Reduced from 60 to 24 hours at CNA job - can I get partial TWC benefits?

I've been working as a contract CNA making around $2500 every 2 weeks (60 hours per week) at a small family-owned company. Without any warning, they just cut my hours down to 24 hours per week. I still have children to support and bills to pay, but they don't seem to care about my situation at all. Can I apply for partial unemployment while still working these reduced hours? Has anyone had experience with this type of situation? I've never applied for TWC benefits before and don't know if I qualify or how the process works when you're still employed but with drastically reduced hours. Any advice would be greatly appreciated!

Yes! You absolutely can apply for partial unemployment in Texas when your hours are cut that dramatically. This is called underemployment and TWC has specific provisions for it. Since your hours were reduced by more than 25% (you went from 60 to 24 hours which is a 60% reduction), you definitely meet that criteria. When you apply, TWC will contact your employer to verify your wages and the reduction in hours. It's totally legit - they just help you get through the phone system faster. You still talk directly to the TWC agents yourself, so you control what information you share. I was skeptical too but got desperate after a week of failed calls.

i got partial unemployment when my resturant cut my hours during remodeling. you definitely qualify! make sure you request payment every 2 weeks even while working or theyll close your claim. also they base your benefit amount on your highest earning quarter from the last year or something like that and then theres a formula they use to determine your weekly benefit amount. its confusing lol

Just wanted to add one more important thing - when you do your payment requests every two weeks, you MUST accurately report ALL hours worked and wages earned during that period. If you make a mistake or underreport, TWC might later determine you were overpaid and demand repayment plus penalties. Better to be 100% accurate from the start. And keep a log of all your work search activities with dates, company names, contact methods, etc.

Also be prepared for your employer to possibly fight your claim!!! These small family businesses are THE WORST about challenging unemployment even when it's legitimate. They might claim they offered you more hours (even if they didn't) or that you voluntarily reduced your schedule. DOCUMENT EVERYTHING!!!

This is a valid concern. If your employer does contest your claim, TWC will schedule a phone hearing. Make sure you have all documentation ready and be prepared to clearly explain how your hours were reduced through no fault of your own. Keep copies of schedules, text messages, emails - anything that shows the reduction was employer-initiated.

one more thing - when u first apply online the system is gonna ask if u were laid off or quit. this confused me cuz neither applied to me with reduced hours. u should select the option for 'still working reduced hours' or something similar (i cant remember exact wording). if u select wrong option it will mess up ur whole application!
