PA UC Hearing Rescheduled: Employer Claims I Requested Continuance But I Didn't - Help!

I'm totally confused and kinda panicking right now. My unemployment appeal hearing was set for tomorrow, but I just got this email saying it's being rescheduled because my employer asked for a continuance. So I called the PA UC service line to confirm, and the rep told me the hearing was postponed because *I* requested a continuance! What?? I never asked for anything to be rescheduled! I'm worried this might somehow hurt my case or make me look bad to the referee. Has anyone else dealt with this kind of mix-up before? Should I be emailing someone about this error? The hearing was already delayed once before and I really need my benefits to start coming through. The bills are piling up and I'm getting desperate. 😫

This happens more than you'd think. The UC system often has communication issues between departments. You need to email the UC Appeals office immediately (use the email on your hearing notice) AND call the Appeals office directly (not the regular UC line). Explain clearly that you did NOT request a continuance and ask for written confirmation of who actually requested it. Document everything - date, time, who you spoke with. If your employer requested it, they should have had to provide a valid reason, and you should've been notified of that reason. Request that information as well. This shouldn't negatively impact your case as long as you're clear about the mistake.

Thank you! I just found the Appeals office email and sent them a message explaining the situation. Do you think I should also try to contact my employer directly to ask why they requested the continuance? I don't want to seem confrontational but I'm really confused about what's happening.

That sounds awful! Did the delays affect your case at all? Did you ever figure out why they kept rescheduling?

This is a common mix-up. When an employer requests a continuance, sometimes it gets incorrectly coded in the system as a claimant request. Here's what you should do: 1. Send a formal email to the Appeals office stating you did NOT request a continuance 2. Request written confirmation of who actually requested it and why 3. Ask for the new hearing date to be expedited given the confusion 4. Continue preparing for your case as if the hearing might be reinstated on short notice I've seen this happen dozens of times and it rarely impacts the final decision in your case. The referee will see the documentation about who actually requested the postponement in your case file.

And make sure you check your email and mail EVERY DAY! Sometimes they'll send the new hearing notice with only a few days notice. I missed mine because it went to my spam folder and nearly lost my whole case because of it.

You might be overthinking this. Happens all the time. The UC system is a mess right now with all these claims. Just make sure u have all ur documents ready for when they reschedule. The important thing is having all ur evidence about why u should qualify for benefits.

Maybe you're right. It's just that my employer is fighting my claim pretty hard, so I'm worried about anything that might make me look bad. But I'll focus on being prepared with all my documentation.

I WENT THROUGH THIS EXACT NIGHTMARE IN JANUARY!!! The UC system is COMPLETELY BROKEN and they don't care about us at all! My employer lied about requesting a continuance too and then the hearing got pushed back 6 WEEKS!!!! By then I was almost evicted and my car was about to be repossessed. Don't expect them to fix anything or be honest with you. The whole system is designed to make us give up. Call your state rep's office - that's the ONLY thing that finally helped me.

If u really need to reach someone at PA UC, I found this service called Claimyr that helped me get through to a live agent when I had a similar issue with my hearing. They connected me within like 20 minutes when I had been trying for days. Website is claimyr.com and they have a video showing how it works: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2 I was desperate and it actually worked. The agent I spoke with was able to see exactly who requested the continuance and put a note in my file about the confusion.

Thanks for the suggestion! I've been trying to call the Appeals office all morning and can't get through. I'll check out that service if I don't hear back from them by tomorrow.

One more thing - make sure to check if the rescheduled hearing will be by phone or in person. Sometimes when hearings get rescheduled, they change the format as well. You don't want to show up in person if it's actually a phone hearing or vice versa. The new notice should specify this, but if you're not sure, confirm with the Appeals office directly.

That's a good point I hadn't considered. My original hearing was supposed to be by phone. I'll make sure to check once I get the new notice. Thanks!

I'm confused...can't you just show up tomorrow anyway? Like if you never asked for a continuance and you're ready for your hearing, can't you just go at the originally scheduled time and explain the confusion? Maybe they'll just do the hearing as planned? Sorry if this is a dumb question, I'm new to this too.

This is not recommended. If you received official notification that the hearing is postponed, then the referee will not be prepared to hear your case and may not even be available. UC appeal hearings are scheduled very specifically with the referee, employer representatives, and documentation all prepared for that time slot. Always follow the most recent official notice you've received.

Quick update - I finally got through to someone at the Appeals office! Turns out my employer DID request the continuance (something about a key witness being unavailable), but when they entered it in the system, they incorrectly coded it as coming from me. The rep apologized for the confusion and said they'll send me a corrected notice with the new hearing date (looking like it'll be in about 2 weeks). Thank you everyone for your help and advice! I'm still frustrated about the delay but at least I understand what happened now.

ugh classic PA UC mess up! glad u got it sorted out but so annoying about the 2 week delay 😠 make sure u keep filing ur weekly claims while u wait for the new hearing!!!

Thanks for the update. This is exactly the kind of clerical error I suspected. Make sure you use these two weeks to thoroughly prepare for your hearing. Review all your documents, practice explaining your case clearly and concisely, and be ready to address any points your employer might raise. Good luck with your hearing!
