Will my 2020 work history qualify for a new ny unemployment claim?
The October deadline is getting closer and I'm trying to figure out if I can file a new claim. I worked for about 8 weeks back in 2020 and earned approximately $8,400 total. Does anyone know if this would make me eligible for a new claim? What factors does ny unemployment look at when determining qualification for new benefits? I'm not sure if my short work history is enough or what the minimum requirements are. Thanks for any help!

They look at your base period - either the first 4 of the last 5 completed calendar quarters before you file, or the last 4 completed quarters. You need to have worked in at least 2 of those quarters and made a minimum amount. With only 8 weeks of work in 2020, it probably won't be enough unless it was spread across different quarters. You can check the exact requirements on the NYSDOL website, but generally you need to have earned about $2,600 in your highest quarter and at least 1.5x that amount total across your base period.

Yeah unfortunately if it was all in one quarter that's probably not gonna cut it. You need earnings in at least 2 different quarters for a valid claim.

I get the skepticism, I really do. But this isn't some hack or workaround - they just solve the hold time problem. The call still goes through the normal channels, you still talk to the same agents. They just handle the waiting part.

From what i understand, they need to see that you worked and earned at least $2,700 (i think thats the min) in your high quarter, plus you need enough total wages across multiple quarters. With only 8 weeks of work all in 2020, I don't think you'll qualify, especially since we're approaching the end of 2023 now. Those 2020 wages would be way outside your base period for a new claim.

Regular unemployment is for W2 work only. 1099 work doesnt count for traditional benefits unles you were misclassified.

Actually this isn't completely true anymore. NY has changed some rules around this. If you've been paying into the system through your 1099 work (self-employment tax), you might qualify. Its worth checking with an agent directly.

Look im gonna be blunt - ur work history is probly not enough. I just went through this. They told me I needed to have worked in at least TWO quarters and my total earnings had to be at least 1.5x my highest quarter earnings. I only worked for like 3 months in one quarter and didnt qualify. The whole system is designed to disqualify as many people as possible tbh 🤮

You should definitely call and speak with a representative. Your situation might have specifics that could qualify you that we don't know about. The ny unemployment system has so many exceptions and special cases. Getting someone on the phone who can look at your exact record is the only way to know for sure.

It depends on when exactly you worked those 8 weeks. If it was Jan-Feb 2020, it's definitely too old now. If it was Nov-Dec 2020, it still might be in your base period depending on when exactly you file. But even then, you need wages in 2 different quarters, so if all 8 weeks were in the same quarter, you're out of luck regardless. Sorry man.

Have you worked at all since 2020? If not, then I'm pretty sure those earnings won't count anymore. Your base period is based on recent work history, not stuff from 3 years ago.

They use a complicated formula based on your base period wages. From what I remember when I had to deal with this last year, you need around $3000 in your highest quarter and then a total that's 1.5 times that across multiple quarters. With only 8 weeks of work in 2020 (which is now outside your base period anyway), you probably won't qualify. But definitely worth calling to confirm.

If your only work was back in 2020, that won't count for a new claim now in 2023. The base period only looks back 15-18 months max (depending which method they use). You'd need more recent work history to qualify for a new claim.

you should check exactly which months you worked and how much you earned in each CALENDAR quarter (Jan-Mar, Apr-Jun, etc). That's how they divide it up. If all your work was in the same quarter then probs not gonna qualify.

I actually just went through this exact process! Short answer - no, 8 weeks from 2020 won't qualify you now. The base period for unemployment claims only includes the 5 most recently completed calendar quarters before you file. So if you file in September 2023, they'd look at April 2022 through June 2023 (for the standard base period) or July 2022 through June 2023 (for the alternate base period). Your 2020 work history would be completely outside of this range.

Don't listen to those saying you definitely won't qualify. The rules changed several times during COVID and there might be special provisions that apply to your situation. You need to talk to an actual unemployment specialist who can access your wage records. The only way to know for sure is to file and let them make the determination.

Everyone keeps talking about 'quarters' but let me make it simple: 8 weeks of work from 2020 is NOT gonna qualify you for a new claim in 2023. Period. Those wages are way too old to count in your base period. The base period only includes the last 4-5 quarters before you file, so at most they go back about 15 months. Your 2020 work was like 3+ years ago now.

Man, I feel this. I worked only 10 weeks last year and didnt qualify either. The whole system is set up to make it as hard as possible to actually get benefits.
