Can you apply for unemployment while on maternity leave in Washington state?
I'm currently on unpaid maternity leave from my job at a retail store and wondering if I can file for Washington ESD unemployment benefits during this time? My leave started 6 weeks ago and I have another 6 weeks left before I'm supposed to return. My employer said the position will be held for me but I'm not getting any income right now and struggling with bills. I tried looking on the Washington ESD website but it's confusing about leave situations. Has anyone been in this situation before?

Unfortunately, you typically can't collect unemployment benefits while you're on approved leave because you're not considered 'available for work' which is a requirement for UI benefits. Since your job is being held for you, Washington ESD would likely deny the claim.

If you've been working and paying into the system, you might be eligible for partial wage replacement during your maternity leave. I was in almost the exact same situation last year! I couldn't get regular unemployment but I did qualify for the paid family leave benefits. The application process was pretty straightforward once I figured out it was a different program entirely. You get a percentage of your wages, not the full amount, but it's definitely better than nothing.

I work in HR and deal with this question a lot. The key thing to remember is that unemployment benefits require you to be 'able and available' for work. If you're on approved leave, especially medical leave, you're not considered available. But paid family leave is specifically for these situations.
