ESD partial payment after overpayment waiver - still waiting on $2900 balance
Has anyone dealt with only getting PART of your payment after an overpayment waiver? I've been fighting with ESD for almost 2 years and FINALLY got my overpayment waived last month. They deposited a small amount (like $460) to my account last week, but according to my calculations they still owe me around $2900! When I called, the agent just said "we don't know when the rest will be processed" and couldn't give me ANY timeline. How is this even legal??? I've been waiting 2 YEARS already and now that my waiver was approved, they're still making me wait with no explanation. My rent is due next week and I was counting on this money. Anyone had a similar experience with partial payments after waiver approval? Did you eventually get the full amount?

Unfortunately, this is pretty common with ESD when they process overpayment waivers. They often release funds in batches rather than all at once. When my overpayment was waived in 2023, I received three separate payments over about 6 weeks. The first was about 30% of what I was owed, then two more payments that made up the rest. Make sure you keep detailed records of exactly what they owe you. Check your ESD account daily for any notices about the remaining payments. The system should show a breakdown of which weeks were included in that first $460 payment.

•Ugh, 6 WEEKS?? I can't wait that long! Did they at least tell you there would be multiple payments? The agent I talked to acted like she had no clue if or when I'd get the rest. My account doesn't show anything about future payments either, just that my waiver was approved.

This EXACT same thing happened to me!!! I got my overpayment waived in January after fighting for like 18 months and they sent me $720 which was only about 1/4 of what they owed me. I called like 15 times and nobody could tell me when I'd get the rest. SO FRUSTRATING!!!! I ended up getting the remaining money about 3 weeks later in 2 more payments. No explanation, no notice, they just randomly appeared in my account. ESD is THE WORST about communication. They never tell you what's actually happening with your money.

•OMG the waiver process was a NIGHTMARE!!! I had to submit like 50 documents showing financial hardship (bank statements, bills, etc) and write this long statement explaining why paying it back would cause hardship. Then they denied it TWICE before finally approving it on the third try. Took FOREVER. Good luck!

Have you checked with ESD to make sure the waiver covered your entire overpayment amount? Sometimes they only waive partial amounts based on specific weeks they determined were eligible for waiver. The remaining balance could still be considered valid overpayment in their system. I recommend requesting a formal breakdown of: 1. Total overpayment amount originally assessed 2. Exact amount waived 3. Any remaining balance they believe you still owe 4. Which specific weeks were included in the payment you already received This would at least clarify if you're actually owed the remaining $2900 or if there's some confusion about what was waived.

•That's a good point. My determination letter does say "full waiver approved" but maybe that doesn't mean what I think it means? I'll definitely ask for that breakdown next time I can get through to them.

If you need to talk to an actual human at ESD about your remaining payment, try using Claimyr (claimyr.com). I was in a similar situation with partial payments after my adjudication was resolved, and I couldn't get through to anyone for weeks. •It worked for me and several people I know. The ESD agent I talked to was able to see exactly which weeks were included in my first payment and confirmed the remaining weeks were in the queue for processing. At least you'd get a straight answer about what's happening instead of the runaround.

•My original overpayment was around $8,700. They waived the whole thing and are supposed to pay it all back because they determined it was their mistake, not mine. So far I've only gotten $460 of the $3,360 they owe me.

I waited 3 months after my waiver approval to get ALL my money back!! And that was with calling them every single week! The entire system is designed to wear us down so we give up. DON'T GIVE UP. Keep calling and document everything. I finally had to contact my state representative to get the rest of my payment released. Suddenly they "found" my money after the rep's office inquired. Funny how that works!!!
