Got my ESD backpay after winning appeal hearing - timeline for anyone waiting!
So unbelievably relieved right now! Just wanted to share my timeline to maybe help others who are stuck waiting after an appeal hearing. I had my hearing with the OAH last Monday (after waiting nearly 2 months for it to be scheduled). The judge ruled in my favor on Friday afternoon - I got the notice through my eServices account. Yesterday was a holiday, and then BOOM - this morning I checked my account and my entire backpay amount ($7,850) hit my bank account! No notification from ESD or anything, just suddenly there. I was denied initially because my former employer claimed I quit voluntarily, but I had documentation showing I was basically forced out after they changed my job duties completely. The judge totally understood my side. For anyone waiting on appeal results - how long did it take for your payments to start after winning? I was shocked it was this fast! Keep your heads up everyone!

•Thanks! Wow, 5 weeks?? I was expecting at least a couple weeks of waiting. Maybe I just got assigned to someone who processed things quickly? Or maybe because I had already submitted all my ID verification stuff months ago?

Congratulations on winning your appeal! The timeline can vary significantly depending on several factors. In general, after a favorable decision from OAH, ESD has to process the judge's order and remove any disqualifications on your claim. This typically takes 1-2 weeks, but as you experienced, can sometimes happen immediately after a holiday weekend. A few things that might affect the timing: - Whether your identity verification is already complete - If you continued filing weekly claims during the appeal process - The current workload of the claims processing team - Whether your claim had any other issues besides the initial denial For anyone else reading this who's going through an appeal - make sure you keep filing your weekly claims even while waiting for your hearing. This ensures you'll get all your backpay if you win!

•this is so true about keeping weekly claims! my friend didnt do her claims during the appeal and when she won they only paid her from when she started filing again NOT for all the weeks she couldve gotten. so sad

I won my appeal last year and it took THREE MONTHS to get my backpay!!! The ESD is TERRIBLE about processing these things consistently! I had to call them 14 times before someone finally fixed it in their system. The judge had ruled in my favor but the ESD people claimed they "never received the paperwork" even though I could see it in my eServices account!!! THE SYSTEM IS BROKEN!!!

•Oh no, that sounds like a nightmare! Did you try contacting your state representative? I've heard that sometimes helps speed things up when ESD is dragging their feet.

•YES I contacted my rep after 2 months and that's the ONLY reason it got fixed! Otherwise I'd probably STILL be waiting!!! The whole unemployment system is designed to make people give up!!!

My timeline was about 10 days after winning my appeal. The key factors that affect payment speed are: 1. Whether you've already completed ID verification 2. If your claim had multiple issues or just one 3. Whether your former employer plans to appeal the OAH decision 4. How backed up ESD is with claims processing One important note - you mentioned you got the backpay but not a notification. Check your eServices account for any new documents. There should be a formal notice that shows the status change from disqualified to qualified. This is important documentation to save in case there are any issues later.

•That's a good point about checking for documents! I just logged in and found a "Redetermination Notice" dated yesterday that says my disqualification was removed. So I guess they did process it yesterday even though the money didn't show up until today. Thanks for the tip!

I've been waiting 3 weeks since winning my appeal and still nothing. I've been calling ESD every day but can't get through - just endless busy signals or getting disconnected after waiting on hold forever. Anyone know a better way to reach them? This is so frustrating!

•I had the same problem last month and found this service called Claimyr that got me through to an ESD agent in about 15 minutes. Basically they keep calling for you and then connect you when they get through. I was skeptical at first but it worked really well. There's a video showing how it works at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 and their website is claimyr.com. The agent I talked to was able to look at my claim and tell me exactly why it was delayed and what needed to be done to release my payments.

•You should definitely call ESD about this. It sounds like either: 1. There might be another issue affecting part of your claim period 2. They may have only processed some of your weeks 3. There could be deductions for taxes or other offsets Check your payment history in eServices to see exactly which weeks were paid and which weren't. Look for any letters or notices that might explain the partial payment. But ultimately, you'll need to speak with an agent to get this resolved.

•Yes! I actually made sure to do my 3 job search activities every week even though I was disqualified and appealing. I entered them all in my weekly claims just in case I won. The judge specifically mentioned during my hearing that I needed to have those done for any weeks I wanted to claim, so I'm really glad I kept up with them!

•This is excellent advice. Many people don't realize that job search requirements still apply during the appeal process. If you haven't been doing them, you might be asked to complete job search activities retroactively or risk losing those weeks of benefits, even after winning your appeal.

my cousin just got denied and hes thinking about appealing. how hard was the hearing??? did you have a lawyer? im trying to help him figure out if its worth it

•I didn't have a lawyer, but I spent about a week preparing. I gathered all my emails with my boss, the original job description, and the new duties they wanted me to do. The hearing was over the phone and lasted about 45 minutes. The judge was actually pretty nice and just wanted to understand the facts. My employer showed up too and gave their side. I was super nervous but just stuck to explaining exactly what happened. Tell your cousin to request all the documentation from his employer that they submitted to ESD - that helped me see exactly what they were claiming so I could prepare to address it.
