NY unemployment claims pending for 5 months after getting fired - can't reach anyone by phone
I was fired from my job in late July 2025 after working there for 10 years. I immediately filed for NY unemployment and have been claiming benefits every week since then, but I still haven't heard ANYTHING from them about my claim status. It's been almost 5 months now! I can't get through to anyone on the phone either - just endless waiting and then disconnects. I'm getting really desperate since my savings are almost gone. Can anyone tell me how I can actually get in contact with a real person at the unemployment office? Has anyone successfully reached them recently?

That's WAY too long to be waiting. Sounds like your claim might be stuck in adjudication, especially since you were fired rather than laid off. They probably need to verify the circumstances with your employer. Have you checked your online account to see if there are any messages or requests for additional information that you might have missed?

•I check my online account literally every day. There's nothing there except confirmation that I've been filing my weekly claims. No messages, no updates, no requests for info... nothing! It just says my claim is 'pending.' I'm worried they never got the paperwork from my ex-employer or something.

•I've been checking spam folders, regular emails, message center, everything! There's absolutely nothing. Did you eventually get it resolved? How?

When claims involve termination, they often get flagged for review, especially with a long work history like yours. Here's what I suggest: 1. Keep certifying weekly (which you're doing - good) 2. Send a secure message through your online account specifically asking about your claim status 3. Try calling right when they open at 8:00 AM 4. Contact your state representative's office - they often have dedicated liaisons for unemployment issues 5. Check if there's an option to schedule a callback rather than waiting on hold If your claim is approved, you'll receive all back payments from when you first filed, so don't worry about losing those weeks of benefits.

•Thank you for these suggestions! I've tried calling early but still can't get through. I'll definitely try contacting my state rep - I hadn't thought of that. And I've sent about 15 messages through my account but haven't gotten any responses. It's like shouting into a void.

After trying for WEEKS to get through the phone lines, I finally tried using Claimyr (claimyr.com) and got through to an agent in less than an hour. They have this video showing how it works: https://youtu.be/Rdqa1gKtxuE - basically they hold your place in line and call you when an agent is available. Totally worth it for me since I had a similar situation where my claim was stuck for months and I needed an actual human to fix it. They resolved my issue in one call.

•does that really work? sounds kinda sketchy tbh

•It's legit - I was skeptical too but I was desperate after not getting benefits for months. The unemployment system is just completely overwhelmed now with all the layoffs happening in 2025. The service just holds your place in line so you don't have to stay on hold for hours.

•I'm willing to try anything at this point. Thanks for suggesting this - I'll check out that video and maybe give it a shot. Did you have to explain your whole situation to the agent or did they already have your info?

The NY unemployment system is COMPLETELY BROKEN right now!!! I've been dealing with these idiots since August and it's now JANUARY!!! They don't answer phones, don't respond to messages, and then they have the nerve to blame US when things go wrong. I've called 47 TIMES in one day and couldn't get through. The whole system needs to be torn down and rebuilt from scratch!!! Sorry for the rant, but I've been exactly where you are and it's infuriating. The only thing that eventually worked for me was showing up IN PERSON to a career center. Most of them can't directly help with claims, but if you make enough noise, sometimes they can connect you with someone who can.

•Wow, I didn't even think about trying to go in person! Is that allowed? Do I need an appointment? The nearest office is about 40 minutes from me but I'd gladly make the drive if it meant actually talking to someone.

•Some offices require appointments, others don't. Call ahead or check online first. Bring ALL your paperwork - ID, termination notice, anything related to your claim. Be prepared to wait. And be NICE to the front desk people - they're not the ones who created this mess and they're more likely to help if you're polite but persistent.

I waited 3 months for my claim to process after being fired from my retail job (apparently "excessive tardiness" even though my bus was always late and not my fault but whatever). The thing that finally worked was calling my state senator's office. They have people who specifically handle unemployment issues. I got a call back from unemployment within 2 days after my senator's office contacted them. They backdated everything and I got all my money at once. Try that route!

•Thank you! I'm definitely going to try the state rep/senator route. Did you just call their main office number? And how long ago was this? I'm wondering if it still works that way.

•This was just last month! I just looked up my state senator online, called their district office (not the Albany one), and explained my situation. They took down all my info and said they'd contact NYSDOL on my behalf. Sure enough, I got a call from an actual unemployment agent two days later who fixed everything. They can't skip you ahead in line exactly, but they can flag your case for attention.

my cousin works for the state (not unemployment but different dept) and she says they r super backlogged right now cuz of the big tech layoffs in nyc plus that huge manufacturing plant that closed upstate. she said like 40% more claims than normal or something

•That makes sense, but 5 months seems ridiculous no matter how backlogged they are! But thanks for the insight - at least I know it's not just me they're ignoring.

Back to your original situation - the fact that you were fired after 10 years is likely what's causing the delay. When an employee is fired, the employer often contests the unemployment claim. If they did, your case would require a hearing where both sides present their case. Have you received ANY notice about a hearing or interview? These can sometimes go to regular mail rather than appearing in your online account.

•No, I haven't received anything about a hearing or interview - not by mail, email, or on my account. And I've been checking my mail religiously. My former employer was pretty vindictive about the firing (it was honestly over something really stupid), so I wouldn't be surprised if they contested it. Is there a way to find out if a hearing is scheduled?

•You can try calling the Telephone Claims Center and specifically asking if a hearing has been scheduled or if your claim is being contested. The number is 1-888-209-8124. If that doesn't work, then using a service like the one mentioned above or contacting your state representative might be your best options at this point. This is definitely not a normal waiting period, even with the current backlog.

One last thing to try: the NYSDOL has a Twitter account (@NYSLabor) where they sometimes respond to people having issues. Some folks have had success sending them a direct message with their contact info (never include your SSN or claim ID in public tweets). Worth a shot while pursuing the other avenues mentioned.

•I'll try that too! At this point I'm willing to try anything. Thanks everyone for all your suggestions. I'm going to: 1. Contact my state rep/senator 2. Try that Claimyr service to get through by phone 3. Send a DM to the NYSDOL Twitter 4. Look into visiting an office in person I'll update if any of these work!

Quick update: I actually got mine resolved finally. Called using that service I mentioned, got through to someone who told me my claim had been stuck because they needed proof I'd been searching for work, but the notification never got sent to me due to a "system error." Once I uploaded my job search records, my claim was approved within a week and I got all my backpay. The whole thing could have been resolved in 5 minutes if I could have just gotten someone on the phone months ago. The system is beyond broken.

•Thank you for the update! That gives me hope that mine might be something simple too. I'm definitely going to try getting through to a human somehow this week. I've been documenting all my job searches just in case, so I have that ready if they need it.
