How much is partial unemployment benefits from NYS Department of Labor?

I just started working part-time after being fully unemployed for 2 months. My new job only gives me about 20 hours a week at $18/hour, so I'm making around $360 weekly before taxes. I was getting $504 in full unemployment benefits before. Does anyone know how much partial unemployment I can get from NYS Department of Labor? I tried calling but couldn't get through and the website isn't super clear about the calculations.

NYS Department of Labor calculates partial benefits using a formula. You can earn up to 25% of your weekly benefit rate without any reduction. After that, they reduce your benefits dollar-for-dollar for earnings over that threshold. So with your $504 benefit rate, you could earn up to $126 without reduction. Your $360 earnings would reduce your benefits to around $270 per week.

That's actually not too bad! So I'd get $270 plus my $360 wages = $630 total which is more than my full unemployment was. Thanks for explaining the math!

just make sure you report all your earnings when you file your weekly claim or they'll hit you with an overpayment later

This happened to my sister last year - she forgot to report some cash tips and NYS Department of Labor wanted back like $2000. Always better to be safe and report everything.

I've been dealing with partial unemployment for months and honestly the NYS Department of Labor phone system is impossible. If you need to speak to someone about your specific situation, I found this service called Claimyr (claimyr.com) that actually got me through to an agent. They have a video demo at https://youtu.be/qyftW-mnTNI showing how it works. Saved me hours of calling and getting hung up on.

Thanks for the tip! I might need that if my partial claim gets complicated. How much does it cost?

I don't remember the exact price but it was worth it to actually talk to someone at NYS Department of Labor instead of sitting on hold for hours. They focus on getting you connected rather than making it expensive.

Make sure you're still doing your work search activities even with partial unemployment. NYS Department of Labor still requires you to look for full-time work and keep your job search log updated. Don't let the part-time work make you forget about the other requirements.

Wait I thought if you were working you didn't have to do work search? This is confusing.

No, you still need to search for work unless you're working full-time. The partial unemployment is supposed to be temporary while you look for better employment.

I went through this same situation last year! One thing to keep in mind is that your partial benefits might affect your benefit year duration. Since you're still drawing some unemployment, it uses up your benefit weeks, just at a lower amount. So if you were originally eligible for 26 weeks of full benefits, working part-time and getting partial benefits still counts toward those 26 weeks. Just something to factor into your planning while you're looking for full-time work.
