Can I bring a lawyer to my ESD unemployment appeal hearing without prior notice?

Just got my appeal hearing scheduled with ESD after being disqualified for supposedly not searching for work properly (even though I absolutely did!). Quick question - does anyone know if I can bring a lawyer who can speak on my behalf during the appeal? I didn't see anywhere in the hearing notice where I need to notify them about bringing legal representation. Do I need to let them know ahead of time, or can my lawyer just show up with me? This is my first time going through this process and I'm already stressed about the whole situation. Any advice is appreciated!

YES you can bring an attorney! I had a hearing last month for a similar issue (job search requirements). The hearing notice doesn't require you to notify them in advance about bringing representation. However, I would recommend calling the Office of Administrative Hearings (OAH) that's listed on your hearing notice and just let them know you'll have representation. It's not required, but it's courteous and helps them prepare for the hearing flow. Your attorney can definitely speak on your behalf - that's what mine did for most of the hearing.

Thank you so much! That makes me feel better. I'll call OAH tomorrow to give them a heads up.

i brought my cousin who's a lawyer to mine without telling them and it was fine lol. they just asked him to state his name and role for the record at the beginning. no big deal.

This is technically correct but not the best practice. While you CAN bring representation without prior notice, it's always better to inform OAH ahead of time. It helps with scheduling and ensures the Judge allocates enough time for the hearing.

Ugh I wish I knew this before MY hearing!! I went in alone thinking I couldn't bring anyone and got completely DESTROYED by the employer's HR person who brought all kinds of paperwork I wasn't prepared for. The judge kept asking me for evidence I didn't know I needed to bring!!! DEFINITELY bring a lawyer if you can afford one!!!!!

Oh no, I'm sorry that happened to you! That's exactly what I'm afraid of. Did you end up losing your appeal?

Yeah I lost and then had to pay back $5,700 in "overpayments" which completely ruined me financially for months. Don't be me - get representation!

Just to add some more details: Yes, you can bring legal representation to your unemployment insurance appeal hearing without prior notification. However, as a best practice, I recommend: 1. Call the OAH at least 2-3 days before your hearing to inform them 2. Have your attorney prepare any evidence exhibits you want to present 3. Review the hearing notice carefully for deadlines about submitting evidence If this is a telephone hearing rather than in-person, there are additional considerations for having your attorney participate. Make sure you understand whether it's phone or in-person!

Thank you for this detailed info! It's a video hearing through Microsoft Teams. Does that change anything about bringing representation?

For a Teams hearing, you should definitely notify OAH in advance so they can send the meeting link to your attorney as well. Otherwise, your attorney would need to be physically with you during the hearing, using the same device. Call the number on your hearing notice ASAP to have them add your attorney to the participant list.

my sister had her hearing last week and the judge was actually really nice!! she didnt have a lawyer and still won her case so dont stress too much about it, just bring all your job search logs and any emails confirming applications you sent

This varies DRAMATICALLY depending on which judge you get and what your specific issue is. Some are reasonable, others are looking for any excuse to deny you. For job search requirement cases specifically, they're often looking at whether you met the exact technical requirements. I wouldn't risk going without representation if the amount at stake is significant.

To directly answer your question: Yes, you can bring an attorney to your unemployment appeal hearing without prior notice. However, it's STRONGLY recommended that you inform the Office of Administrative Hearings in advance. Here's why notifying them is beneficial: 1. They can send hearing materials directly to your attorney 2. For virtual hearings, they'll provide separate access for your attorney 3. It allows the judge to plan for a potentially longer hearing 4. It looks more professional and shows you're taking the process seriously Make sure your attorney has copies of ALL correspondence between you and ESD, your detailed job search logs, and any evidence supporting your case. The burden is on you to prove you met the job search requirements. Good luck with your hearing!

Thank you for such a detailed response! This is extremely helpful. I've collected all my job search logs with screenshots of confirmation emails and application receipts. Hopefully that will be enough.

Have you tried just getting through to ESD directly to discuss this? Maybe there's a way to resolve it before the hearing? I had an issue with job search requirements last year and was able to clear it up by talking to an agent.

I've been trying for weeks but keep getting disconnected or waiting for hours. It's incredibly frustrating!

Try Claimyr - it's a service that helps you get through to ESD without waiting forever. I used it when I had issues with my claim and got connected in about 20 minutes instead of hours. They have a video showing how it works at https://youtu.be/7DieNd3C7zQ?si=26TzE_zGms-DODN3 and their website is claimyr.com. Saved me so much frustration when I was dealing with adjudication issues.

I've never heard of this before. Has anyone else used this service successfully? Might be worth trying before my hearing date.

I've recommended it to several clients who had good experiences. It doesn't guarantee ESD will resolve your issue, but it does get you through to an actual person much faster than calling directly.

I think everyone here is missing an important point - you need to bring evidence that you actually did your job searches properly! What documentation do you have? The judge will want to see SPECIFIC evidence like: names of companies, dates of applications, contact information, method of application, etc. THAT is what will win your case, not just having a lawyer there.

I've kept detailed records of everything - company names, position titles, application dates, confirmation emails, even follow-up communications. I have a spreadsheet plus screenshots. I'm hoping this will be enough to prove I met the requirements.

That's perfect! Make sure all of that is organized chronologically and bring at least 3 copies of everything (one for you, one for the judge, one for ESD's representative). With good documentation like that and a lawyer to help present it effectively, you have a strong case.
