Can I get NY unemployment after quitting job due to injury? Doctor ordered 6 weeks recovery
I was on unemployment, then got a job for only ONE WEEK before I got injured. My doctor has ordered me to stay off work for 4-6 weeks while I recover from surgery. When I tried to go back to my employer, they said there's no work available right now. I'm not sure what to do - can I reapply for NY unemployment since the job fell through? Or should I be applying for disability instead? Has anyone dealt with this situation before? I need some sort of income while I'm recovering and really don't know what my options are right now. Any advice would be appreciated!

You might qualify for both, but timing matters here. Since you worked for a week, then got injured, you should look into filing for NY short-term disability (DB) through the employer where you got hurt. Disability pays less than unemployment but doesn't require you to be able to work. Once your doctor clears you to work again, you could potentially reapply for unemployment if you're still jobless. The key for unemployment is being able and available to work - which you're not right now with doctor's orders.

when i broke my foot last yr they said i didnt qualify for disability cuz i hadnt worked long enough at my job... think its like 4 weeks minimum or something. unemployment wont approve u if ur not able to work either so ur kinda stuck in a bad spot

THE WHOLE SYSTEM IS DESIGNED TO MAKE PEOPLE FAIL!! I was in almost EXACTLY your situation in January 2025 and spent WEEKS getting bounced between unemployment and disability with NO INCOME. Both kept saying I should qualify for the OTHER program. It's a joke. Your best bet is to just keep calling until you get someone sympathetic who will actually help.
