How long after getting fired can I file for unemployment in Washington?
Got terminated from my job yesterday and I'm wondering about the timing for filing my Washington ESD claim. Is there a waiting period or should I file right away? I heard from someone that you have to wait a certain amount of time but I can't find clear info on the Washington ESD website. My supervisor said it was due to restructuring but honestly I think they just didn't like me. Either way I need to get my claim started but don't want to mess anything up by filing too early or too late.

You should file immediately! There's no waiting period in Washington state - you can file your initial claim the same day you lose your job. The sooner you file, the sooner your benefit year starts. Even if you're not sure about all the details, it's better to get the claim in the system.

•Thanks, that's what I was hoping to hear. Do I need any specific documents before I start the application?

•You'll need your Social Security number, employment history for the last 18 months including employer names and addresses, and your bank info if you want direct deposit. If you don't have everything, file anyway - you can always add missing info later.

Yeah definitely don't wait. I made that mistake a few years ago thinking I needed to 'cool off' after getting fired and it just delayed everything unnecessarily. Washington ESD processes claims based on when you file, not when you lost your job.

•How long did the delay end up costing you?

•About 2 weeks of benefits I could have gotten if I'd filed right away. Not huge money but when you're unemployed every bit helps.

The key thing is that your benefit year starts the week you file your initial claim, not the week you lost your job. So if you got fired on Tuesday and file on Friday, your benefits would start that week. But if you wait until the following Wednesday to file, you've lost that first week entirely.

•Wait, so if I file on a Friday does my benefit week start that Friday or the following Sunday?

•Washington ESD benefit weeks run Sunday to Saturday, so if you file on Friday your benefit year would start that Sunday. You'd then need to file your first weekly claim the following week for that partial week.

Just a heads up that since you were fired (not laid off), Washington ESD is going to look closely at the reason for termination. Make sure you're honest about what happened but frame it appropriately. Being fired for performance issues is usually still eligible, but misconduct can disqualify you.

•They said it was restructuring but I think it was really performance related. Should I mention both possibilities on my application?

•Stick with what your employer officially told you - restructuring/lack of work. If Washington ESD contacts your employer and gets a different story, you can address it then. Don't volunteer information that might hurt your claim.

•This is exactly why I had trouble reaching Washington ESD when I needed to clarify my termination details. I ended up using Claimyr (claimyr.com) to get through to an actual agent who could explain how they evaluate these situations. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works. Way better than sitting on hold for hours.

whatever you do DONT WAIT!! I waited like 3 weeks thinking I needed to have everything perfect and it just made everything harder. The Washington ESD system is designed for you to file right away even if you dont have every detail figured out

•Did waiting cause you any problems beyond just the delay?

•yeah they asked why I waited so long and I had to explain it in my application. probably looked like I was working somewhere else or something. just file asap

Since you mentioned being unsure about the termination reason, you might want to request a copy of your personnel file from your employer. In Washington state they have to provide it within a reasonable time, and it could help if there are any disputes about your eligibility.

•Good idea, I'll contact HR today about that.

•How long do employers have to respond to personnel file requests in Washington?

•There's no specific timeframe in Washington law, just 'reasonable time.' Most employers do it within a week or two to avoid issues.

I'm in a similar situation - got let go last week and filed my claim over the weekend. Already got my determination letter saying I'm eligible, so the system definitely works fast when you file right away.

•That's encouraging! How long between filing and getting the determination?

•Filed Sunday night, got the letter Thursday. No issues with my claim though - straightforward layoff situation.

One thing nobody mentioned - make sure you understand the difference between being fired 'for cause' vs other reasons. Washington ESD treats misconduct disqualifications very seriously, but performance issues or personality conflicts usually don't disqualify you.

•How do they determine what counts as misconduct vs just being a bad fit?

•Misconduct has to be willful or negligent behavior that violates your employer's interests. Things like theft, violence, or repeatedly ignoring direct orders. Poor performance or not getting along with coworkers isn't misconduct.

•This is exactly the kind of thing that's worth talking to Washington ESD about directly. I used Claimyr when I had questions about my eligibility after a complicated termination. Much easier than trying to get through on the phone myself.

Just file today if you can. The worst thing that happens is they ask for more information later. The best thing that happens is you start getting benefits as soon as possible. There's really no downside to filing immediately.

•You're right, I'm overthinking this. Going to file this afternoon.

For what it's worth, I was fired from my last job for what they called 'not meeting expectations' and had no trouble getting benefits. Washington ESD seems pretty reasonable about these things as long as you weren't stealing or fighting or something crazy.

•Same here - got fired for 'performance issues' which was really just a bad manager situation. Washington ESD approved my claim with no problems.

The online application is pretty straightforward too. Takes maybe 30-45 minutes if you have your employment history ready. Don't stress about getting every detail perfect - you can always call them later to clarify things.

•Do you remember what the hardest part of the application was?

•Honestly just remembering exact dates and addresses for all my previous employers. I had to look up some old pay stubs and tax forms.

•This is where having a service like Claimyr can really help if you run into issues during the application process. They can walk you through any confusing parts or help you reach someone at Washington ESD if you need clarification.

Quick question - if you file immediately but then find out later that your employer is going to contest the claim, does that cause problems?
0 coins
Amara Chukwu
•No, employer contests are totally normal and expected. Washington ESD will investigate and make a determination. Filing early doesn't hurt you if there's a contest later.

•Good to know, I was worried about that too.

I went through this exact same situation 6 months ago. Filed the day after I got fired, had my first payment within 3 weeks. The key is just getting started with the process as soon as possible.

•3 weeks sounds pretty good actually. I was expecting it to take longer.

•That included the waiting week too. Once the claim was approved payments started coming regularly every week.

One last tip - make sure you keep detailed records of your job search activities from day one. Washington ESD requires you to make at least 3 job search contacts per week, and they do audits.

•Thanks for the reminder. I need to set up my WorkSourceWA account too.

Javier Morales
•Exactly, that's part of the job search requirement. Better to get all that set up early so you're not scrambling later.

Bottom line: file today, worry about the details later. Washington ESD makes it pretty easy to add information or make corrections after you've started your claim.

I was in a similar situation last year - got fired on a Wednesday and was worried about timing too. Filed that same day and it was the right call. The Washington ESD system is set up to handle claims immediately, and there's actually a benefit to filing quickly because your waiting week starts right away. Don't overthink it - the application will walk you through everything step by step, and you can always update information later if needed. The peace of mind of having your claim in the system is worth it.

•That's really helpful to hear from someone who went through the exact same thing! I was definitely overthinking it. The waiting week starting immediately is a good point I hadn't considered. Did you run into any issues during the application process, or was it pretty smooth sailing once you got started?
