What SS form replaces Power of Attorney when someone becomes incapacitated?

My father had a stroke last month and I'm trying to help manage his affairs. We have a general Power of Attorney document but when I called Social Security, they told me SSA doesn't recognize POAs and I need to fill out some specific form instead. The rep didn't tell me which form and I couldn't stay on hold any longer (was already waiting 2+ hours). Does anyone know which form I need to become his representative for Social Security matters? He's receiving retirement benefits and I just need to be able to handle things while he recovers. Thanks for any help!

You need to apply to be a Representative Payee. The form is SSA-11 (Request to Be Selected as Payee). Social Security requires this instead of a POA because they have specific obligations for people handling someone else's benefits. You'll need to visit your local office or call to start this process - they'll interview you and may require medical documentation of your father's incapacity. Once approved, you'll be responsible for using his benefits for his needs and reporting how funds were spent annually.

Thank you! That's exactly what I needed to know. Do you know if there's a way to download the SSA-11 form and fill it out beforehand, or do I have to get it at the office?

Went thru this with my mom. its a NIGHTMARE getting thru to anyone!!! took me like 4 calls and i kept getting hung up on after waiting forever

I know! I tried calling three different times and kept getting disconnected after waiting on hold. It's so frustrating when you're trying to help a family member.

I became a representative payee for my aunt last year. You need form SSA-11 but they won't just let you mail it in - you need an interview too. They'll want to see your ID, your father's SS card, and medical documentation about his condition. They're really strict about this process since they've had problems with rep payees misusing funds in the past. It's not just a simple form submission.

Thanks for explaining. That makes sense but sounds complicated. Did you have to wait long for the interview appointment?

It took about 3 weeks to get the appointment, but that was during COVID. Might be faster now. The interview itself was only about 20 minutes. Just be prepared to explain exactly how you'll manage his money and keep records.

This is called Representative Payee. My brother is on SSDI and I'm his payee. It's different than POA because you're specifically managing their SS benefits. You have to report how you spend the money every year and they can audit you.

Thanks! Do they deposit the money into my account or does it still go to his account?

They'll deposit it to a special account that has to be set up in his name with you as the representative payee. It can't go to your personal account - that's against their rules.

UGHHH dealing with SS when a family member is incapacitated is SO HARD!! I've been trying to help my grandmother for THREE MONTHS and still can't get anywhere. Their phone system is useless - you wait for 2 hours then get disconnected. The offices are backed up for months. I feel your pain!!!!

That sounds awful! Three months is ridiculous. I hope your situation gets resolved soon.

If you're struggling to get through to the SSA by phone (which is very common right now), you might want to try using Claimyr. I found it at claimyr.com after weeks of trying to reach someone about my wife's benefits. It basically calls SSA for you and then calls you when an agent is on the line. Saved me hours of hold time. They have a video showing how it works here: https://youtu.be/Z-BRbJw3puU For the Representative Payee application, you'll still need to complete the process in person eventually, but at least you can get your questions answered and potentially schedule an appointment without the endless hold times.

This sounds really helpful, I'll check it out. At this point I'm willing to try anything to avoid those ridiculous hold times. Thanks for the recommendation!

Yes, it worked for me. I was skeptical too but after getting disconnected three times while on hold for over an hour each time, I was desperate. Got through to an agent in about 20 minutes after using their service.

My neighbor said she had to visit the office in person to sort this out. Apparently SS is really strict about who can access someone else's benefits and they want to see you face to face.

This is correct. They won't just let you submit paperwork by mail for Representative Payee status. They require an in-person interview to verify your identity and relationship to the beneficiary. It's part of their fraud prevention measures.

One important thing to know: Representative Payee status is different from having authority to handle other Social Security matters like appeals or reporting changes. If you need broader authority, there's another option called "Appointed Representative" (Form SSA-1696) that allows you to represent someone for claims and appeals. But for managing the actual benefit payments, Representative Payee (SSA-11) is what you need.

That's good to know! I might need both since I'll probably need to report his address change soon too. Do you know if I can apply for both at the same time?

Yes, you can apply for both simultaneously. Just be clear with the SSA representative about what you're trying to accomplish. Bring all documentation about your father's condition and your relationship to him. Medical records establishing his incapacity will be particularly important.
