Can you claim unemployment on maternity leave in Washington state?

I'm currently on unpaid maternity leave from my job and wondering if I can file for unemployment benefits through Washington ESD while I'm off work. My employer doesn't offer paid maternity leave and I've been out for 2 weeks already with about 4 more weeks to go. I know I'm technically still employed but not getting paid. Has anyone been in this situation? Can I apply for UI benefits during maternity leave or do I need to wait until I'm actually looking for work again?

Unfortunately, you typically can't collect regular unemployment benefits while on maternity leave because you have to be able and available for work to qualify for UI. Since you're still employed and not actively seeking work, Washington ESD would likely deny your claim.

That's what I was afraid of. It's frustrating because we really need the income right now.

Have you looked into Paid Family and Medical Leave (PFML) through the state? That might be what you need instead of regular unemployment.

0 coins

You should definitely check if you qualify for Washington's Paid Family and Medical Leave program rather than unemployment. PFML is specifically designed for situations like yours - bonding with a new child. It's administered separately from Washington ESD unemployment.

I didn't even know that existed! How do I apply for PFML?

0 coins

You apply through the state's PFML website, not the unemployment site. It's a different system entirely.

I tried to get unemployment during my maternity leave last year and Washington ESD denied it immediately. They said I wasn't 'able and available' for work which is a requirement for UI benefits. But I did get approved for PFML which paid 90% of my wages for 12 weeks.

0 coins

90% of wages sounds way better than unemployment anyway! I'm definitely going to look into PFML now.

0 coins

Wait, how did you get 90%? I thought PFML was less than that.

0 coins

It depends on your income level. Lower income workers can get up to 90% while higher earners get less. There's a sliding scale.

You definitely can't get regular UI while on maternity leave, but honestly trying to reach someone at Washington ESD to get a clear answer about your specific situation can be impossible with their phone lines always busy. If you really need to talk to someone there, I discovered this service called Claimyr (claimyr.com) that helps you actually get through to Washington ESD agents. They have a video demo at https://youtu.be/7DieNd3C7zQ showing how it works.

Thanks for the tip! I might need that if I have to deal with Washington ESD for any reason.

Never heard of Claimyr but anything that helps with those impossible phone lines sounds useful.

The key requirement for unemployment is that you have to be actively seeking work and available to accept a job immediately. Being on maternity leave means you're not available for work, so you wouldn't qualify for UI benefits. PFML is definitely the right program for your situation.

0 coins

That makes sense. I guess I was confusing the two programs.

0 coins

Just to clarify - Washington's PFML covers up to 12 weeks for bonding with a new child and you can take it intermittently if needed. You have to have worked at least 820 hours in the qualifying period to be eligible though.

I've been working full time for over 2 years so I should qualify. Going to apply today!

0 coins

Make sure you apply as soon as possible. There might be waiting periods or processing delays.

0 coins

I made the same mistake when I had my baby 3 years ago. Tried to file for unemployment and got rejected. Wish I had known about PFML back then!

0 coins

It's confusing how there are so many different programs. I'm glad I asked here before wasting time with the wrong application.

One thing to keep in mind - if your employment situation changes while you're on leave (like if you get laid off), then you might be able to file for unemployment once you're ready to return to work and actively job searching.

0 coins

Hopefully that won't happen, but good to know for the future.

0 coins

Yeah, the rules can change depending on your specific circumstances. Always worth checking with the actual agencies if you're unsure.

0 coins

PFML applications can take a few weeks to process, so don't expect immediate payment. But it's retroactive to when your leave started if you're approved.

0 coins

That's really helpful to know. I'll get my application in ASAP.

If you end up needing to contact Washington ESD about anything unemployment-related in the future (like if your job situation changes), I had success using Claimyr to get through their phone system. Saved me hours of calling and getting busy signals.

Several people have mentioned Claimyr now. Definitely bookmarking that for future reference.

0 coins

Is that service free or do they charge something?

0 coins

They have different options but honestly it was worth it to actually talk to a human at Washington ESD instead of calling for hours.

The Washington state PFML program is relatively new compared to unemployment insurance, so a lot of people don't know about it yet. It's a much better fit for family leave situations.

0 coins

I'm so glad I posted here instead of just assuming I couldn't get any help during my leave.

Also worth noting that you can sometimes combine PFML with accrued vacation time or sick leave if your employer allows it, which might help bridge any gaps in pay.

0 coins

I'll check with HR about that. Every little bit helps right now.

0 coins

Some employers also offer supplemental pay to make up the difference between PFML and your full wages. Worth asking about.

0 coins

Don't feel bad about the confusion - the difference between unemployment insurance and family leave benefits isn't always clear. They serve different purposes even though they're both state programs.

0 coins

Thanks everyone for all the helpful information. I feel much more informed now!

If anyone else is reading this and wondering about unemployment during medical leave (not just maternity), the rules are similar - you generally need to be able and available for work to collect UI benefits.

0 coins

Good point. Medical leave would also likely qualify for PFML depending on the situation.

Just wanted to add that Washington's PFML also covers care for family members with serious health conditions, not just bonding with new children. It's a pretty comprehensive program.

0 coins

That's really good to know for the future. Sounds like a much better system than I realized.

0 coins

Hope your PFML application goes smoothly! The forms can be a bit confusing but it's worth taking the time to fill them out completely and accurately.

0 coins

I'll be extra careful with the paperwork. Don't want any delays because of mistakes on my part.

0 coins

One last tip - keep all your documentation from your employer about your leave dates and the reason for leave. You'll need that for your PFML application.

0 coins

Already have all that saved. Thanks for thinking of that detail!

0 coins

Congratulations on your new baby by the way! Hope the PFML process goes quickly for you.

0 coins

Thank you! All this advice has been incredibly helpful. So grateful for this community.

0 coins

If you run into any issues with the PFML application or need to follow up on anything, the customer service for that program is generally much easier to reach than Washington ESD unemployment lines.

0 coins

That's a relief to hear. Hopefully I won't need to call at all but good to know if I do.

0 coins

Final update from me - seriously consider having Claimyr in your back pocket if you ever need to deal with Washington ESD in the future. Their unemployment phone system is notoriously difficult to navigate, but that service made it actually manageable when I needed to resolve an issue with my claim.

0 coins

Definitely keeping that option in mind. Thanks again for all the help everyone!
