Maternity leave ended + company sold + no contact from new owner = TWC claim?
I'm completely lost on what to do with TWC. I was on maternity leave until last week, but while I was out my company got bought by another business on February 28th. My old manager texted me that my position was terminated during the acquisition. I was supposed to return to work Monday, but nobody from the new company has contacted me at all! No termination letter, no COBRA info, literally nothing. I've tried calling HR three times but just get voicemail. Am I technically laid off? Can I file for unemployment since I was ready to return but have no job to go back to? Has anyone dealt with a similar situation where a company buyout happened during leave? I'm worried about how to explain this to TWC since it's so complicated.

You should definitely file for unemployment right away. This counts as a layoff due to company reorganization/acquisition, which is not your fault. When you file, just explain exactly what happened - that you were on approved maternity leave, the company was sold, and upon your return date, you discovered your position was eliminated. The NERVE of these companies!!! This is ILLEGAL treatment of a new mother returning from protected leave! The new company HAD AN OBLIGATION to honor your employment status during acquisition. Make sure you tell TWC EXACTLY what happened because this could potentially be a FMLA violation as well as wrongful termination. They can't just pretend you don't exist because you were on maternity leave when they bought the company! I went through a similar thing (not maternity but medical leave) and TWC found in my favor because the company couldn't prove they had legitimate business reasons to eliminate ONLY my position.

FMLA protects your job with the original employer, but a new owner isn't automatically bound to keep all employees. They must treat people on leave the same as other employees in similar positions, but if they eliminated an entire department or function, that's usually considered legitimate. Same thing just happened to my wife last month lol. She went on leave in December, company got bought in January, and nobody bothered to tell her until she showed up for work and couldn't get in the building! The new owners were like "who are you?"
