TWC denied my claim after medical retirement from Air Force - can't work due to back surgeries
I was medically retired from the Air Force on September 5th and have had two back surgeries in the last three months (most recent on Sept 14th). My doctor says I can't work for at least another 3 months while recovering. Since I'm no longer military but can't work yet, someone suggested filing for unemployment. I applied to TWC and was initially approved, but then got a determination letter saying I'm denied because I'm 'under doctor's care' and not able to work. I'm completely confused - isn't unemployment supposed to help in situations like this? This is my first time applying, and I'm getting desperate as my savings are running out fast. I might have to start looking for work against my doctor's orders if I can't get some income soon. Does anyone know if I can appeal this or if there's another benefit I should be applying for instead? My determination letter doesn't really explain my options.

sorry bout ur situation man but unemployment is for people who CAN work but DON'T have a job. if ur doctor says you cant work then you dont qualify for regular unemployment benefits. have u looked into disability?

Unfortunately, regular TWC unemployment benefits require that you're able and available to work full-time. Since your doctor has restricted you from working, you don't meet the basic eligibility requirements. That's why you were denied. What you should look into instead: 1. VA disability benefits if you haven't already applied 2. Social Security Disability Insurance (SSDI) for temporary disability 3. Check if you qualify for any temporary financial assistance programs through the VA Don't risk your health by working against medical advice. The appeal for your TWC denial likely won't be successful since you genuinely can't work right now, which is a core requirement.

I WENT THROUGH SOMETHING SIMILAR LAST YEAR!!! The system is SO FRUSTRATING. You can't get unemployment if you can't work, but disability takes FOREVER to kick in. It's like they WANT people to be homeless in between!!! Have you tried calling TWC to see if there are ANY exceptions for your situation? I spent WEEKS trying to get through to someone who could actually help.

I work with veterans transitioning to civilian life, and this is a common misunderstanding. For your immediate situation: 1. Contact your local VA office about their emergency financial assistance program - many vets don't know this exists but it can provide short-term help 2. Look into the Wounded Warrior Project financial assistance if your injuries were service-related 3. File for SSDI right away, and make sure to indicate you're a veteran as this can sometimes expedite your claim 4. Some states have temporary disability programs separate from unemployment, though Texas unfortunately doesn't If you're having trouble reaching someone at the VA about urgent financial assistance, I'd recommend Claimyr (claimyr.com) - they help people get through to government agencies without waiting on hold for hours. I'm so sorry about your situation! I'm wondering if you might qualify for pandemic unemployment assistance instead of regular unemployment? That covered people who couldn't work for medical reasons related to COVID. Is your medical condition at all COVID related?

•The Pandemic Unemployment Assistance (PUA) program ended in September 2021. It's no longer available, unfortunately. That program was specifically for COVID-related unemployment during the height of the pandemic.

my brothr got medicaly retired too and he got some kind of seperaton pay plus his VA disability, did you get a lump sum payment when you retired? that should help while waiting for the va disability to start

•I did get some separation pay but most of it went to paying off debts and getting moved back home. Was trying to make it stretch but medical bills keep adding up unfortunately.

Just to clarify something important - if you appeal the TWC denial, you'll need to certify you're able and available for full-time work, which contradicts your doctor's orders. Making false statements on unemployment claims can lead to penalties and having to repay benefits plus interest if they discover the discrepancy later. Instead, focus on expediting your VA claim. You can request a hardship acceleration by submitting VA Form 20-10207 (Request for Expedited Processing). Include documentation of your financial hardship (past due bills, eviction notices, etc) to strengthen your case.

one more thing - check with ur county veterans service office. they sometimes have emergency funds 4 vets in ur exact situation. helped my buddy last year when he was in between benefits
