How many times can PA UC employer reschedule appeal hearing? Mine's been rescheduled 3x already!
I'm getting beyond frustrated with my PA unemployment situation. My former employer contested my claim (saying I quit when I was actually laid off), and I've been waiting for an appeal hearing for AGES. The problem is that the employer has already rescheduled the hearing THREE TIMES in the last 2 months. First they claimed scheduling conflict, then their HR rep was out sick, and now they're saying they need more time to gather documents. Meanwhile I'm struggling to pay bills and burning through my savings! Is there a limit to how many times they can postpone this? Can I object somehow? My benefit payments have been on hold this whole time and I'm desperate.

Pennsylvania UC regulations actually limit this. Employers are typically allowed ONE postponement for good cause, and additional postponements are at the referee's discretion. After three postponements, this is unusual. Call the appeal office where your hearing is scheduled and explain the situation - they may deny further postponements or potentially rule in your favor if the employer continues to delay. Make sure you document all the postponement dates and reasons given.

same thing happend to me last year!! my old boss kept delaying and delaying. eventually the ref got tired of it and ruled in my favor cuz they didnt show up to the 4th scheduled hearing lol. hang in there!!

I think u can ask for "backpay" too? Like when they decide in ur favor (if they do) they should pay u all the weeks u were waiting. But not 100% sure how that works......

•Yes, this is called "relief from charges" and if the appeal is found in your favor, you'll receive all eligible weeks of benefits from when you first filed, assuming you've been filing your weekly claims throughout this period. Don't stop filing your weekly claims while waiting for the appeal decision - that's a common mistake that causes people to lose benefits they're entitled to.

THE SYSTEM IS LITERALLY DESIGNED TO MAKE YOU GIVE UP!!!! I'm 100% convinced employers know exactly what they're doing when they pull this postponement garbage. They hope you'll either 1) find another job or 2) give up on fighting it. DON'T GIVE UP. Keep documentation of EVERYTHING and make sure you're ready when the hearing finally happens. They cant delay forever!!

•This is so true. My cousin works in HR and says some companies have policies to contest EVERY unemployment claim regardless of circumstances just to discourage people. Disgusting practice but totally legal apparently.

If you're having trouble reaching someone at the UC office about this (which is likely), I'd recommend trying Claimyr. •Yes, it definitely worked for me. The PA phone lines are completely overwhelmed, especially for appeals questions. With Claimyr I got through to an actual UC rep who was able to look up my case and submit a note to the referee about the excessive postponements.

Contact the Unemployment Compensation Board of Review directly at 717-787-5122. Explain that your employer has requested multiple postponements and ask if they can expedite your hearing or deny further postponements. Pennsylvania rules state that postponements should only be granted for "proper cause" and after three, they should be scrutinizing these requests more carefully. When you call, have your appeal number ready and be prepared to provide the dates of all the previously scheduled hearings that were postponed. You may need to be persistent, but this is the most direct route to address the issue.

Also mention that you're prepared to proceed with the hearing immediately and that the multiple postponements are creating financial hardship. Be polite but firm about needing resolution.

One additional suggestion: if you haven't already, document every communication with your former employer about the separation. Text messages, emails, the final paycheck stub showing layoff vs. quit - anything that supports your version of events. The more prepared you are for the actual hearing, the better your chances of winning regardless of their delay tactics.

•I've been keeping everything, including the original layoff notice they gave me. It clearly states "position eliminated due to restructuring" which directly contradicts their claim that I quit. I also have emails discussing the layoff from my manager. Hopefully that will be enough evidence.

What finally worked for me was filing a complaint with the PA Department of Labor & Industry's Office of UC Tax Services at the same time I was pushing for the hearing to proceed. I explained that the employer was using delay tactics and it seemed like they were trying to avoid the hearing because they knew their case was weak. The complaint didn't directly speed up my hearing, but it created a paper trail that showed the employer's pattern of avoidance. When I mentioned this complaint during my eventual hearing, the referee seemed to take note of it. Also, make sure you're documenting every single postponement with dates and reasons - this pattern of delays can actually work in your favor during the hearing itself.
