Stuck in NY unemployment investigation since March - anyone know how long determinations take?
Been out of work since March 9th, 2025. My NY unemployment case went into investigation and I've only been able to speak to a representative ONE time this whole time based on a tip from here (calling on Thursday between 10-12) but I haven't had any luck since. I called the governor's office per some posts on here as well but I never get connected with someone it always prompts me to leave a message which I have done 3 times now. Any help would be appreciated? Anyone else waiting on a determination from investigation? How long did it take for them to get back to you? I'm getting desperate since my savings are almost gone and no one can tell me whether I'll even get benefits.

8 weeks?? That's insane! Did they at least tell you why you're under investigation? They wouldn't tell me anything specific.

Same boat here. Been waiting 6 weeks for determination. The stress is unbearable.

Investigations typically take 4-10 weeks depending on complexity. Make sure you've submitted all requested documentation through your online account. You can also try sending a secure message through your NY.gov account specifically requesting a status update on your investigation. Be sure to include your full name and last 4 of SSN in the message.

After struggling with this same issue for weeks (almost 7 weeks of investigation with no contact), I finally got through to an actual claims specialist who could help. I used a service called Claimyr (claimyr.com) that connected me to NYSDOL within 30 minutes after I'd been trying for weeks on my own. The agent was able to tell me exactly what was holding up my claim and what documents I needed to submit. Check out their demo video if you're curious: https://youtu.be/Rdqa1gKtxuE - seriously saved me weeks of more waiting and stress.

I've never heard of that service before. Did they actually help resolve your case or just get you through to someone? I'm desperate enough to try anything at this point.

They just get you through to NYSDOL quickly instead of you having to call hundreds of times. The NYSDOL rep I spoke with explained what documents were missing and I uploaded them right away. My case was resolved in about 5 days after that call. Worth every penny for me because I was about to miss another rent payment.

Investigations are taking longer than usual right now due to the high volume of claims. Here's what has worked for some of my clients: 1. Send a secure message through your NY.gov account every 7-10 days requesting a status update 2. Make sure ALL your employment documentation is uploaded (past pay stubs, W2s, separation notice if you have it) 3. Check your spam/junk folders daily for communications 4. Call the legislative office for your district - they can sometimes escalate cases 5. Be consistent but professional in all communications Most investigations are resolving in 6-8 weeks currently, though some complex cases take longer.

Thank you for the detailed advice! I'll try contacting my district office today. I've uploaded everything they asked for but haven't heard anything back. Should I upload the documents again or would that just confuse things?

Don't re-upload unless specifically asked to do so - it can actually create confusion in their system. Instead, send a secure message listing all documents you've already submitted with their upload dates, and ask if anything else is needed. This creates a documented trail of your compliance.

I'll definitely try this tomorrow morning! Did they actually help resolve your case when you got through?

My investigation took almost 9 weeks to complete, and it was the most stressful time of my life. I had to borrow money from family just to pay my bills. I think what finally moved things along was when I contacted my state assembly person's office - they have direct contacts at NYSDOL and submitted an inquiry on my behalf. After that, I got approved within 10 days and received all my backpay! Don't give up, and document EVERYTHING - dates you called, who you spoke with, what was said. This will be helpful if you need to prove you've been trying to resolve the issue.

Just Google "NY State Assembly [your neighborhood/borough]" to find your representative. Their websites always have a constituent services contact form or phone number. Explain that you're having issues with your unemployment claim and they'll usually have you fill out a release form so they can inquire about your case.

Anybody else notice how the DOL website says investigations typically take 2-3 weeks but literally NOBODY gets a determination that fast?

Mateo Sanchez
YES! That's exactly why I've been so confused. Everything official says 2-3 weeks but I'm going on 5 weeks now with zero updates.

For claims under investigation, it's important to understand that the timeline is highly variable. Some factors that affect processing time include: - Whether your former employer contests the claim - Availability of required documentation - Verification of your employment history - Current case backlog at NYSDOL While investigations used to average 2-3 weeks, current processing times are closer to 6-8 weeks for most cases. Make sure you're certifying weekly even while under investigation - if approved, you'll receive backpay for all properly certified weeks.

Thank you for the explanation. I've been certifying every week without fail. It's just so stressful not knowing if I'll ever see that money. Do they notify you when they make a determination or do you just suddenly start receiving payments?

You should receive an official determination notice via postal mail and/or in your online message center, regardless of whether the decision is approval or denial. If approved, payments typically begin processing within 2-3 business days after the determination is made. If your mailing address has changed since you applied, make sure that's updated in your account to avoid missing important notices.

After multiple failed attempts, I found success by calling my state senator's office. They have a staff member dedicated to helping constituents with unemployment issues. After I filled out their authorization form, they contacted NYSDOL directly. Within a week, my investigation was completed. You can find your NY state senator at nysenate.gov/find-my-senator

i heard that if u answer ANYTHING wrong on your weekly certification they can put u under investigation. even if its an honest mistake!! thats why im super careful now and triple check everything

That makes me paranoid now! I wonder if I made a mistake somewhere. I've been certifying honestly but now I'm worried I might have clicked something wrong.

One important thing to know is that benefits under investigation are still potentially payable - that money isn't gone if your claim is eventually approved. In most cases, once a determination is made in your favor, you'll receive all back benefits for weeks properly certified. While waiting, ensure you're doing these things: 1. Continue certifying weekly without fail 2. Check your NY.gov inbox at least 3 times weekly for communications 3. Keep a detailed log of all your job search activities 4. Respond immediately to any requests for information The system is frustratingly slow, but persistence typically pays off.

I've been doing all of those things except keeping detailed job search logs. Is that required during an investigation period? I've been looking for work but not documenting it carefully.

Yes, documenting your work search activities is required throughout the entire period you're claiming benefits, including during investigation. NY requires you to make at least three work search activities per week and be able to provide this information if requested. Start documenting immediately - websites applied to, application confirmation numbers, contacts made, etc. This can become crucial if they question your eligibility.

That's my biggest fear right now - waiting all this time just to get denied. Did they give you a specific reason?

TIP: Call the TTY/TDD line instead of the regular number. It's 1-888-783-1370. Sometimes the wait is shorter there and they can still help regular claims. That's how I finally got through after two weeks of constant calling. The representative was able to see notes on my account and told me exactly what was holding things up.

I never thought of trying the TTY line. Is that ethical though? Isn't it meant for people with hearing impairments?

You're right, and I actually felt bad about it after. I was just desperate after hundreds of failed calls. The legislative office route is probably more appropriate - that's what ultimately resolved my case.
