Can I file Washington ESD unemployment while on maternity leave?

I'm currently on unpaid maternity leave and wondering if I can file for unemployment benefits through Washington ESD. My employer doesn't offer paid leave and I've been off work for 2 weeks now with about 6 more weeks to go. I'm physically able to work but obviously can't leave my newborn right now. Does anyone know if Washington ESD considers this situation eligible for UI benefits? I'm really stressed about finances and need to know my options.

Unfortunately, to qualify for unemployment benefits in Washington, you have to be able and available for work. Being on maternity leave typically means you're not available for work, which would disqualify you from UI benefits. You might want to look into Paid Family and Medical Leave (PFML) through Washington state instead - that's specifically designed for situations like yours.

I didn't know about PFML! Is that through Washington ESD too or a different agency?

PFML is through the Employment Security Department but it's a separate program from regular unemployment. You apply through their website at paidleave.wa.gov

I tried this same thing last year and got denied. Washington ESD was pretty clear that you can't collect unemployment if you're not actively seeking work. The whole point of UI is to support people who are looking for jobs, not people who are temporarily unable to work.

That's what I was afraid of. Did you end up finding any other assistance programs?

Cass Green

•

Yeah, I applied for PFML retroactively and got approved. It doesn't pay as much as my regular salary but it helped cover some expenses.

Actually, if you're having trouble getting through to Washington ESD to get clear information about this, I'd recommend checking out Claimyr. It's a service that helps you get connected to ESD agents when the phone lines are jammed. I used it when I had questions about my claim status and it saved me hours of calling. There's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. The website is claimyr.com.

Thanks for the suggestion! I'll definitely check that out since I can never get through to them normally.

Is Claimyr legit? I'm always suspicious of third-party services for government stuff.

It's legitimate - they just help you get through to the actual ESD agents. You're still talking to real Washington ESD staff, not some middleman.

Wait, I'm confused about the difference between unemployment and PFML. Can someone explain this better? I thought maternity leave was covered under unemployment benefits.

Miranda Singer

•

No, they're completely different programs. Unemployment is for people who lost their jobs and are actively looking for work. PFML is for people who need time off for family or medical reasons but still have a job to return to.

•

Oh that makes sense! So PFML is more like temporary disability benefits?

Miranda Singer

•

Exactly! It's designed to replace some of your wages while you're bonding with a new baby or recovering from childbirth.

I hate how complicated Washington state makes this stuff. Why can't they just have one program that covers all these situations?

0 coins

Aliyah Debovski

•

Right? I'm already stressed about money and now I have to figure out which program applies to my situation.

Cass Green

At least PFML exists now. My older sister had her kids before that program started and got nothing.

Just to be clear about the eligibility requirements - for unemployment, you need to be physically able to work, available for work, and actively seeking work. Maternity leave fails the 'available for work' test because you can't accept a job offer while caring for a newborn. That's why PFML was created specifically for family leave situations.

This is really helpful. I was getting confused about the requirements.

What if someone on maternity leave says they're available for work though? Would Washington ESD know?

0 coins

That would be fraud and could get you in serious trouble. ESD does investigate claims and lying about your availability can result in overpayment penalties and even criminal charges.

How much does PFML pay compared to unemployment? I know UI is based on your wages but I don't know about PFML.

Miranda Singer

•

PFML pays up to $1,327 per week in 2025, but the exact amount depends on your wages. It's 90% of your average weekly wage up to that maximum.

That's actually not bad! Better than I expected.

Way better than zero which is what I'm getting right now!

OP, definitely apply for PFML ASAP. There might be a waiting period and you want to get the process started. I made the mistake of waiting too long and lost out on some benefits.

Good point! I'll start the application today. Do you remember how long the approval process took?

It took about 3-4 weeks for me, but that was during a busy period. Could be faster now.

If you need to talk to someone at ESD about your specific situation, I really recommend using Claimyr to get through. I spent literally hours trying to call them directly before I found that service. Much less frustrating than dealing with busy signals all day.

I'm definitely going to try that. The few times I've called ESD I just got hung up on.

0 coins

Same here! It's like they don't want people to actually reach them.

Just wanted to add that you should also check if your employer offers any short-term disability benefits. Some companies have that in addition to or instead of participating in PFML.

Aliyah Debovski

•

I don't think my company offers that but I'll double-check my benefits package.

It's worth checking! Sometimes it's buried in the fine print of your employee handbook.

This thread is really helpful! I'm not pregnant yet but my husband and I are planning to start trying soon and I had no idea about PFML. Good to know for future reference.

0 coins

Right? I wish I had known about this earlier in my pregnancy!

0 coins

PFML also covers paternal leave, so your husband could potentially take time off too when you have a baby.

Olivia Kay

Oh wow, that's even better! We'll definitely look into that when the time comes.

I'm a single mom and went through this exact situation. PFML was a lifesaver. Don't feel bad about needing financial help - that's literally what these programs are for!

0 coins

Thank you for saying that. I do feel guilty about needing help but you're right, that's what these programs exist for.

0 coins

Joshua Hellan

•

Exactly! You've been paying into these systems through your paychecks. Now it's time to use them when you need them.

Does anyone know if you can collect PFML and unemployment at the same time? Like if you're on maternity leave but then your employer lays you off?

0 coins

That's a really specific situation. I don't think you can collect both simultaneously, but the timing would matter. You'd probably need to talk to ESD directly about that scenario.

0 coins

That's exactly the kind of complex question where Claimyr would be helpful. Getting a real person on the phone from ESD is the only way to get a definitive answer.

0 coins

OP, make sure you save all your medical documentation from your pregnancy and delivery. PFML requires proof of the medical need for leave.

0 coins

Good tip! I have all my doctor's notes and hospital records from the birth.

0 coins

Perfect! That should be exactly what you need for the application.

0 coins

The Washington ESD website has a really good comparison chart that explains the differences between unemployment, PFML, and disability benefits. Might be worth checking out if you're still confused about which program applies to your situation.

0 coins

I'll look for that! I learn better from visual comparisons anyway.

0 coins

That sounds helpful for me too since I was confused earlier.

One thing to keep in mind is that PFML benefits are taxable income, just like unemployment would be. So don't forget to set aside money for taxes or adjust your withholding.

0 coins

Ugh, I didn't think about taxes. Thanks for the reminder though!

0 coins

James Johnson

•

Yeah, it's easy to forget about that when you're focused on just getting some income coming in.

This whole thread has been super educational. I had no idea Washington had such a comprehensive family leave program. Other states should take notes!

0 coins

I'm definitely grateful to live in a state that has these protections. Can't imagine going through this with no support at all.

Washington's PFML program is relatively new but it's been a game changer for families.

•

Quick question - does PFML cover adoption too or just biological children?

0 coins

Yes, PFML covers adoption! You can take family leave to bond with an adopted child just like with a biological child.

0 coins

Mia Green

•

That's awesome! Good to know for friends who might be considering adoption.

OP, I hope this thread helped answer your question! Sounds like PFML is definitely the way to go for your situation. Congratulations on your new baby by the way!

0 coins

Thank you so much! This thread has been incredibly helpful. I'm going to start my PFML application right now.

0 coins

Good luck with the application! Feel free to come back and update us on how it goes.

I definitely will! Thanks everyone for all the advice and support.
