Can you file unemployment if you were fired - Washington ESD eligibility question
I got terminated from my job last week and I'm not sure if I can even apply for unemployment benefits through Washington ESD. My manager said I was fired for performance issues but I think it was really because I couldn't work the overtime they wanted due to my kid's daycare schedule. Does being fired automatically disqualify you from getting UI benefits in Washington? I've never filed for unemployment before and I'm really stressed about how I'm going to pay my bills.

You can definitely file for unemployment even if you were fired! Washington ESD doesn't automatically deny claims just because you were terminated. The key is whether you were fired for 'misconduct' or not. Performance issues usually don't count as misconduct unless it was willful or you were deliberately ignoring your job duties.

I work in HR and see this all the time. Being fired for performance issues is usually not misconduct unless the employee was deliberately performing poorly or refusing to improve after coaching. Inability to work overtime due to childcare is definitely not misconduct.
