Will PA UC approve me if my employer gave termination letter with unemployment papers?
I just got fired from my job last week (not my fault, they were cutting staff). When HR handed me my termination letter, they also gave me some unemployment paperwork and said I should file right away. I've never been through this before - does getting unemployment papers directly from my employer mean they're not going to fight my claim? Or is this just standard procedure and I could still get denied? Just filed my initial claim yesterday and I'm super anxious about whether I'll actually get benefits. Anyone been in a similar situation?

•Ugh that's what I was afraid of. Did your claim get approved or did the company fight it?

The paperwork is just standard - PA employers are required to provide UC information when terminating employees. The REAL question is why you were fired. If it was for misconduct, you'll likely be denied. If it was due to lack of work, downsizing, position elimination, etc., you should be eligible. Were you given a specific reason in the termination letter?

•The letter says "position elimination due to departmental restructuring" - so I guess that's good? My supervisor did mention performance issues in my last review 3 months ago but the letter doesn't say anything about that.

Position elimination is generally considered a qualifying reason for UC benefits. You'll likely be approved if that's what's stated on the termination letter. Just be prepared that your employer might still provide details about those performance issues during their response to your claim. Be honest if asked about them during any interviews. Did you receive any severance pay? That can affect when your benefits start.

•I got 2 weeks severance. Will that delay when my benefits start? I'm worried about making rent next month.

I HATE how these companies try to have it both ways! They give you the unemployment info making you think they support your claim, then they turn around and tell UC about every little mistake you ever made! HAPPENED TO ME TWICE. And the PA UC system just takes their word over yours. The whole system is rigged against workers. Hope you have better luck than I did but don't count on it.

To address your question about severance - yes, those 2 weeks of severance will likely delay the start of your benefits. PA UC considers severance as deductible income for the weeks it covers. So you probably won't receive benefits until after those 2 weeks are up. Make sure you still file your weekly certifications during this time though!

•Oh no, I didn't realize that! So I basically won't get anything for 2 weeks? How long after I file should I expect to hear if I'm approved?

Hey there! My situation was super similar in January - got laid off with a stack of PA UC paperwork. In my experience, the initial determination can take 2-4 weeks in PA right now. Your claim will likely show as "pending" with an "open issue" until they make a decision. If it helps, I was approved even though my company mentioned some attendance issues in my past. One thing - if you need to call PA UC to check your status or have questions, good luck getting through. I spent DAYS trying before I found Claimyr (claimyr.com). They got me connected to an actual UC agent in about 30 minutes. They have a video showing how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2. Totally worth it when you're stressing about rent!

•is that service legit? seems sketchy that you have to pay to talk to unemployment. shouldnt that be free???

It's legit! I was skeptical too but PA UC's phone system is completely broken. I tried for 3 days straight and got nothing but busy signals. The service just helps you bypass the phone queue. The UC agents are still the real government employees who handle your claim.

•Thanks for the tip - my claim is showing an "open issue" status now so I might need this. I've been trying to call all morning and just getting busy signals.

Based on what you've shared, you have a strong case for approval. "Position elimination due to departmental restructuring" is a clear non-fault reason. The fact that there were performance discussions in the past isn't disqualifying unless they can show you were fired specifically for misconduct or rule violations. Here's what to expect: 1. Initial "pending" status with "open issue" is normal 2. Your employer has 7 days to respond to your claim 3. If they don't contest, you could be approved in 2-3 weeks 4. If they do contest, you'll get a notice for a fact-finding interview 5. After the severance period, make sure you complete all weekly certifications 6. Document your job search activities (PA requires at least one per week) Stay positive - based on what you've shared, you'll likely be approved!

•Thank you so much for this detailed info! I'll make sure to keep up with my weekly certifications and job search activities. This makes me feel a lot better about my chances.
