Has anyone used Unemployment Law Project for ESD appeal? Need advice ASAP!
I just got my disqualification letter from ESD saying I was terminated for misconduct, which is completely FALSE. My manager had it out for me from day one and made up reasons to fire me after I reported unsafe working conditions at the warehouse. I have my appeal hearing with OAH scheduled in 11 days and I'm completely freaking out. I've never done anything like this before. Has anyone used the Unemployment Law Project for representation? Are they worth contacting? I'm afraid I'll mess everything up if I try to represent myself, but I can't afford a regular attorney. My savings are almost gone after 6 weeks without benefits. Any advice would be really appreciated!

YES! Absolutely contact the Unemployment Law Project immediately! They represented me in January 2025 when ESD wrongly disqualified me for allegedly refusing suitable work. The ULP attorney was incredible - totally prepared, knew exactly what questions to ask my former employer, and helped me prepare my testimony. We won the appeal and I got all my back benefits (about $8,900). They're a legitimate non-profit and their services are free or low-cost depending on your income. They have offices in both Seattle and Spokane. Don't wait - call them tomorrow morning!

I had a similar situation last year. ESD claimed I committed fraud because I accidentally reported my hours wrong one week (I fixed it immediately when I realized). Before you get a lawyer, have you tried calling ESD directly to explain the situation? Sometimes these things can be resolved without going through the whole appeal process. I had to call like 50 times before getting through to an actual person, but when I finally did, they were super helpful. Might be worth a shot before your hearing.

•I've tried calling ESD multiple times but keep getting disconnected. At this point, the appeal hearing is already scheduled so I think I'm past being able to resolve it with a phone call. But thanks for the Claimyr tip - I'll check it out for future reference!

Don't waste your time with ULP! I used them and still lost my appeal. The judge didn't care about anything they said. The whole system is rigged against workers and these non-profits can't change that. You're better off just finding a new job and moving on with your life. ESD is a JOKE.

•I'm sorry you had a bad experience, but that wasn't at all what happened in my case. They dramatically increased my chances of winning. The law is clear that being fired for performance issues usually isn't misconduct unless there was deliberate disregard of the employer's interests. The OP definitely should get representation!

Be prepared to explain why your actions didn't constitute misconduct under WAC 192-150-205 4. Review your employer's response to your claim (you should have received this) Misconduct cases hinge on whether your actions showed deliberate disregard for your employer's interests or willful violations of reasonable policies. If you were fired for performance issues without warnings, that's generally not misconduct under WA unemployment law.

Has anyone else noticed that ESD seems to be automatically denying more claims lately?? My sister and two friends all got disqualified for ridiculous reasons in the past few months. One of them used ULP and won her appeal, the other is still waiting. Seems like they're trying to save money by hoping people don't appeal disqualifications!! Anyway good luck with your case OP!

What's happened is that with the new ESD computer system implemented in late 2024, there are more automated flags that trigger investigations, which can lead to more initial denials. However, the appeal success rate has remained fairly consistent at around 30-35% over the past several years.

UPDATE: I just got off the phone with ULP and they're going to represent me! Even though my hearing is soon, they said they could help. They're sending me a questionnaire to fill out and then will prep with me before the hearing. I'm so relieved! Thank you all for your advice and encouragement (except for the doom and gloom lol). I'll update again after my hearing.
