TWC appeal for late paystub submission - what are my chances of winning?

Just got a determination letter saying my benefits were denied because I didn't submit my paystubs before the deadline. I've been working part-time at a restaurant and reporting my income, but apparently they needed actual documentation which I didn't realize until too late. I've already filed an appeal online and uploaded all my missing paystubs from the last 3 months. Has anyone gone through an appeal for this specific reason? What are my chances of winning? The determination letter mentions something about 'failure to provide requested information in a timely manner' but I honestly never saw the original request in my correspondence inbox. Getting really anxious about this since I'm counting on these benefits to pay rent next month.

Thanks for responding! Did you have to explain why you were late with the documents? I'm worried they won't believe that I never saw the original request.

Your chances are actually quite good in this specific situation. TWC generally grants appeals when the claimant provides the requested documentation, even if it was submitted late. The key factors that will help your case: 1. You've now submitted all the paystubs they requested 2. You can demonstrate you've been consistently reporting your income 3. You have a reasonable explanation for missing the deadline Make sure you attend the appeal hearing (usually by phone) and clearly explain that you never saw the original request in your correspondence inbox. Take screenshots of your correspondence section to show this if possible. Also, check your contact information is correct in the system so you don't miss future notices. The fact that you promptly filed the appeal and submitted the documents after receiving the determination letter works in your favor. TWC understands that these administrative issues happen.

This is so helpful, thank you! I'll definitely prepare those screenshots. Do you know roughly how long it takes for them to schedule the hearing after filing the appeal? It's been 3 days and I haven't heard anything yet.

I'M LITERALLY GOING THROUGH THE EXACT SAME THING RIGHT NOW!! They denied me for 'not responding' to a request I NEVER GOT! I submitted my appeal last week but haven't heard ANYTHING about a hearing date. This system is BROKEN!!! How are we supposed to respond to requests we never receive?? The worst part is that they STILL expect us to do our weekly payment requests even though they're not paying us. Makes no sense!

Keep doing those payment requests even during appeal. If you win they'll pay all back benefits but only for weeks you properly requested! Learned that hard way :

Just went through an appeal for almost the same reason in February. I think you'll win as long as you've got the paystubs now. For the hearing, make sure you're in a quiet place with good phone reception. My hearing took about 20 minutes, and the judge was actually pretty understanding. One thing that helped me was I had documentation showing I had tried to upload the paystubs through the portal but encountered a technical error. Do you have any kind of proof that you never received the original notice? Check your email settings to see if TWC notifications are going to spam maybe? Also, I was waiting almost 3 weeks for my hearing to be scheduled, so don't panic if it takes some time. They're really backed up right now from what I hear.

3 weeks?! That's so long to wait when bills are due. I don't have proof I never received it other than just showing my correspondence inbox. But I do have all my paystubs organized and ready to go, so hopefully that helps.

I had this same issue back in January and won my appeal. Here's what helped me win: 1. I prepared a clear timeline of all correspondence I'd received from TWC 2. I had screenshots showing I'd reported all my earnings accurately 3. I was honest about missing the deadline but emphasized I was providing all documentation now The hearing officer was reasonable and ruled in my favor since the purpose of the original request (verifying my income) was ultimately satisfied, just late. FYI - right now it's taking about 3-4 weeks for appeals to be scheduled. If you're in a financial emergency while waiting, make sure to call TWC directly for assistance options. If you're having trouble getting through to TWC, I used a service called Claimyr (claimyr.com) that got me connected to a representative in about 20 minutes instead of spending days trying to get through. They have a video showing how it works: https://youtu.be/V-IMvH88P1U?si=kNxmh025COIlIzKh. It helped me get some clarity on my appeal status when the online system wasn't updating.

Thank you for the detailed advice! I'll definitely prepare all those things for my hearing. And thanks for the Claimyr tip - I might try that because I've been calling and can't get anyone on the phone. 3-4 weeks is a long time to wait without benefits.

My neighbor had something similar happen and lost his appeal because he didn't have proof he never saw the original request. Not trying to scare you but you should be prepared for either outcome. He ended up having to repay benefits too. The whole system is designed to trip people up I swear.

This is what I'm worried about too! How can we PROVE we didn't receive something?? It's impossible! And then they punish US for THEIR system failures!

Just to follow up - one more crucial tip: During your appeal hearing, use these exact words: "I want to assert that I exercised due diligence in maintaining my claim and responded immediately upon receiving the determination." This specific language addresses the legal standard TWC uses in these cases. Also emphasize that providing the paystubs late doesn't change the fact that you accurately reported income all along. For reference, TWC's appeals process follows the "good cause" standard for late submissions. Hearing officers will often waive the timeliness requirement if you demonstrate a reasonable explanation for the delay, especially if the underlying issue (income verification) is now resolved with your submitted documents.

Thank you! I'll write down that exact phrase to use during the hearing. This makes me feel a bit more confident.

Heads up - those appeal hearings are super formal! Judge made me swear an oath and everything lol. But dont be nervous just tell truth. I would check mail settings too sometimes TWC emails go to spam

Good point about checking spam. I just looked and don't see anything from TWC there. Thanks for the heads up about the formal nature of the hearing!

Has anyone actually used that Claimyr service mentioned above? I've been trying to get someone at TWC on the phone for days and I'm desperate, but wondering if it's legit before I try it.

Yes, I've used it twice. It works exactly as advertised - connects you through to TWC without having to redial for hours. Saved me so much frustration. The video demo on their site shows exactly how it works.
