What is partial credit unemployment benefits in NYS Department of Labor system?

I just started a new part-time job after being unemployed for 6 weeks, but I'm only getting about 15 hours a week. Someone mentioned I might still qualify for something called 'partial credit unemployment' through NYS Department of Labor but I have no idea what that means. Do I still file weekly claims? How does it work if you're working but not making much? My regular UI benefit was $365 a week and now I'm only making about $240 from this part-time gig. Any help understanding this would be amazing!

Yes, you can still collect partial unemployment benefits in New York! When you work part-time while collecting UI, NYS Department of Labor has a formula. They subtract your gross weekly earnings from your benefit rate, but there's a partial earnings disregard. You need to report ALL hours worked and gross pay on your weekly claim certification. Keep filing your weekly claims and be totally honest about your work.

Thank you! So I should keep certifying every week even though I'm working? I was worried they'd cut me off completely.

The formula is your weekly benefit rate minus your gross weekly earnings, but you get to keep the first $50 you earn without any reduction. So if your benefit is $365 and you earn $240, you'd get $365 - ($240 - $50) = $175 in partial benefits. Always report exactly what you earned and hours worked on your weekly certification.

Wait really? I thought any work meant no benefits at all. This is good to know!

Just be super careful about reporting everything correctly. I messed up once and didn't report some cash work I did and NYS Department of Labor hit me with an overpayment notice months later. It's not worth the risk - they cross-check with employers.

I was in a similar situation last year and had such a hard time getting through to NYS Department of Labor to ask questions about partial benefits. The phone lines are always jammed. I ended up using this service called Claimyr (claimyr.com) that helped me get connected to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Made it so much easier to get clarification on the partial benefit calculations.

How much does something like that cost though? I'm already struggling financially.

It's worth checking out their site for the details, but for me it was way better than spending hours on hold or never getting through at all.

Just keep filing your weekly claims and answer honestly about your work hours and pay. The system will calculate your partial benefit automatically. Don't overthink it!
