Will I get unemployment back pay after NYS Department of Labor approves my delayed claim?
My unemployment claim has been stuck in adjudication for over 6 weeks now. I filed back in early December but they needed to verify my previous employment. I finally got all my documentation submitted last week through the document upload portal. If they approve my claim, will I get back pay for all those weeks I've been waiting? I'm really worried because I've been struggling financially this whole time and need to know if I can expect the money from those missed weeks.

Yes, if your claim gets approved you should receive back pay for all the weeks you were eligible, starting from your original filing date. The NYS Department of Labor will pay you for every week that you filed a weekly claim and were found eligible, even during the adjudication period. Make sure you've been filing your weekly claims this whole time though!

•Thank god, yes I've been filing every week like they told me to. I was so scared I'd lose all that money just because their system was slow.

same thing happened to me last year, took 8 weeks but got all my back pay in one lump sum when it finally went through

The key is that you have to keep filing your weekly claims during adjudication. If you stopped filing, you won't get back pay for those weeks you didn't file. But as long as you've been filing consistently, you should get everything you're owed. The payment usually comes within 1-2 business days after approval.

•Wait, what if I missed filing one week because I was confused about whether I should keep filing? Will I lose that week's benefits entirely?

•You might be able to request a late claim for that week, but you'd need to call the NYS Department of Labor to ask about it. Sometimes they allow it if you have a good reason.

I had to deal with this same situation and couldn't get through to anyone at NYS Department of Labor for weeks to get answers. Finally used this service called Claimyr (claimyr.com) that actually got me connected to a real person who confirmed my back pay would come through. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Was way easier than trying to call myself.

•How much does something like that cost? I'm already strapped for cash waiting for my benefits.

•I was worried about that too but it was worth it to finally get real answers instead of just waiting and wondering. Much cheaper than the stress of not knowing what was going on with my claim.

THE WHOLE SYSTEM IS A JOKE!!! I waited 12 weeks for back pay and when it finally came it was less than what I calculated. They never properly explained the deductions either. At least you'll probably get something but don't expect the NYS Department of Labor to make it easy or transparent.

definitely keep filing weekly! friend of mine stopped filing during adjudication thinking it didn't matter and lost out on like $4000 in back pay

I'm going through something similar right now - filed in January and still waiting on adjudication for an identity verification issue. Reading all these responses gives me some hope that I'll eventually get the back pay. It's frustrating how long these processes take, especially when you're already financially stressed. Michael, I hope your claim gets approved soon and you get all that money you've been waiting for!
