Washington ESD eligibility after being fired - am I still able to get unemployment benefits?

So I got let go from my job last week and I'm trying to figure out if I can even apply for unemployment through Washington ESD. My manager said it was for 'performance issues' but honestly I think they just wanted to get rid of me because I complained about unsafe working conditions. I've been working for 2 years and paying into the system. Does being fired automatically disqualify you from getting UI benefits in Washington? I really need to know before I waste time filing a claim.

Being fired doesn't automatically disqualify you from Washington ESD benefits. It depends on WHY you were fired. If it was for misconduct, then yes you'd be disqualified. But if it was for performance issues or not being a good fit, you should still be eligible. You need to file your claim and let Washington ESD make the determination.

What exactly counts as misconduct though? They said I wasn't meeting productivity standards but I feel like they were unrealistic.

0 coins

Misconduct has to be deliberate or willful violation of company rules. Poor performance due to inability rather than unwillingness usually doesn't count as misconduct.

0 coins

You should definitely file your claim right away. The worst they can do is deny it, but you might be surprised. I got fired for attendance issues (I was having car trouble) and still got approved for benefits after they reviewed my case.

0 coins

How long did the review process take? I'm worried about going weeks without any income.

0 coins

Mine took about 3 weeks for the initial determination. They called both me and my former employer to get both sides of the story.

If you're having trouble getting through to Washington ESD to check on your claim status, I recently discovered claimyr.com - it's a service that helps you actually reach ESD agents by phone. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me hours of calling and getting hung up on.

0 coins

Is that legit? I'm always skeptical of third-party services when it comes to government stuff.

0 coins

Yeah it's real. They don't ask for any personal info - just help you get connected when ESD phone lines are busy. Worked for me when I needed to resolve an adjudication issue.

0 coins

MAKE SURE you document everything about why you were fired. Save any emails, write down dates and what was said. If Washington ESD puts you in adjudication (which they probably will since you were terminated), you'll need evidence to support your side of the story.

0 coins

I do have some emails where I raised concerns about the safety issues. Should I include those when I file?

0 coins

Absolutely. Anything that shows you were acting in good faith and following proper procedures. Retaliation for reporting safety concerns could actually work in your favor.

0 coins

Good point. Washington state has strong whistleblower protections, so if they fired you for reporting safety violations, that's definitely not misconduct on your part.

0 coins

i got fired for being late too many times and still got unemployment so dont worry about it too much. just file your claim online and see what happens

0 coins

Really? I thought attendance issues would count as misconduct. Maybe it depends on the circumstances.

0 coins

yeah they asked me about it and i explained i was taking care of my sick kid and didn't have reliable childcare. they approved it

0 coins

This is so stressful. I was fired from my last job too and I'm terrified Washington ESD will deny my claim. The uncertainty is killing me while I wait for their decision. How do you even function while waiting weeks to find out if you'll have any income?

0 coins

I totally get the anxiety. Try to file for other assistance programs in the meantime - SNAP, energy assistance, etc. At least that can help with basic needs while you wait.

0 coins

Good idea. I didn't even think about other programs. This is all so overwhelming when you're already dealing with losing your job.

0 coins

The key thing is being honest on your application. Don't try to hide that you were fired - Washington ESD will find out anyway when they contact your employer. Just explain your side of the story clearly and let them make the determination.

0 coins

That's good advice. I was wondering if I should try to phrase it differently but you're right, they'll get the employer's version anyway.

0 coins

Exactly. Plus if they catch you being dishonest, that could actually disqualify you even if the firing itself wouldn't have.

0 coins

Washington ESD is so backed up right now it's ridiculous. I've been trying to get through to them for WEEKS about my adjudication status. The phone system is a joke - you wait on hold forever just to get disconnected.

0 coins

That's exactly why I used that Claimyr service I mentioned earlier. They handle the calling for you and actually get you connected to an agent. Worth checking out if you're frustrated with the phone system.

0 coins

At this point I'm willing to try anything. I'll look into it.

0 coins

Just wanted to add - even if you get denied initially, you can appeal the decision. I won my appeal after being denied at first. The hearing officer was much more thorough than the initial reviewer.

0 coins

How long does the appeal process take? And do you need a lawyer?

0 coins

My appeal hearing was scheduled about 6 weeks after I filed it. You don't need a lawyer but you can have one. I represented myself and it went fine.

0 coins

The appeals process is actually pretty straightforward. Just make sure you have all your documentation organized before the hearing.

0 coins

Been there done that. Got fired for 'attitude problems' which was basically code for not putting up with my toxic boss. Still got approved for benefits because Washington ESD recognized it wasn't misconduct, just a personality conflict.

0 coins

That gives me hope. My situation sounds similar - they said performance issues but I think it was really about me speaking up about problems.

0 coins

Yeah, stick to your guns. If you were doing your job and following the rules, being fired for standing up for yourself or reporting issues shouldn't disqualify you.

0 coins

ugh this whole system is so confusing. why cant they just have clear rules about what disqualifies you instead of making everyone guess?? like just tell us upfront if we're eligible or not

0 coins

I understand the frustration, but every situation is different. That's why they have to review each case individually. What might be misconduct in one context might not be in another.

0 coins

i guess that makes sense but its still stressful not knowing

0 coins

File your weekly claims even while you're waiting for the adjudication decision! A lot of people don't realize this but you need to keep certifying or you'll lose those weeks even if you get approved later.

0 coins

Wait, really? I thought you couldn't file weekly claims until your initial claim was approved.

0 coins

Nope, you file them right away. They'll just hold the payments until your eligibility is determined. But if you don't file them, you can't get paid for those weeks later.

0 coins

This is super important! I almost missed out on 4 weeks of payments because I didn't know this rule.

0 coins

Does anyone know how long Washington ESD keeps records of previous claims? I'm worried they might look at an old disqualification from like 5 years ago when I was young and stupid.

0 coins

Each claim is evaluated on its own merits. An old disqualification shouldn't affect your current claim unless there's a pattern of misconduct.

0 coins

That's a relief. I was a completely different person back then and this situation is totally unrelated.

0 coins

I used to work for an employer who fought every single unemployment claim, even the legitimate ones. It was so wrong. Some companies just try to make it as hard as possible for former employees to get benefits.

0 coins

That's terrible. Do you think my employer will fight it? They seemed pretty eager to get rid of me.

0 coins

Hard to say, but even if they do contest it, Washington ESD will still make an independent determination based on the facts. Don't let the possibility of them fighting it discourage you from filing.

0 coins

Pro tip: when you file your claim, be very specific about the job search requirements. Since you were fired, you'll need to be actively looking for work and keeping a log of your job search activities.

0 coins

What kind of job search activities count? I've been applying online but haven't heard back from anyone yet.

0 coins

Online applications count, but you also need at least 3 work search activities per week. That can include networking, attending job fairs, or contacting employers directly.

0 coins

The whole system is designed to make people give up. Between the confusing website, the impossible phone system, and the weeks of waiting, they're hoping you'll just find another job and stop trying to claim benefits.

0 coins

That's pretty cynical but probably not wrong. I've seen too many people give up when they had valid claims just because the process was so frustrating.

0 coins

That's another reason why services like Claimyr are helpful - they cut through the bureaucratic runaround and actually get you connected to someone who can help.

0 coins

Quick question - if I file for unemployment but then find a job before the claim is processed, do I need to cancel the claim or just stop filing weekly claims?

0 coins

You should report the job when you file your next weekly claim. The system will automatically stop your benefits once you report full-time employment.

0 coins

Thanks! I have a promising interview next week so I wanted to know what to do if it works out.

0 coins

Bottom line - file your claim. Don't try to second-guess whether you'll be approved or not. Let Washington ESD make that determination. You've paid into the system and you deserve to have your case heard fairly.

0 coins

You're absolutely right. I'm going to file today. Thanks everyone for all the advice and encouragement!

0 coins

Good luck! Remember to keep detailed records of everything and don't give up if you get an initial denial. The appeals process exists for a reason.
