Need help with ny unemployment proof for cash work - no W2s

My cousin got a letter from unemployment asking for proof of employment from 2020. Problem is she only worked for about a month that year doing housekeeping and was paid in cash. No W2s or paystubs exist. She filed taxes jointly with her spouse for 2020, but I'm not sure if that's enough. Has anyone dealt with this situation before? What can she submit as proof when she was paid under the table? This is stressing her out since she doesn't want to have to repay benefits. Any advice on what documents NY unemployment will accept in this case?

This is tricky. I think the joint tax return might work if it shows any self-employment income. If she has any text messages with her employer discussing work hours/pay that could help too. Bank statements showing cash deposits around work dates might also work. But honestly, she's in a tough spot without official documentation.

Thanks for responding. The joint return just shows her husband's income, none of hers since it was all cash that wasn't reported. I'll tell her to look for any texts with the employer though, that's a good idea!

I had a similar situation and they ended up asking me to repay everything 😭 it was like $7800. Hopefully your cousin has better luck!

Oh no that's exactly what she's worried about. Did you try to appeal or anything?

0 coins

Yeah I appealed but they denied it. I ended up on a payment plan. Its ridiculous how the system punishes people who work in cash industries.

After struggling with this EXACT same issue, I finally got through to someone who could actually help. I used claimyr.com which connected me to a live agent without the usual 4+ hour wait. Best thing I've done - talking to the agent directly got my problem resolved. Definitely worth checking out for your cousin: https://youtu.be/Rdqa1gKtxuE

Is this actually real? Sounds too good to be true tbh

0 coins

100% real. I was skeptical too, but I was desperate after trying to call for literally weeks. Got connected to an agent in about 40 mins and they walked me through exactly what documentation would work for my situation.

wait this sounds super sketch... how does it even work?

0 coins

Not sketch at all! They basically call the unemployment office for you and stay on hold, then call your phone when they reach a live person. Saved me hours of hold music and actually got my issue resolved.

I've seen this recommended before in other threads. Might be worth a shot if you're desperate 🤷‍♀️

If she was doing housekeeping, maybe she has receipts for cleaning supplies she bought? Or possibly the people she worked for could write letters confirming she worked for them, with dates and amounts paid? NY unemployment sometimes accepts signed statements from employers even for cash work.

Been through this with my roomate. The DOL is going after everyone who cant prove eligibility now. The whole system is just designed to make it impossible for gig workers and cash workers to get help. It's all a scam to get people to repay benefits they already spent on surviving 🤬

0 coins

THIS!!!! They gave ppl the money when they desperately needed it and are now asking for receipts they know many ppl don't have. Its cruel and calculated.

0 coins

Seriously I know at least 5 people getting these letters. They're clearly doing a mass audit to try to recoup funds.

The honest answer nobody wants to hear: if she didnt report the income on taxes and has zero documentation, she probably shouldn't have claimed unemployment based on that job. The system is designed to verify reported income, not under the table cash work. Not trying to be harsh but that's the reality.

Wow way to blame the victim. People were literally starving during the pandemic. Should they have just died instead of claiming benefits? 🙄

0 coins

I'm not blaming anyone, just explaining how the system works. I think it's unfair too, but that doesn't change the reality of the documentation requirements.

The system is broken AF but profile 12 isn't wrong. This is literally why I kept every scrap of paper during my bartending days.

I'm an accountant (not giving official advice), but here's what I'd recommend for your cousin's situation regarding NY unemployment verification: First, gather ANY evidence possible: - Any written communications with employers (texts, emails, notes) - Bank statements showing cash deposits matching work periods - Affidavits from clients she cleaned for (have them notarized if possible) - Calendar entries showing work schedules - Photos of her at workplaces if any exist - Receipts for supplies or transportation costs related to work Second, she needs to speak directly with a DOL representative to explain her situation. Regular phone lines are nearly impossible, but services like claimyr.com can connect you with an agent much faster. Third, be prepared to request a hearing if denied. The hearing officers often have more flexibility than the initial reviewers. Don't give up - many cash workers have successfully navigated this with creative documentation approaches!

Thank you SO MUCH for this detailed response! This gives me some real ideas to help her with. I'll pass this along immediately.

This is great advice. I'd add that if she still has any contact with her previous employer, getting them to write a letter confirming dates worked could be huge.

My bf went through this whole mess last month. Try looking for anything with dates - even uber receipts to/from work locations. He literally printed out his google maps history showing regular trips to the workplace and they accepted that + a note from his former boss 👍

Tell her not to ignore this!! My sister didn't respond to a similar letter and they hit her with an overpayment notice for $11,200 plus penalties 😱 Even if she doesn't have perfect documentation, she needs to submit something and explain her situation.

0 coins

Omg that's terrifying! I'm definitely going to make sure she responds before the deadline.

0 coins

Yep. Same happened to my neighbor. Got hit with $8k overpayment. They're not playing around with these notices.

i recomend trying to call and explain the situation but good luck getting anyon on the phone lmao 💀 i tried for 2 weeks straght everyday b4 i finally gave up

0 coins

I gave up on calling too until someone told me about claimyr.com - it was the only way I actually got through to a human. Worth every penny to finally get my issue resolved!

0 coins

Hmm never heard of that. might check it out, still have some unresolved issues with my claim

0 coins

You're not alone! NY unemployment is sending these notices to thousands of people. There's a class action lawsuit brewing about this whole mess. In the meantime, document EVERYTHING and respond by the deadline even if the documentation isn't perfect.

0 coins

Where did you hear about a class action? I'd be interested in joining that!

There was an article in the Buffalo News last week and some legal aid groups are organizing. Let me see if I can find the link.

Check if her phone has any location history from 2020 that might show her at the workplace consistently. Sounds weird but I know someone who used this successfully!

The whole point of emergency unemployment during the pandemic was to help EVERYONE including cash workers. Now they're trying to claw it all back. Absolutely disgusting how NY unemployment is treating people.

0 coins

Facts! And they know exactly what they're doing targeting the most vulnerable workers who had the least documentation.
