Can I file Washington ESD unemployment while on maternity leave?
I'm currently on unpaid maternity leave and wondering if I can file for unemployment benefits through Washington ESD. My employer doesn't offer paid leave and I've been off work for 2 weeks now with about 6 more weeks to go. I'm physically able to work but obviously can't leave my newborn right now. Does anyone know if Washington ESD considers this situation eligible for UI benefits? I'm really stressed about finances and need to know my options.

Unfortunately, to qualify for unemployment benefits in Washington, you have to be able and available for work. Being on maternity leave typically means you're not available for work, which would disqualify you from UI benefits. You might want to look into Paid Family and Medical Leave (PFML) through Washington state instead - that's specifically designed for situations like yours.

I tried this same thing last year and got denied. Washington ESD was pretty clear that you can't collect unemployment if you're not actively seeking work. The whole point of UI is to support people who are looking for jobs, not people who are temporarily unable to work.

Maternity leave fails the 'available for work' test because you can't accept a job offer while caring for a newborn. That's why PFML was created specifically for family leave situations.
