Can you get long term disability and unemployment at the same time Washington ESD?
I'm really confused about this situation. I've been on long-term disability for about 8 months now due to a back injury from my warehouse job. My disability benefits are only covering about 60% of what I was making, and I'm struggling financially. A friend told me I might be able to collect unemployment benefits from Washington ESD too since I'm technically unemployed. But I thought you had to be able and available to work for UI benefits? Has anyone dealt with this before? I don't want to mess up my disability claim but I really need the extra income.

This is a tricky situation and the rules are pretty specific. Generally speaking, to qualify for unemployment benefits in Washington, you need to be able and available for work. If you're receiving long-term disability, that usually means you're certifying that you cannot work due to your medical condition. Washington ESD considers this a conflict - you can't simultaneously claim you're unable to work (for disability) and able to work (for unemployment).

•That makes sense but it's so frustrating. The disability payments barely cover my rent let alone everything else.

•I was in a similar spot last year. The state sees it as you can't claim both - it's one or the other unfortunately.

There might be some exceptions depending on your specific situation. If your disability allows you to do certain types of work (like sedentary work when you previously did physical labor), you could potentially qualify for unemployment while looking for suitable work within your restrictions. You'd need to get medical clearance stating what work you can do and register with WorkSource.

•My doctor said I could probably do desk work but nothing that requires lifting over 10 pounds. Would that count?

•Possibly, but you'd need documentation from your doctor specifically stating you're able and available for work within those restrictions. Washington ESD would need to see that you're actively job searching for appropriate positions.

I went through this exact situation in 2023. I was on disability but my doctor eventually cleared me for light duty work. I had to get a letter from my doctor stating I was able to work with restrictions, then I applied for unemployment. It took forever to get through to Washington ESD to explain my situation though - kept getting hung up on after waiting on hold for hours. Finally used this service called Claimyr (claimyr.com) that got me through to an actual agent who could review my case properly. They have a video demo at https://youtu.be/7DieNd3C7zQ that shows how it works.

•How long did it take for them to approve your claim once you got through to someone?

•About 2 weeks after I spoke with the agent and submitted all my medical documentation. The key was having that doctor's letter specifically stating what work I could do.

•Never heard of Claimyr before but might have to check it out. I've been trying to reach Washington ESD for weeks about my own issues.

be careful with this because if you collect both and theyre not supposed to overlap you could end up owing money back. happened to my cousin

Freya Collins
•That's exactly what I'm worried about. Did your cousin have to pay it all back?

•yeah they made him pay back like $4000 in unemployment benefits plus penalties. took him months to sort out

The safest approach is to contact Washington ESD directly before applying for unemployment while on disability. They can review your specific medical restrictions and employment situation to determine eligibility. You'll likely need: 1) Medical documentation of your work restrictions, 2) Proof you're actively seeking work within those restrictions, 3) Registration with WorkSource WA for job search assistance.

•Good luck getting through to them though. I've been trying for 3 weeks just to ask about my weekly claim issue.

•The phone lines are definitely challenging. Early morning calls (right at 8am) tend to have better success rates.

I work in HR and deal with this question sometimes. The key distinction is whether your disability is total or partial. If you're on total disability, you typically cannot collect unemployment. If you're on partial disability or have work restrictions but can still perform some jobs, you might qualify for unemployment benefits while searching for suitable work.

•My disability is through my employer's insurance - does that make a difference versus social security disability?

Carmella Fromis
•Yes, that can make a difference. Private disability insurance often has different criteria than SSDI. You'd need to check your policy terms and coordinate with Washington ESD.

•This is exactly the kind of complex situation where talking to an actual Washington ESD representative is crucial rather than guessing.

Whatever you do, don't just start filing weekly claims without getting approval first. Washington ESD takes benefit fraud seriously and even if it's an honest mistake, you could face penalties. Get everything in writing from them before proceeding.

•That's good advice. I definitely don't want to get in trouble for trying to follow the rules.

•Absolutely agree. Always better to ask first than deal with an overpayment situation later.

Has anyone tried appealing a denial for this situation? I got denied for UI while on partial disability last year but never followed up on it.

•You can appeal UI denials, but you typically only have 30 days from the denial notice. If it's been longer than that, you'd need to show good cause for the delay.

•It's been way longer than 30 days unfortunately. Probably too late now.

The able and available requirement is the biggest hurdle here. You have to certify weekly that you're able and available for work. If your disability documentation says otherwise, that creates a conflict Washington ESD will catch during adjudication.

•So even if I'm cleared for light duty work, I'd have to prove I'm actively looking for those specific types of jobs?

Raúl Mora
•Exactly. You'd need to show you're applying for jobs within your restrictions and available to accept suitable work offers.

I'm dealing with something similar right now. Been on short-term disability for 3 months and it's about to run out. My doctor says I can return to work with restrictions but my employer doesn't have any suitable positions. Wondering if I can transition to unemployment benefits.

Sara Hellquiem
•That's actually a more straightforward situation. If your employer can't accommodate your restrictions and you're medically cleared for some work, you may qualify for UI benefits while searching for appropriate employment.

•Thanks, that gives me some hope. I'll need to get the right documentation from my doctor first.

DONT DO IT! I tried this and got in huge trouble. They made me pay everything back plus interest. Just stick with your disability benefits and dont risk it.

Freya Collins
•Yikes, that's scary. Did you have medical clearance to work or did you apply without it?

Evelyn Kim
•I thought I was cleared but apparently the documentation wasn't specific enough for Washington ESD. They said I was still classified as unable to work.

The timing matters too. If you're transitioning off disability and back to work availability, there's usually a specific process to follow. Don't overlap the benefits - end one before starting the other if possible.

Freya Collins
•That makes sense. Better to have a gap than to risk owing money back.

I used Claimyr about 6 months ago for a different issue and it was worth it. Saved me weeks of trying to get through on the phone. The agent I spoke with was really knowledgeable about these complex situations.

•How much does it cost? I'm already strapped for cash.

•It's reasonable considering how much time and frustration it saves. Way better than losing wages while waiting weeks to talk to someone.

Check with WorkSource WA too. They have disability employment specialists who understand these situations and can help you navigate both the job search requirements and benefit coordination.

Bottom line - get professional advice before making any moves. This isn't something to guess about given the potential consequences.

One more thing - if you do get approved for both, make sure you report the disability income on your weekly unemployment claims. Failure to report other income is considered fraud even if it's an oversight.

Freya Collins
•Good point. I'll make sure to be completely transparent about everything if I move forward.

•Exactly right. Always report all income sources on your weekly claims to avoid issues later.
