Will my Social Security payment increase after WEP repeal for past COLAs since FRA?

Just heard the big news about WEP repeal! I've been getting reduced SS benefits since 2020 when I started collecting at my Full Retirement Age because of my pension from teaching (30 years in public schools in Texas). The Windfall Elimination Provision has been taking about $490 from my monthly check all this time. Now that Congress finally repealed WEP, I'm trying to figure out what my new benefit will be. Will they just add back the amount WEP was reducing me by, or will they also include all the COLAs that would have applied to that missing amount since 2020? In other words, will I get the original non-WEP amount PLUS all the cost-of-living adjustments I would have received on the full amount? Anyone know how SSA is handling this for people already receiving benefits? This could make a significant difference in my monthly income going forward!

I'm in a similar boat (retired firefighter with Illinois pension) and have been calling SSA daily to get clarification on this exact question. Can't get through to anyone! From what I've read in the legislation, they should be restoring your full benefit PLUS all the COLA increases you would have received if WEP hadn't been applied. I estimate I'm owed about $23,000 in back payments plus a $570 monthly increase going forward. Have you been able to speak with anyone at SSA about how they're implementing this?

Not yet! I've tried calling the 800 number three times this week but kept getting the "we're experiencing higher than normal call volume" message. I'm hoping they'll send out letters explaining the process, but knowing SSA, that might take months. Your estimate of back payments sounds substantial! I hadn't even thought about whether they'd give us retroactive payments for all those reduced months.

As someone who helps clients navigate SSA benefits, here's what I can tell you about the WEP repeal implementation: Yes, your new monthly benefit will include both the original non-WEP amount AND all the COLAs that would have applied to that full amount since you began collecting. The adjustment will be made automatically by SSA - you don't need to file any special request. However, they haven't announced the exact timeline for processing these adjustments. They're likely working from oldest claims forward or possibly by birth date. As for retroactive payments, the legislation includes provisions for those as well, though they may be issued separately from your ongoing benefit adjustment. Keep checking your my Social Security account online for updates specific to your situation.

what about ppl who get GPO reduction? is that also being eliminated or just the WEP??? my wife gets her teacher pension and only $247 from my SS record because of GPO. this whole system is RIGGED against public servants!!!

So glad to see this post! My dad is in the same situation with his California school pension and SS benefits. The WEP reduction has been about $425 per month since 2018. Really hope they process these changes quickly!

My neighbor who worked for the post office for 22 years got her adjustment already! She said it showed up without warning - just a larger deposit and then a letter came 3 days later explaining it. So they're definitely processing them, but seems random how they're doing it.

I've been following the WEP/GPO repeal legislation closely, and there's some misinformation floating around. To clarify: 1) Yes, your new benefit will include the non-WEP amount plus all accumulated COLAs 2) They are processing adjustments in batches based on your Social Security number's last two digits 3) Retroactive payments are included but will be issued separately as a lump sum 4) The GPO (Government Pension Offset) repeal is being phased in over 5 years, unlike the WEP which is immediate If you're struggling to get through to SSA about your specific situation, I'd recommend trying Claimyr (claimyr.com). I was getting nowhere with the 800 number for weeks, but their service got me connected to a real agent in under 10 minutes. They have a video showing how it works: https://youtu.be/Z-BRbJw3puU. The agent I spoke with confirmed my WEP adjustment is scheduled for processing next month.

This is incredibly helpful information, especially about processing by the last two digits of SSN. Mine ends in 78, so I wonder where that puts me in the queue. I'm definitely going to check out that Claimyr service - at this point I'd try anything to get actual information from a real person at SSA. Did they tell you how long the retroactive payment might take after they process the monthly benefit adjustment?

The SSA is COMPLETELY OVERWHELMED by this change!!! My sister-in-law works at our local office and says they've been given ZERO training on how to implement these changes. The computer systems aren't even updated yet to handle the adjustments!!! She said most offices are telling people to WAIT until they receive an official notice and NOT to call or visit offices about WEP/GPO changes because they literally cannot do anything yet. This is typical government incompetence - pass a law with no plan to implement it properly. Don't hold your breath for seeing that money anytime soon!!!

That's incredibly frustrating but not surprising. Did your sister-in-law mention any timeline for when their systems might be updated? I'm wondering if we should still file appeals to create a paper trail even if they can't process them yet.

my brother retired from arizona highway patrol got his adjustment already! went up $437 a month and got $17k backpay last week! but he had to go in person to ssa office three times and bring all his pension statements with him. nobody gets anywhere just calling. you have to go in person and DEMAND your correct payment!!

While I understand the frustration, I want to clarify that in-person visits aren't necessary or even advised right now for WEP adjustments. SSA has been clear that these will be processed automatically. Your brother's experience was likely coincidental timing - the adjustment was probably already in process. Demanding payments in person won't speed up the systematic review process and may actually divert resources from processing the adjustments. The most efficient approach is to monitor your my Social Security account and wait for notification.

wait im confused...is this only for government workers? i worked at walmart for 30 years and also get social security. does this affect me at all?

0 coins

No, this only affects people who worked in jobs where they didn't pay into Social Security (typically certain government positions like teachers, police, firefighters in some states) AND also worked enough in Social Security-covered jobs to qualify for benefits. If you worked at Walmart and paid Social Security taxes on those earnings, you weren't subject to WEP, so this repeal doesn't change your benefits.

Has anyone actually received their adjusted payment yet? I'm seeing a lot of rumors but few confirmed cases. Also, does anyone know if we need to file anything or provide documentation, or is SSA handling this entirely on their end?

My dad called yesterday (finally got through after trying for a week) and the agent told him they're not accepting any documentation or applications for the WEP adjustment. She said everyone affected will get a letter with their specific timeline and all changes will be automatic. But she couldn't give any dates.

UPDATE: I just checked my my Social Security account online and there's a new notice posted! It says my benefit recalculation is scheduled for next month and explains that I'll receive two separate deposits: one for the ongoing adjusted amount and another for retroactive payments going back to my original application date. They're calculating everything with all applicable COLAs! So excited to finally get the full amount I earned after paying into the system for 22 years alongside my teaching career. For those still waiting, keep checking your online account - seems they're updating information there before sending physical notices.

That's fantastic news! I just checked mine and don't see anything yet, but this gives me hope. What day did the notice appear? I wonder if they're rolling them out gradually throughout the month.
