ESD still hasn't responded to my overpayment waiver after 4 months - now taking money from my new claim

I'm seriously at my wit's end with ESD's waiver process. It's been 4 months since I submitted my overpayment waiver, and I haven't heard a single thing from them. Meanwhile, they've started taking $166 per week from my current claim to repay the supposed overpayment! Some background: I had three previous overpayment notices that were all approved for waivers. Then ESD randomly decided to "recalculate" my benefits from 2023 and sent a fourth overpayment notice. I never even got a chance to appeal before they started garnishing my new unemployment checks. I'm falling behind on rent and utilities. My weekly benefit should be $332, but I'm only getting half that now. According to the ESD website, my file was on an adjudicator's desk, then suddenly changed to "waiting for adjudicator" a week later. It's like they deliberately pushed my file to the bottom of the pile! Anyone else dealt with this waiver delay nightmare? How long did your waiver take to process? Did you do anything that actually got ESD to respond? I've called about 20 times in the past month and can't get through to anyone who can help.

This exact thing happened to me last year. My waiver took almost 5 months to process, and ESD was taking $210 out of my benefits every week. What I did was contact my state representative's office and explained my situation. Their constituent services staff contacted ESD directly, and suddenly my waiver was processed within 10 days. I got all my money back in one lump sum payment about a week after that. You should be able to find your state rep's contact info online. Just google "[your county] WA state representative" and reach out to their office. They actually have staff dedicated to helping with ESD issues.

I had a similar situation, though not quite as bad. My waiver was pending for about 3 months. The key insight I can share is that waivers are handled by a completely separate team from regular adjudicators. The "waiting for adjudicator" status you're seeing is misleading - it's actually in a different queue altogether. Make sure when you call, you specifically ask to speak with someone from the overpayment/collections department, not just any claims agent. They're the only ones who can see the actual status of your waiver and potentially expedite it.

THEY ARE DOING THIS ON PURPOSE!! The entire system is designed to make people give up and not get the money they're owed. I had THREE waivers that took 7 months to process. By the time they finally approved them, I had already paid back over $2,000 from my weekly benefits that I should never have had to pay!! You NEED to be persistent. Call EVERY SINGLE DAY. Send messages through eServices EVERY. SINGLE. DAY. Document everything. Ask for supervisor names. Write down who you talked to and when. Eventually, they'll process your waiver just to get you to stop bothering them. The system is DESIGNED to fail people who need help the most. It's DISGUSTING!!

i get being upset but calling every day wont help... they just put u back in the same queue each time. i worked in a call center (not esd) & thats not how it works. they're probably understaffed & overwhelmed, not evil.

my waiver took 6 months to process so 4 months isn't that bad tbh. they eventually approved it and i got all my money back. just keep waiting, its frustrating but theres not much u can do to speed it up.

One thing I haven't seen mentioned yet - make sure you continue to file your weekly claims properly while waiting for the waiver decision. If you miss filing claims during this period, it can complicate things even more. Also, double-check your Notices section in eServices to see if they've sent you any letters requesting additional information that you might have missed. Sometimes waivers get held up because ESD is waiting for documentation they requested, but the notice got lost in the mail or filtered to spam in your email. Worth checking!

Thanks for this! I just checked my Notices section and there's nothing new there. I've been filing my claims religiously every week - too afraid to miss one. But I'll keep an extra close eye on my mail and email just in case they send something.

ugh this is exactly why i tell everyone to always appeal EVERYTHING with unemployment!! even if you think you might owe the money, always file the appeal and waiver request because once they start taking money its so hard to get it back. sorry ur dealing with this, the waiting is the worst part :/

This is actually really good advice. Always appeal within the deadline, even if you're not sure. You can always withdraw the appeal later, but you can't file one after the deadline has passed. I learned this the hard way with my first overpayment notice.

wait so they approved ur first 3 waivers but not the 4th one for the same issue?? that makes no sense!! did u use the same reason for all of them? im confused how they could approve some but not others

They haven't denied the 4th one - they just haven't responded at all! But they started taking money from my checks anyway. The first 3 were all related to them miscalculating my hours. This 4th one came out of nowhere a year later when they "recalculated" something from 2023. The whole thing is a mess.
