Can temps get unemployment benefits through Washington ESD?
I've been working temp assignments through a staffing agency for the past 8 months but my current assignment just ended unexpectedly. The agency says they don't have anything else available right now. Am I eligible to file for unemployment benefits with Washington ESD? I'm confused because technically I'm still employed by the temp agency even though I don't have any work assignments. Has anyone been in this situation before?

Yes, temp workers can absolutely qualify for unemployment benefits in Washington! The key is whether you're available for work and your assignment ended through no fault of your own. Since your assignment ended and the agency doesn't have replacement work, you should be eligible to file a claim with Washington ESD.

•That's a relief to hear. Do I need to wait a certain amount of time before filing, or should I apply right away?

•File as soon as possible! There's a one-week waiting period, but the sooner you file, the sooner your claim can be processed. Don't wait for the agency to find you work.

I work at a temp agency and deal with this all the time. You're absolutely eligible as long as you meet the work history requirements. The temp agency is your employer for UI purposes, so they'll be the ones responding to Washington ESD about your claim. Make sure you report that you're available for work when you file your weekly claims.

•Should I tell the temp agency I'm filing for unemployment? I don't want to hurt my chances of getting future assignments.

•You don't need to tell them, but they'll find out when Washington ESD contacts them about your claim. Most legitimate agencies understand this is normal - it's not going to hurt your standing with them.

I've been trying to reach Washington ESD for weeks about my temp work situation and keep getting busy signals. Anyone else having trouble getting through to them? I need to verify some details about my claim but can't reach a human.

•Have you tried calling right when they open? I've had better luck calling at 8 AM sharp, but even then it's hit or miss.

•I've tried everything - different times, different numbers. It's so frustrating when you just need to ask one quick question.

I was in the exact same situation last year! Filed for unemployment when my temp assignment ended and had no issues. The process was pretty straightforward once I got my claim approved. Just make sure you keep track of any work you do for the agency while collecting benefits.

•How did you handle the job search requirements? Do I need to look for permanent work or can I just wait for the agency to call me back?

•You still need to do the job search activities required by Washington ESD. Waiting for the agency to call isn't enough - you need to actively look for work and document it.

For anyone struggling to get through to Washington ESD by phone, I recently discovered this service called Claimyr that helps you actually reach an agent. They basically navigate the phone system for you and call you back when they get an agent on the line. Found it at claimyr.com and there's a demo video at https://youtu.be/7DieNd3C7zQ that shows how it works. Saved me hours of frustration!

•That sounds too good to be true. How much does it cost?

•It's worth checking out their site for details. For me, the time savings alone made it worthwhile since I was spending hours trying to get through.

temp work is the worst for this stuff... you never know when your assignment will end and then you have to deal with all the unemployment paperwork. at least washington esd usually approves temp claims pretty easily compared to other types of job endings

•That's good to know. I was worried they might deny it since I technically still have an employer.

•nah you should be fine as long as you worked enough hours. they understand how temp work works

One important thing to remember - when you file your weekly claims, you need to report any work you do, even if it's just a one-day assignment from the temp agency. Washington ESD will reduce your benefits for that week, but you won't lose your claim entirely. It's better to report everything than to get caught not reporting work.

•What if I get a short assignment that pays less than my weekly benefit amount? Do I still need to report it?

LilMama23
•Yes, you must report ALL work and earnings, no matter how small. Washington ESD has a formula for calculating partial benefits, so you might still receive some unemployment that week.

Been working temp for 3 years and this comes up constantly. The main thing is that temp agencies are required to pay into the unemployment insurance system just like any other employer. So you've been paying into it with every paycheck and you're entitled to benefits when you're out of work.

Aisha Patel
•That makes sense. I always wondered what that UI deduction was for on my paystubs.

Ava Williams
•Exactly! That's your unemployment insurance premium. You've been paying into the system, so don't feel bad about using it when you need it.

I remember when I first started doing temp work, I was so confused about the unemployment stuff. But honestly, it's one of the few benefits of temp work - you can usually get unemployment pretty easily between assignments. Just be honest about your situation when you file.

•Did you ever have any issues with the temp agency when you filed for unemployment?

•Never had any problems. Good agencies understand that unemployment is part of the temp work cycle. If an agency gives you grief about it, that's a red flag.

Make sure you understand the difference between being 'laid off' and 'fired' when you file your claim. If your temp assignment just ended because the client didn't need you anymore, that's essentially a layoff and you should qualify. If you were terminated for cause, that's different.

•My assignment ended because the project was completed. I assume that counts as a layoff?

Lena Müller
•Yes, that's definitely a layoff situation. You weren't fired for performance issues - the work simply ended. You should have no problem qualifying.

The Washington ESD website has a whole section about temp workers and unemployment benefits. It's actually pretty clear once you read through it. The main requirement is that you have to be available for work and actively seeking employment.

•I'll check that out. Is there a specific page about temp workers?

•It's in their eligibility section. They explain how temp work affects your claim and what you need to do to maintain benefits.

WASHINGTON ESD IS SO SLOW WITH EVERYTHING! I filed 3 weeks ago and my claim is still pending. Called so many times but cant get through. This is ridiculous when people need money to live!

•Have you tried using that Claimyr service someone mentioned earlier? I used it last week and actually got through to talk to someone about my pending claim.

For what it's worth, I've been temp for 5 years and filed for unemployment probably 6 times. Never been denied. The process is usually pretty smooth once you get past the initial application. Just keep filing your weekly claims and be patient.

Aisha Patel
•That's reassuring. How long did it usually take to get your first payment?

Yara Assad
•Usually 2-3 weeks after filing, including the waiting week. Sometimes faster if there are no issues with your claim.

Don't forget about WorkSourceWA registration! You need to register there and do job search activities. It's a pain but it's required to keep your benefits. They have workshops and stuff that count toward your job search requirements.

•Is that something I need to do right away or can I wait until my claim is approved?

•You should register as soon as you file for unemployment. They'll ask about it when you do your weekly claims.

I had an issue where the temp agency reported that I quit instead of being laid off. Had to appeal the decision but eventually got it sorted out. Make sure the agency reports the separation correctly to Washington ESD.

•How did you know they reported it wrong? Did Washington ESD tell you?

•Yeah, I got a letter saying I was disqualified for voluntary quit. Had to provide documentation that my assignment ended involuntarily.

temp agencies usually don't fight unemployment claims because they know the assignments are temporary by nature. it's built into their business model. just be honest about your situation and you should be fine

•Good to know. I was worried they might contest it to avoid higher unemployment taxes.

I used Claimyr too when I couldn't get through to Washington ESD. Took about 20 minutes and they called me back when they had an agent on the line. Definitely worth it when you're stuck in the phone system loop.

The bottom line is that temp workers pay into unemployment insurance just like everyone else, so you're entitled to benefits when you're out of work. Don't let anyone tell you otherwise. File your claim, be honest about your situation, and follow the rules for maintaining benefits.

•Good luck! The temp work cycle can be stressful, but unemployment benefits help bridge the gaps between assignments.

I went through this exact situation about 6 months ago when my temp assignment at a warehouse ended suddenly. Filed with Washington ESD and got approved within 2 weeks. The key thing I learned is to make sure you're actively looking for work - not just waiting for the temp agency to call. I registered with multiple agencies and applied to permanent jobs too, which helped me meet the job search requirements. Also keep all your paystubs from the temp work as proof of employment history. The whole process was actually pretty straightforward once I understood that temp workers have the same rights to unemployment benefits as regular employees.
