What is unemployment percentage criteria for NYS Department of Labor weekly claims?
I'm confused about the unemployment percentage requirements when filing my weekly claims with NYS Department of Labor. I worked part-time this week (16 hours) and made $240, but I'm not sure how this affects my unemployment benefits. Do I still qualify for partial benefits? What percentage of my weekly benefit amount can I earn before they reduce my payments? The my.ny.gov website isn't very clear about the calculation.

NYS Department of Labor uses a formula where you can earn up to 25% of your weekly benefit rate without any reduction. Anything above that gets deducted dollar-for-dollar from your benefit amount. So if your weekly benefit is $400, you can earn up to $100 without penalty. Your $240 would reduce your benefit to $160 that week.

•That makes sense! So I should still file my weekly claim and report the $240 honestly?

I had trouble getting through to NYS Department of Labor when I had questions about partial benefits. Ended up using this service called Claimyr (claimyr.com) that helped me reach an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Made it so much easier than sitting on hold for hours just to get hung up on.

•Did they charge you for that? I've been trying to call for weeks about my adjudication issue.

•They do charge but it was worth it to actually talk to someone who could explain my specific situation instead of guessing from the website.

The NYS Department of Labor system is SO confusing about this stuff! I've been unemployed for 6 months and still don't fully understand how they calculate everything. Sometimes I think they make it complicated on purpose to discourage people from claiming benefits they're entitled to.

Just remember to keep track of your job search activities too. NYS Department of Labor requires 3 work search contacts per week even when you're working part-time and claiming partial benefits.

•Wait, I still need to do job searches even though I'm working part-time? I thought that requirement was waived if you had some employment.

•Nope, the job search requirement stays in place unless you're on standby status with your employer. Part-time work doesn't exempt you from the work search requirement.
