follow-up on the Claimyr thing - I used them again yesterday when I had questions about my job search requirements. Much easier than trying to navigate the phone system yourself. Worth checking out if you hit any snags with your claim.

0 coins

Did they actually help resolve your issue or just get you through to someone?

0 coins

They got me connected to an actual Washington ESD agent who could access my account and answer my specific questions. Saved me hours of frustration.

0 coins

attendance issues don't automatically disqualify you especially if you had legitimate reasons and followed proper procedures for calling in. worst case scenario you might have to do a phone interview or appeal but don't assume you'll get denied

0 coins

That's reassuring. I'm feeling more confident about filing now after reading everyone's responses.

0 coins

The Washington ESD adjudication process can take a while if your claim gets flagged, but they're pretty fair about legitimate situations. Transportation issues that prevent you from getting to work aren't usually considered misconduct if you made good faith efforts to resolve them.

0 coins

I did try to arrange alternative transportation when I could. Hopefully that helps show I wasn't just blowing off work.

0 coins

Exactly - showing you made reasonable efforts to attend work despite the challenges will work in your favor during adjudication.

0 coins

File immediately and start your job search activities right away too. Even if your claim is under adjudication, you'll need to show you're actively looking for work once benefits start.

0 coins

Good point about the job search. Do I need to log activities before my claim is approved?

0 coins

You don't have to log them until you start receiving benefits, but it's good to start building a record anyway. Makes it easier when you do need to report.

0 coins

honestly the whole system is designed to help people who lose jobs through no fault of their own. car problems causing attendance issues falls into that category most of the time. just be honest and provide documentation

0 coins

Thanks everyone for all the advice and encouragement. Going to file today and gather up all my documentation just in case.

0 coins

One more thing - when you file, make sure you have all your employment information ready (dates, wages, reason for separation). The application asks for a lot of detail and it's easier if you have everything organized beforehand.

0 coins

I have my last paystub and the termination paperwork. Should I need anything else for the initial filing?

0 coins

That should be enough to get started. They might ask for additional documentation later if your claim goes to adjudication.

0 coins

I was in almost the exact same situation last year - fired for attendance due to car problems. Got approved after about a month of adjudication. The key was showing that I had legitimate reasons and wasn't just unreliable.

0 coins

That gives me hope! Did you have to do a phone interview or just submit documentation?

0 coins

Just submitted documentation initially. They called me about 3 weeks later to ask a few clarifying questions, then approved the claim a few days after that.

0 coins

File now and don't stress too much about the attendance thing. Washington ESD sees these cases all the time and they understand that sometimes people have legitimate reasons for missing work. Your car breaking down isn't misconduct.

0 coins

Really appreciate everyone's help and advice. Feeling much more confident about this whole process now.

0 coins

Good luck with your claim! Let us know how it goes.

0 coins

Just wanted to add that I also used Claimyr when I had issues getting through to Washington ESD about my claim status. Really saved me time and frustration when I needed to speak with an agent about my adjudication. The service at claimyr.com was worth it for me.

Good to know there are options if I run into problems contacting them. Thanks for sharing your experience.
