PA UC Board of Review appeal vs. hearing - has anyone won after losing first appeal?

I just lost my appeal with the PA UC referee (first level) and I'm about to file for the Board of Review appeal. Now I'm trying to understand what actually happens next. Is there another hearing with the Board of Review or do they just review everything and make a decision without me being there? My determination said I quit without a necessitous and compelling reason, but I had real harassment issues my employer ignored for months! I'm seriously stressing about this because I've been without benefits for 6 weeks now. Has anyone here gone through a Board Review appeal after losing their first appeal and actually WON? Looking for some hope here because my savings are almost gone.

the board just reviews the paperwork, they dont do another hearing. at least thats what happened with me. took like 5 weeks to get a decision.

The Board of Review doesn't typically conduct another hearing unless there are exceptional circumstances. They review the testimony and evidence from your referee hearing along with any written arguments you submitted with your appeal. If they feel something was missed or unclear, they might remand (send back) the case to the referee for another hearing, but that's not common. You should have received instructions with your referee decision on how to appeal to the Board. Thank you so much for explaining this! I did include a detailed letter with my appeal explaining why I think the referee got it wrong. I have documentation of the harassment I reported to HR multiple times with no action taken. Do you know roughly how long Board decisions usually take?

I WON my board appeal after losing with the referee!!!! It can totally happen! My case was different tho - they said I was fired for willful misconduct but I proved I was following company policy. Took about 7 weeks to get the board decision but TOTALLY worth it when I got that fat backpay check!!!

i lost both my appeals. whole system is rigged against workers. employer lies and UC believes them every time. waste of time imo

Not always true. I won my Board appeal after losing with the referee. The system isn't perfect but it's not completely rigged either. Appeals can work if you have documentation and make solid arguments.

To directly answer your original question - yes, people do win Board appeals after losing at the referee level. My sister-in-law had almost the exact same situation (quit due to workplace harassment) and won her Board appeal after losing with the referee. The Board took her documentation more seriously and overturned the decision. Don't give up hope!

It took about 6 weeks for her. And yes, she had to borrow money from family during that time because PA doesn't pay benefits while appeals are pending. But once she won, she got all the back payments in one lump sum.

Has anyone managed to get payments while waiting for their Board decision? My claim status just says "appeal pending" and I can't even file my weekly claims.

You should still be able to file weekly claims even with an appeal pending. This is very important - you need to keep filing every week during your appeal or you won't get those weeks paid if you win. If the system won't let you file online, call UC and ask them how to file your weekly certifications during the appeal process.

I'll keep filing my weekly claims and try to figure out how to make it through the next 6-8 weeks financially. Maybe I'll try that Claimyr service to at least check on my status instead of calling UC endlessly. Will update here when I get my decision!

I did try to organize my evidence chronologically when I filed the Board appeal, but I'm wondering - did you submit any NEW documentation to the Board that wasn't presented at the referee hearing?
