TWC flagged 'suspected fraud' on out-of-state worker claim - can't reach 512 fraud unit!
Hey everyone, I'm at my wit's end trying to navigate this interstate claim mess. My husband worked for a Texas company for over 4 years but we've always lived in Tennessee. He got laid off on May 3rd and applied for Texas unemployment about a month ago since that's where his employer is based. Initially, things seemed OK - a TWC rep even called to update his info since he has a Tennessee driver's license. But now when we log in, there's a message saying "suspected fraud" and telling us to call the 512 fraud unit. We've left SEVERAL messages over the past week with zero response. His claim is just sitting there with no payments, and we're starting to worry about bills. Has anyone dealt with the interstate claim process or this fraud unit? Any suggestions on how to actually get a human on the line? I'm starting to think we should have filed in Tennessee instead, but the TWC rep specifically told us Texas was correct since that's where the company is based.

Interstate claims are always tricky. The "suspected fraud" flag is often automatically triggered with out-of-state addresses/IDs. Your husband did the right thing filing in Texas since unemployment should be filed where the work was performed, not where you live. For the fraud unit, you need to be persistent. Try calling right when they open at 8:00 AM CT. Also, have all his employment documentation ready - paystubs showing Texas withholding, employment contract mentioning Texas work location, any travel records/receipts, and his Tennessee ID. One other thing - make sure he's still doing his 3 required work search activities each week and requesting payment on his assigned day, even while this is being resolved. They can backdate payments once the fraud flag is removed, but only if he's been completing all requirements.

I had this EXACT problem last year!!! It was a NIGHTMARE getting through to anyone at TWC. I spent WEEKS calling and getting busy signals or disconnected after waiting on hold for hours. I almost gave up completely but eventually the fraud flag got removed. You need to send in additional documentation - they need proof that he actually worked in Texas. Does he have any tax forms with his employer's Texas address? Hotel receipts? Anything that proves he was legitimately working there? Also, try emailing the ombudsman office - sometimes they can help when regular channels fail. Just google "TWC ombudsman" and you'll find the contact info.

This fraud flag happens ALL THE TIME with out-of-state workers. The system is designed for standard in-state employment and automatically flags anything unusual. A regular agent was able to transfer me directly to the fraud department. That's a huge advantage because the regular line has shorter wait times. Once I explained my situation to the first agent, they put me in touch with someone who could actually fix the problem.

My husband had a similar situation (worked in Texas but we lived in Louisiana) and his employer had to provide verification that he actually worked in Texas despite having an out-of-state license.

We've gathered all his employment documentation, travel receipts, and everything else suggested. It's so frustrating that the system automatically flags these interstate claims without providing clear instructions on how to resolve it. I'll update this thread once we get through to someone!

tWC is SO BROKEN!!!! i filed 5 months ago and STILL haven't gotten anything!!! their whole system is designed to deny benefits and make everything impossible. they probably flagged you on purpose just to delay paying!!! i've left 27 MESSAGES with different departments and no one EVER calls back. the whole interstate thing is just an excuse. they do this to EVERYONE!!!

The TWC has to confirm which state's unemployment insurance fund should be paying the benefits. Quick update: We finally got through! Used Claimyr this morning and got connected to a TWC agent in about 30 minutes. They transferred us to the fraud department, and it turns out the flag was automatically triggered because of the Tennessee address + Texas employer combination. The agent said they need copies of his travel receipts, W-2 forms, and a letter from his employer confirming the travel arrangement. We're gathering everything now and will fax it over today. They said once they receive and verify the documents, the hold should be removed within 3-5 business days. Thank you all for your help and suggestions!

Keep the fax confirmation receipt 4. Call back in exactly 5 business days if you don't see the hold removed Once the fraud hold is removed, any payments owed should be released relatively quickly. Just make sure he continues requesting payments on his assigned day, even while waiting for the hold to be removed.
