Fired from union job in PA - can I still qualify for UC benefits?

So I just got terminated from my position at a manufacturing plant where I was part of the union for 3 years. The company is claiming I violated their attendance policy (I was literally 10 minutes late three times in one month because of documented car troubles). The union rep seemed pretty useless during my termination meeting and just sat there while HR handed me my papers. I filed for unemployment the next day and now I'm worried that being in a union might affect my claim somehow? Has anyone been fired from a union job and successfully got PA unemployment? Does the union status make the process different or hurt my chances? Really need these benefits while I search for something new.

union or non-union doesn't matter for unemployment. what matters is if u were fired for willful misconduct. attendance can be tricky. did u get warnings before? did u provide documentation for car issues?

I got one verbal warning about a month ago. And yes I have texts to my supervisor each time showing I was having car trouble and would be a few minutes late. I even have repair receipts from the shop. So this isn't considered willful misconduct right?

I successfully got UC after being let go from my union position with AFSCME last year. The key factors were: 1) I had documentation of all my disciplinary actions, 2) I made sure to carefully explain my side during the initial UC application, and 3) I had my union send me a copy of the contract showing the exact violation they claimed. The union status doesn't hurt your claim at all - in fact, if your union contract has specific discipline procedures that weren't followed, that can HELP your case. Ask your union rep for a copy of the attendance policy and the full collective bargaining agreement. When UC reviews your case, they'll want to see if the employer followed their own procedures.

This is super helpful! I'll definitely request those documents from my rep tomorrow. I didn't even think about checking if they followed all the proper discipline procedures in our contract. Thank you!

I got DENIED after being fired from my union job at the grocery store!!! They said I had "willful misconduct" because I missed 3 shifts in 2 months even though I called off properly each time!!! The union didn't help AT ALL during my appeal and I had to represent myself at the hearing which was TERRIFYING!!! I'm still waiting to hear back and I'm so stressed I can barely sleep!!!

That's why union jobs can be a double-edged sword. The attendance policies are often MORE strict because they're so clearly defined in the contract. Your union should have assigned a rep to help with your UC appeal - that's literally what your dues pay for! I would call the union hall directly and ask to speak to the business agent, not just your shop steward.

Being in a union doesn't affect your eligibility for UC. I was fired from my teamsters job for similar reasons and got approved. The key is documenting EVERYTHING. In your UC application be very specific that you had documented car issues and that 10 minutes late is hardly excessive. Good luck!

Thanks! Did you have to go through an appeal or did they approve you right away?

They initially denied me but I won on appeal. The appeal was actually pretty straightforward - just telling my side to the referee.

Good to know. I'm preparing myself mentally for the possibility of an appeal. I'm gathering all my documentation just in case.

Union status has no direct impact on UC eligibility. What matters is the reason for termination. For attendance issues, PA UC looks at: 1. Whether the employer had a reasonable attendance policy 2. Whether you were aware of the policy 3. Whether your absences/lateness were within your control 4. Whether you had good cause for the absences/lateness With documented car troubles and only being 10 minutes late, you have a good case that this wasn't willful misconduct. Make sure you clearly explain this when claiming benefits and provide those repair receipts if asked. However, be prepared for your employer to potentially contest your claim. Many companies automatically contest all UC claims regardless of circumstances.

Thank you for the detailed explanation! I'll definitely make sure to highlight the documented car issues. I'm going to gather all my repair receipts and text messages to supervisors just in case.

my cousin got fired from his UNION construction job for something similar and they STILL got unemployment!! the whole system is rigged if you ask me. meanwhile us small business owners have to pay higher and higher UC taxes because of all these claims!!!

The system isn't "rigged" - it's designed to protect workers who lose their jobs through no fault of their own. Being 10 minutes late due to documented car issues isn't the same as consistently not showing up without cause. UC isn't some kind of welfare handout - it's insurance that both employers and employees pay into.

If you're trying to reach PA UC, you might want to try Claimyr (claimyr.com). I was getting nowhere with busy signals for weeks until a coworker recommended it. They got me connected to an actual UC agent in under an hour. You can see how it works in their video: https://youtu.be/CEPETxZdo9E?si=WL1ZzVZWG3KiHrg2. Totally worth it to get my open issue resolved instead of waiting months.

Something else to consider - check if your union contract has any provisions about unemployment benefits. Some union contracts actually have supplemental unemployment benefit funds (SUB pay) that can provide additional income on top of regular UC. Also, if your company is claiming you violated the attendance policy, request a copy of your attendance records directly from HR. When I got let go from my union position, I discovered discrepancies in their records that helped my case.

I didn't even know SUB pay was a thing! I'll definitely look into that, though I'm not sure if our contract includes it. And good call on requesting my attendance records directly - I'll email HR tomorrow.

After 2 weeks with no update on my UC claim I finally got through to a rep yesterday. Apparently my employer is contesting it (no surprise) but the agent said with my documentation I should be fine. Just a waiting game now!

good luck! employers almost always contest, it's annoying but part of the process. if u have those repair receipts u should be ok. 10 min late is nothing lol
