Can you still get ny unemployment if working part time hours?
I recently had my hours cut from 40 to just 15 hours per week at my retail job due to the store's financial issues. My manager says this might continue for several months and honestly I can't survive on 15 hours a week. My rent is $1,300 and I'm barely making $650 now with these reduced hours. Has anyone successfully claimed partial unemployment while still working some hours? I tried reading the NY unemployment website but got confused about the formula they use to calculate benefits when you're partially employed. Do I report my gross wages or take-home pay? Also wondering if I need to do anything special on the weekly certification to show I'm still employed but at reduced hours? Anyone gone through this process recently?

Yes, NY unemployment definitely still offers partial benefits. I had my hours cut from 38 to 12 back in November and qualified. The key is that you need to report your GROSS wages (before taxes) each week when you certify. They have a formula where if you work less than 4 days and earn less than $504, you can still get a percentage of your weekly benefit. The days matter too - even if you work just 1 hour on a day, that counts as a full day worked in their system.

My boss was actually the one who suggested I apply! They get notified when you file but it doesn't cost them anything extra if you're still employed with reduced hours. It's not like you're filing against them.

The partial unemployment formula is: if you work 1 day, you get 75% of your weekly benefit. 2 days = 50%, 3 days = 25%, 4+ days = 0%. BUT even if you work just 1 hour on a day, they count that as a full day worked. And if you make more than $504 in a week, you get zero benefits no matter how few days you work.

The important thing to understand about NY's partial unemployment is that it's based on DAYS worked, not just hours or income. This is different from many other states. So if you work 5 hours spread across 4 different days, you'd get $0 in benefits even though you barely worked any hours. But if you work 15 hours all on the same day, you'd get 75% of your benefit amount. It's weird but that's how it works.

My employer was totally fine with it - they actually expected it since they knew cutting hours would cause financial hardship. Your employer has already been paying into the unemployment insurance system, so it's not like it costs them extra when you claim benefits due to reduced hours.

Heads up that if your income varies week to week, you'll need to recertify EVERY week with your exact earnings for that period. I'm a server with different income each week and it's annoying but you get used to it.

My roomate just went thru this. Your weekly benefit = (Your normal benefit amount) - (75% of what you earned that week). So if your normal benefit would be $400, and you earned $200 in a week, you'd get $400 - $150 = $250 that week. Something like that anyway.
