Can you file for unemployment if you were fired in Washington state?
I got fired from my job last week and I'm not sure if I can even apply for unemployment benefits through Washington ESD. My manager said it was due to 'performance issues' but I honestly think they just wanted to get rid of me because I complained about working conditions. Does being fired automatically disqualify you from getting UI benefits? I've never had to deal with this before and I'm really stressed about how I'm going to pay my bills.

You can definitely file for unemployment even if you were fired! It depends on WHY you were fired though. Washington ESD will look at whether it was misconduct or just poor performance. If it was performance issues and not something like stealing or violating company policy, you should be eligible. File your claim right away because there's a waiting period.

•That's a relief to hear. What counts as misconduct exactly? I was never written up for anything serious, just told my work wasn't meeting expectations.

•Misconduct is usually willful behavior like theft, harassment, or deliberately breaking rules. Poor performance alone isn't misconduct. You should be fine to file.

I was in the same situation last year. Got fired for 'not being a good fit' and was terrified to apply. Washington ESD approved my claim after about 3 weeks. The key is being honest on your application about what happened but also explaining your side of the story.

•Did your employer contest your claim? I'm worried they might try to fight it.

•They did contest it initially, but Washington ESD still approved me. They interviewed both me and my former supervisor over the phone. Just be truthful and you'll likely be fine.

Here's what you need to know: Washington state has 'at-will' employment, meaning you can be fired for almost any reason EXCEPT misconduct that would disqualify you from UI benefits. Performance issues, personality conflicts, business restructuring - these don't disqualify you. File immediately because benefits are retroactive only to when you file, not when you lost your job.

•This is super helpful info. How long does it usually take to get approved after filing?

•If there's no employer contest, usually 1-2 weeks. If your employer disputes it, Washington ESD has to do an investigation which can take 3-6 weeks.

I've been trying to reach Washington ESD for weeks about my claim status and their phone system is impossible. Constant busy signals or I get disconnected after waiting on hold for hours. Has anyone found a way to actually talk to a real person there?

•I had the same problem until I found this service called Claimyr (claimyr.com). They help you get through to Washington ESD agents by handling the calling for you. I watched their demo video (https://youtu.be/7DieNd3C7zQ) and decided to try it. Got connected to an agent within a few hours instead of spending days trying myself.

•That sounds too good to be true. How much does it cost?

•It's definitely worth it when you consider how much time and frustration it saves. I was able to resolve my adjudication issue the same day instead of waiting weeks.

whatever you do dont mention anything about complaining about working conditions when you file. that could be seen as insubordination or causing problems. just say it was performance related.

•I disagree with this advice. You should be honest about what happened. If you were raising legitimate safety concerns, that's actually protected activity.

•maybe but why risk it? keep it simple and focus on the performance angle

•Being honest is always the best approach. Washington ESD will likely contact your employer anyway, so inconsistencies in your story could hurt your claim.

I got fired 6 months ago and my claim is STILL under adjudication. Washington ESD is absolutely useless. They keep saying they need more information but never tell me what information they actually need. This system is broken.

•6 months?! That's insane. Have you tried appealing or contacting your state representative?

•I've tried everything. Even got a lawyer involved. Washington ESD just keeps saying they're backed up and to wait.

•That's when services like Claimyr really help. They can get you connected to someone who can actually look at your case and explain what's holding it up.

Quick question - do you have to do the job search requirements even while your claim is pending? I don't want to mess anything up by not following the rules.

•Yes, you need to start looking for work immediately and keep a job search log. You'll need to report your work search activities when you file your weekly claims.

•Thanks! Better safe than sorry. I'll start applying places tomorrow.

Been there, done that. Filed after getting fired for 'attitude problems' (aka standing up for myself). Washington ESD approved my claim but it took forever because my employer fought it. Document everything you can remember about the firing - dates, conversations, any witnesses. You'll need it if they contest your claim.

•Good advice about documenting everything. I wish I had thought to do that before I left.

•It's not too late! Write down everything you remember now while it's still fresh. Even small details can matter.

The whole system is designed to discourage people from filing. They make it so complicated and hard to reach anyone. But don't let that stop you - you paid into this system through your taxes and you deserve benefits if you qualify.

•Exactly! I felt so ashamed when I had to file but then realized I'd been paying into unemployment insurance my whole career. It's not welfare, it's insurance you've already paid for.

•That's a good way to think about it. I do feel embarrassed about needing help but you're right, I've been paying into the system.

Just file online through the SecureAccess Washington portal. Don't overthink it. Answer the questions honestly and let Washington ESD make the determination. The worst they can do is say no, but you won't know unless you try.

•You're right, I need to just do it. Thanks for the encouragement!

•And file ASAP! Every day you wait is money you're potentially losing.

I'm a former Washington ESD employee and I can tell you that most people who get fired for performance issues are approved for benefits. The bar for misconduct is actually pretty high - it has to be willful violation of company policy or deliberate harmful behavior. Poor performance, personality conflicts, or business decisions don't qualify as misconduct.

•This is so reassuring to hear from someone who actually worked there! Thank you.

•Question for you - what's the deal with adjudication taking so long lately? Seems like everyone's waiting months.

•They're understaffed and still dealing with the backlog from the pandemic. Plus they have to investigate every contested claim thoroughly. It's frustrating but they're doing their best.

File immediately and don't let anyone tell you that you can't get benefits just because you were fired. I was fired from three different jobs over the years and got approved for UI every single time. The only time I was denied was when I quit without good cause.

•Three times? What happened if you don't mind me asking?

•Different reasons each time - downsizing, personality conflict with manager, and performance issues. Only the last one was contested and I still won.

Pro tip: when you file your weekly claims, be very careful about how you answer the questions. One wrong answer can mess up your whole claim. And make sure you're doing your job search activities - Washington ESD will audit those.

•What kind of job search activities do they require? I haven't looked into that yet.

•You need to make at least 3 job contacts per week and keep detailed records. They can ask for your job search log at any time.

•And don't just apply online - they want to see variety like networking, attending job fairs, working with WorkSource, etc.

I used Claimyr when I couldn't get through to Washington ESD and it was a lifesaver. My claim had been stuck in adjudication for two months and I was getting desperate. They got me connected to an agent who was able to tell me exactly what documentation was missing from my file. Resolved the whole thing in one phone call.

•That sounds amazing. I'm definitely going to check that out if I can't get through myself.

•How does it work exactly? Do they just keep calling until they get through?

•They have a system that handles the calling and waiting so you don't have to. Check out their demo video - it explains everything better than I can.

UPDATE: I filed my claim this morning and it was way easier than I expected. The online system walked me through everything step by step. Now I just have to wait and see if it gets approved. Thanks everyone for the encouragement and advice!
