Can you still get ny unemployment if working part time hours?

I recently had my hours cut from 40 to just 15 hours per week at my retail job due to the store's financial issues. My manager says this might continue for several months and honestly I can't survive on 15 hours a week. My rent is $1,300 and I'm barely making $650 now with these reduced hours. Has anyone successfully claimed partial unemployment while still working some hours? I tried reading the NY unemployment website but got confused about the formula they use to calculate benefits when you're partially employed. Do I report my gross wages or take-home pay? Also wondering if I need to do anything special on the weekly certification to show I'm still employed but at reduced hours? Anyone gone through this process recently?

Yes, NY unemployment definitely still offers partial benefits. I had my hours cut from 38 to 12 back in November and qualified. The key is that you need to report your GROSS wages (before taxes) each week when you certify. They have a formula where if you work less than 4 days and earn less than $504, you can still get a percentage of your weekly benefit. The days matter too - even if you work just 1 hour on a day, that counts as a full day worked in their system.

Thanks! Did you have any issues with your employer when you applied? I'm worried my boss might get upset if I file for partial benefits.

My boss was actually the one who suggested I apply! They get notified when you file but it doesn't cost them anything extra if you're still employed with reduced hours. It's not like you're filing against them.

Just make sure you're super accurate with reporting your hours and income each week. They will check with your employer and if the numbers don't match up, you could end up having to pay back benefits 👀

I was in the same boat last spring when my restaurant cut my hours way back. Got so frustrated trying to reach someone at ny unemployment to answer my questions. Finally found this service called Claimyr (claimyr.com) that got me a callback from an actual agent within like 2 hours. Talking to an agent got my benefits started so fast instead of waiting weeks. It was the only way I could get a real person on the phone! Check out this video too: https://youtu.be/Rdqa1gKtxuE

Does this claimyr thing actually work? Seems too good to be true with how impossible it is to reach unemployment these days.

100% worked for me! I was SHOCKED when my phone rang and it was actually a real agent from unemployment. They fixed my issue in one call that I'd been trying to resolve for weeks.

I get the skepticism, I was doubtful too. But as someone who spent literal DAYS trying to get through on my own, it saved my sanity. Talking to a real agent solved in 10 minutes what I couldn't fix for 3 weeks.

I dunno man, I tried everything to get through to someone at NYSDOL. This actually sounds worth checking out.

The partial unemployment formula is: if you work 1 day, you get 75% of your weekly benefit. 2 days = 50%, 3 days = 25%, 4+ days = 0%. BUT even if you work just 1 hour on a day, they count that as a full day worked. And if you make more than $504 in a week, you get zero benefits no matter how few days you work.

Just a heads up that their system is complete trash for part-time workers. I worked varying hours each week and sometimes the system would flag my claim for 'inconsistent reporting' even though I was being 100% honest. Took FOREVER to get it fixed. Document everything - hours, pay stubs, all of it.

Oh great 😫 That's exactly what I'm worried about since my hours vary week to week.

Yep its a nightmare. Take screenshots of your work schedule if possible and keep ALL paystubs. Trust me on this one.

The important thing to understand about NY's partial unemployment is that it's based on DAYS worked, not just hours or income. This is different from many other states. So if you work 5 hours spread across 4 different days, you'd get $0 in benefits even though you barely worked any hours. But if you work 15 hours all on the same day, you'd get 75% of your benefit amount. It's weird but that's how it works.

This is why NY's system is so broken! Makes no logical sense. Who designed this garbage?? 🤦‍♂️

For real. I had to rearrange my work schedule to consolidate hours into fewer days just to maximize benefits. Ridiculous system.

I've been on partial unemployment for about 3 months now. Here's what I've learned: - Report your gross wages (before taxes) each week you certify - Be super specific about which days you worked (the system counts days not hours) - Try to consolidate your hours into fewer days if possible - Keep detailed records of everything in case they audit you - The online system sometimes glitches, especially when reporting partial employment - Getting through on the phone is nearly impossible Honestly, the hardest part was getting my initial claim processed correctly. I was stuck in pending for weeks until I finally found claimyr.com which got me connected to a real agent who fixed everything in one call. Worth every penny because I was at my wits end trying to get through the regular phone lines. One more tip: if your hours fluctuate week to week, you can still claim each week - just accurately report the days/hours for that specific week. Hope this helps!

Thank you so much for this detailed response! This is exactly what I needed. Did you have any issues with your employer when they got notified about your claim?

My employer was totally fine with it - they actually expected it since they knew cutting hours would cause financial hardship. Your employer has already been paying into the unemployment insurance system, so it's not like it costs them extra when you claim benefits due to reduced hours.

Can confirm everything in this comment. The system isn't designed well for partial claims but once you get it going, it works. Just prepare for potential delays at the beginning.

Make sure u dont accidentally make more than your weekly benefit amount or theyll cut you off completely that week. Its a stupid system tbh

I applied for partial unemployment and got denied even though my hours were cut by more than half!!! Then I couldn't get anyone on the phone for WEEKS. The entire system is rigged against workers I swear. Still fighting with them 2 months later.

Did you appeal? You absolutely should qualify with hours cut in half. Sounds like someone misprocessed your claim.

Yeah I filed an appeal but haven't heard anything back yet. The whole system is a joke.

Heads up that if your income varies week to week, you'll need to recertify EVERY week with your exact earnings for that period. I'm a server with different income each week and it's annoying but you get used to it.

My roomate just went thru this. Your weekly benefit = (Your normal benefit amount) - (75% of what you earned that week). So if your normal benefit would be $400, and you earned $200 in a week, you'd get $400 - $150 = $250 that week. Something like that anyway.

That's not right for NY. New York uses days worked not just income. Look at the other comments explaining it.

The partial UI system in NY is based on days worked AND earnings. Here's the breakdown: • Work 0 days = 100% of benefit rate • Work 1 day = 75% of benefit rate • Work 2 days = 50% of benefit rate • Work 3 days = 25% of benefit rate • Work 4+ days = 0% of benefit rate BUT if you earn more than $504 in a week (doesn't matter how many days), you get zero benefits for that week. Also, any work on a day counts as a full day, even if it's just one hour. My advice: If possible, try to consolidate your hours into fewer days. 15 hours spread across 5 days gets you nothing, but 15 hours on 2 days gets you 50% of your benefit rate.

Thank you for breaking it down so clearly! This makes sense now. I'll see if I can get my manager to schedule my hours on fewer days.

Just be aware they are SUPER slow processing partial claims. Mine took almost 5 weeks to start getting payments. Keep certifying every week while you wait.

i applied for partial benefits in february and have been getting them without issue. they definitely still do it but the system is confusing af. i still dont understand why some weeks i get different amount than others even tho i worked the same hours 🤔

It might be because of the days you worked, not just the hours. Each day you work reduces your benefit by 25% regardless of how many hours you worked that day.

The problem with ny unemployment is getting through to ask these kinds of specific questions. I spent TWO WEEKS calling and couldn't get through. Finally broke down and used claimyr.com which got me a callback in 2 hours. Best money I ever spent because I was able to ask all my questions and get my claim fixed.

It basically calls for you and waits on hold, then calls your phone when it reaches a human. I was skeptical but it actually worked. claimyr.com
