PA UC Treasury offset removal timeline after fault overpayment changed to non-fault

After dealing with a nightmare situation, I'm hoping someone can tell me how long this will take to finally resolve. I had a fault overpayment from my 2023 claim that got sent to Treasury offset (they took my tax refund in February). After fighting this for months and having THREE different hearings, the referee finally ruled in my favor that it should've been non-fault all along! The UC supervisor confirmed they updated my account per the referee order last week and changed it from fault to non-fault overpayment. My question is: how long before Treasury removes the offset? I'm expecting another refund soon and I'm terrified they'll take that one too even though UC fixed the problem on their end. Has anyone gone through this process? The UC rep was super vague and just said "it takes time" but wouldn't give me an actual timeframe. I'm so stressed about this!

When I had a similar situation in 2023, it took about 5-6 weeks for the Treasury offset to be removed after UC changed my overpayment status. The systems don't communicate instantly. What you should do is request a letter from UC confirming the change to non-fault status and the removal request for the Treasury offset. That documentation will be crucial if they accidentally take your next refund too. You can upload this request through your dashboard or call them directly.

Thank you so much for the actual timeline! UC never gives straight answers these days. I'll definitely request that letter - didn't even know I could do that. 5-6 weeks feels like forever but at least I have some idea now. Did you have to follow up with them during that time or did it just automatically update?

I had my overpayment changed from fault to non-fault last year, and it took them exactly 4 weeks to remove the Treasury offset. However, I was checking my UC dashboard daily and noticed they had actually removed it on their system after 2 weeks, but it took another 2 weeks for Treasury to process it on their end. You should be able to see when UC removes it by looking under the \

THEY TOOK 3 MONTHS TO REMOVE MINE!!! And even after that I had to keep calling and calling because they still tried to take my next refund anyway!! The UC system is completely broken and they don't care that people need their money. I had to contact my state representative to finally get it fixed. Don't believe them when they say it's handled because half the time the right hand doesn't know what the left is doing!!

Oh no, that's exactly what I'm afraid of! I can't wait 3 months - my next refund should be here in about 45 days. Did contacting your state rep actually help speed things up? I'm wondering if I should just be proactive and do that now rather than waiting for them to mess up again.

I've been helping people navigate PA UC issues for years, and sadly, there's no consistent timeline for Treasury offset removals. It can take anywhere from 4-12 weeks, depending on several factors. The most important thing you can do right now is:\n\n1. Get written confirmation from UC about the status change (request this ASAP)\n2. Ask UC specifically for the date they submitted the offset removal to Treasury\n3. Call Treasury's TOP (Treasury Offset Program) directly at 800-304-3107 to verify they received the request\n\nDoing these steps will help you track where your request actually is in the process rather than just waiting blindly.

This is incredibly helpful advice! I didn't even think about contacting Treasury directly. I'll call UC tomorrow to get those dates and then follow up with TOP. Seriously, thank you for these specific steps - it makes me feel like I have some control in this process instead of just waiting and hoping.

I was in this exact situation in January. After weeks of getting nowhere with regular UC phone lines (busy signals, disconnects, hold times of 3+ hours), I discovered Claimyr.com which got me connected to a UC rep in about 15 minutes. They have a service that helps you bypass the phone queue. The rep was able to give me the exact date my offset removal was submitted to Treasury and even expedited it when I explained my situation. You can see how it works in their video demo: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2\n\nOnce I got that information, I was able to follow up properly and my offset was removed after about 3 weeks total.

Yes, it actually did. I was skeptical at first but I was getting desperate after trying to call for almost two weeks straight. The service connected me to a rep who could see exactly where my offset removal request was stuck in the system. Definitely better than guessing and waiting.

my cousins wife had overpayment thing too but it was diffrent cuz they said she didnt report all her work hours or somethin. anyway it took like 2 months for everythng to get fixed and she had to keep callin them like every week to remind them. uc people are so slow with everything!

There's an important distinction here - when overpayments involve unreported work hours, that's a different process than what OP is describing with a referee decision changing the fault status. The timeline for unreported work hours can indeed be longer because it often requires additional verification. For OP's specific situation with a referee order, it should theoretically be faster since there's an official decision already in place.

UPDATE: I followed the advice here and called UC this morning. After being on hold for almost 2 hours, I finally spoke with someone who confirmed they submitted the offset removal request to Treasury on April 29th (5 days after the referee decision). She said it typically takes 30-45 days from that date for Treasury to process it, so I should expect it to be resolved by mid-June. I also asked for written confirmation which they're sending by mail. I'm going to call the Treasury number that was suggested above to verify they received it. Thanks everyone for your help!

That's great progress! One important thing to remember is to keep copies of EVERYTHING. That confirmation letter is gold if they accidentally take your next refund - you'd be able to get it back much faster with that documentation. And definitely call Treasury to confirm they received the request. Sometimes these requests sit in queues without being processed, and a follow-up call can help move things along.

just wondering did u ever get ur first refund back that they took? when mine got changed to non-fault they still never gave me back the money they already took

That's actually another thing I'm confused about! The UC rep said something about me potentially getting the refund money back, but wasn't clear on if that happens automatically or if I have to request it separately. Does anyone know if they return the money they took through offset once it's changed to non-fault? Or am I just out that money forever?

For non-fault overpayments, you're still required to repay the overpaid amount, but without penalties and interest. If your tax refund was already taken through offset, that amount was applied to your overpayment balance. The difference now is that they can't use aggressive collection methods like offset for future refunds, and there won't be penalties. However, if the referee decision determined you weren't overpaid at all (rather than just changing it to non-fault), then you would be entitled to get that money back. Check the exact wording of your referee decision.

Omg that's terrifying! I just took screenshots of everything in my portal. I also recorded the date and time of my call with the rep and her name. The whole system feels designed to make people give up. I'm not going to let them get away with

I went through something similar last year and want to share a few additional tips that helped me. First, when you call Treasury at that number mentioned above (800-304-3107), ask them to put a note on your file about the pending offset removal - this can help if there's any confusion when your next refund comes in. Second, I'd recommend setting up email alerts through your bank if you're expecting direct deposit refunds, so you know immediately if anything gets intercepted. Finally, if you have any other federal payments coming (like stimulus payments, child tax credits, etc.), those could potentially be affected too until the offset is fully removed. The good news is that once Treasury processes the removal, it should protect all future federal payments, not just tax refunds. Stay persistent - you've already done the hard part by winning at the referee level!
