How long after being fired can I file for Washington ESD unemployment benefits?
Got terminated from my warehouse job last Friday and I'm wondering how quickly I need to get my unemployment claim filed with Washington ESD. My supervisor said it was due to attendance issues but I think it was really because I complained about safety violations. Either way, I need to start getting benefits ASAP since I have rent due next week. Is there a deadline for filing after you get fired? Should I wait a few days or file immediately? Also worried they might deny my claim since it was a firing and not a layoff.

File as soon as possible! There's no waiting period requirement, and the sooner you file, the sooner your claim gets processed. Washington ESD recommends filing the week you become unemployed. Even if you were fired, you can still get benefits if the termination wasn't for misconduct. Safety complaints are actually protected, so that could work in your favor.

•Thanks! I was worried I had to wait or something. Should I mention the safety complaint issue when I file or keep it simple?

•Definitely mention it if they ask about the reason for termination. Be honest but factual - just state that you raised safety concerns and were subsequently terminated for alleged attendance issues.

File right away but don't expect money immediately. My claim took 3 weeks to get approved after I was fired. They have to investigate whether it was misconduct or not, which takes time.

•3 weeks?? How am I supposed to pay bills for 3 weeks without income?

•That's why you file ASAP. The waiting period starts when you file, not when you were fired. And if approved, you get back pay to your first eligible week.

I had trouble getting through to Washington ESD when I needed to file after being terminated. Kept getting busy signals and their online system kept timing out. Finally used this service called Claimyr that calls for you - found it at claimyr.com. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Made the whole process way less stressful since I didn't have to keep trying to call.

•Never heard of that before. Is it legit or some kind of scam?

•It's legit - they just handle the calling part so you don't have to deal with busy signals. Really helped when I needed to speak to someone about my firing and potential misconduct issues.

•I was skeptical too but it actually worked when I couldn't get through any other way. Sometimes you just need to talk to a real person about complex situations.

wait you can file right after being fired??? I thought you had to wait like 2 weeks or something before you could apply for unemployment

•No waiting period to file. You're thinking of the one-week waiting period before benefits start, but that's built into the system automatically.

•oh ok that makes more sense. my friend told me wrong info i guess

Being fired doesn't automatically disqualify you from UI benefits. Washington ESD looks at whether it was misconduct or not. If you were fired for poor performance, not being a good fit, or business reasons, you can still qualify. Misconduct has to be willful and work-related violations.

•What counts as misconduct exactly? They said it was attendance but I was only late a few times due to bus issues.

•Occasional tardiness due to transportation issues usually isn't considered misconduct, especially if you notified your employer. Patterns of unexcused absences might be, but it depends on company policy and circumstances.

File online at esd.wa.gov as soon as you can. Have your Social Security number, last employer info, and dates of employment ready. The system asks about reason for separation - just be truthful about what happened.

•Do I need pay stubs or anything like that when I file?

•Not usually for the initial filing, but keep them handy. Washington ESD might request documentation later during their review process.

The safety complaint angle could actually help your case. Washington has whistleblower protections and retaliation for safety complaints can be considered wrongful termination rather than misconduct.

•Really? I didn't know that. Should I contact L&I too or just focus on the unemployment claim?

•Focus on unemployment first since you need income immediately. You can explore other options later if needed.

Just remember you'll need to do job searches every week once your claim is active. Don't slack on that part or they'll cut your benefits.

•How many job searches do I need to do per week?

Gael Robinson
•Three job search activities per week minimum. Can be applications, networking events, career fairs, etc. Keep good records.

ugh the washington esd system is so frustrating when you get fired. took me forever to get someone on the phone to explain why my claim was under review. ended up using that claimyr thing someone mentioned above and it actually worked

•How long did your review take? I'm already stressing about how long this might take.

•about 2.5 weeks total but once i talked to someone they expedited it. sometimes you just need to get through to the right person

One important thing - make sure you file for the week you were actually unemployed, not the week you file. So if you were fired Friday, that's still considered employed for that week. File for the following week as your first week of unemployment.

•Wait, so I wouldn't get paid for last week at all? Even though I only worked one day?
0 coins
Summer Green
•Correct, you worked part of that week so it doesn't count as a week of total unemployment. Benefits start the first full week you're unemployed.

this whole system is confusing af. why cant they just make it simple - you lose your job, you get help right away

•It's complicated because they need to verify eligibility and prevent fraud. But yes, it could definitely be more user-friendly.

File immediately and be prepared for them to contact your former employer. They'll investigate the firing to determine if benefits should be approved. Keep documentation of everything related to your termination.

•What kind of documentation should I keep? I don't have much from work.

•Any emails, write-ups, safety reports you filed, witness statements, etc. Even notes about conversations you had with supervisors can be helpful.

Been through this process twice. First time took forever, second time I knew to file immediately and it went much smoother. The key is getting your application in ASAP and being completely honest about what happened.

•Did you get approved both times even though you were fired?
0 coins
Ben Cooper
•Yes, both times. First was downsizing disguised as performance issues, second was retaliation for filing a complaint. Neither was considered misconduct.

Don't overthink it - just file. Washington ESD will sort out the details during their investigation. Worst case scenario they deny it and you appeal. But you can't get benefits at all if you don't file.

•True, I guess I have nothing to lose by filing. Thanks for the reality check.

Update on the Claimyr thing I mentioned earlier - they also helped me when Washington ESD needed additional information about my firing. Sometimes the automated system just isn't enough when you have a complex situation like yours with the safety complaints.

•Good to know, I might need that if this gets complicated. How quickly do they get you through?

•Usually same day or next day depending on when you schedule the call. Way better than spending hours on hold or getting disconnected.

File online Sunday night or early Monday morning when the system is less busy. Weekdays during business hours the site gets overloaded and times out constantly.

•Good tip, I'll try that. Didn't think about timing making a difference.

whatever you do dont wait. i waited a week after getting fired and regretted it. every day you wait is potentially money lost even if you get approved later

•Yeah I'm definitely filing today. Thanks everyone for the advice!
