NY unemployment waiting week stuck for 5 weeks - approved but not paid
I've been stuck in what's supposed to be a 'waiting week' for 5 WEEKS now and I'm completely lost on what to do. My NY unemployment claim was approved back in February 2025, but I haven't received a single payment. When I check my payment history, it shows $0.00 for every week, but when I look at my claim summary, it shows the correct weekly benefit amount ($582) that I should be getting. What's really frustrating is that I've already gone back to work now, but I still need those 5 weeks of benefits I'm owed! Has anyone dealt with this before? Is there something I need to do to trigger the actual payments to start? I certified every week correctly while I was unemployed, so I don't understand what's happening.

That waiting week issue is actually a common glitch in the system right now. Your claim is stuck in processing limbo. Since you've been approved, those payments should be released retroactively. You need to speak with a claims specialist directly - they're the only ones who can push it through the system. Have you tried calling the NYSDOL hotline?

•I've tried calling SO MANY TIMES but always get the 'high call volume' message and then it hangs up on me. Is there a better time to call or a special number I should use?

•Did you have to do anything special to get it fixed once you reached someone? Or did they just push a button on their end?

This is EXACTLY what happened to me!! The system is totally BROKEN. I was stuck in "waiting week" for almost 2 months even though I was approved. My theory is they purposely create these delays to avoid paying people. They hope you'll give up and go away. DON'T GIVE UP! Keep calling and document EVERYTHING. Ask for a supervisor if the first person doesn't help. They owe you that money!!!

•I don't think they're purposely doing it. The unemployment system is just really outdated. They did a partial upgrade in 2024 but it created more problems than it solved. My cousin works for the state (not NYSDOL) and says they're swamped with these issues.

I had this exact problem in January. After weeks of trying to call with no luck, I used Claimyr (claimyr.com) to get through to an agent. It basically holds your place in line and calls you when an agent is available. Took about 45 minutes instead of days of redialing. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE When I finally spoke to an agent, they explained my claim had a "processing flag" that needed manual removal. They fixed it while I was on the phone and I got all my backpay two days later. Since you're dealing with retroactive payments for weeks you already certified, it's definitely worth getting through to a live person.

•Thank you! I hadn't heard of this service before. I'll check it out because I'm getting desperate at this point. Did they ask for any specific information when you called? I want to make sure I have everything ready.

•Have your NY.gov ID and password ready, plus your claim confirmation number if you have it. They'll need to verify your identity with some personal info. Also have the exact dates of your waiting week and subsequent weeks ready. The more specific you are about the issue, the faster they can help.

•This is not good advice. If the claim is stuck in the system, it won't automatically fix itself. NYSDOL's system requires manual intervention when claims get stuck in the waiting week status beyond the normal timeframe. The waiting week is only supposed to be ONE week - if it's been 5 weeks, something is definitely wrong and needs to be corrected by staff.

DOL Claims Specialist here. What you're experiencing is called a "waiting week suspension flag" - it's when the system marks your initial week as unpaid (normal) but then fails to move your claim to active payment status for subsequent weeks (not normal). Since you've gone back to work, you'll need to specifically request retroactive payment processing. Here's what to do: 1. Call the claims center and specifically ask for a "retroactive payment review for waiting week bypass error" 2. Make sure you have documentation of all your weekly certifications from that period 3. The agent can manually override the waiting week flag and release all eligible payments 4. Request an email confirmation once it's processed This requires talking to a tier 2 agent or higher, so if the first person can't help, specifically ask to be transferred to a claims specialist. These retroactive payments typically process within 3-5 business days once the flag is removed.

•Thank you so much for this detailed explanation! That's exactly what I needed to know. I'll specifically ask for that "retroactive payment review" when I call. It's such a relief to understand what's actually happening with my claim.

Not sure if this helps but I had something similar happen and it was because my employer was slow responding to the DOL about my separation reason. Even though I was approved, the payments were held until that was resolved. Have you checked if there's a message about your employer in your account?

•I just double-checked and don't see any messages about my employer. The status just says "approved" with that frustrating $0.00 payment amount. I think it must be the technical flag issue others mentioned.

did u fill out the new MWC form?? I forgot to do the monthly work certification form and that caused my payments to stop. They added that requirement in january

•The Monthly Work Certification (MWC) form isn't relevant for waiting week issues, and it wasn't implemented until March 2025. This sounds like a standard waiting week processing error that needs agent intervention.

After you get this resolved (which will happen!), make sure to request interest on your delayed payments. Under NY Labor Law Section 598.4, they're required to pay interest on benefits delayed more than 30 days due to administrative error. Most people don't know to ask for this, but you're entitled to it!

•That's really good to know! I'll definitely ask about the interest when I call. Every little bit helps when you've been without income for weeks.

UPDATE: I finally got through to someone at NYSDOL this morning! Used the Claimyr service that was recommended and got a callback in about an hour. The agent confirmed it was exactly that "waiting week suspension flag" that was mentioned. She said my account got stuck in some kind of review loop. She processed a manual override while I was on the phone, and said I should see all my back payments within 2-3 business days! She also said they'd include interest since it was their error. Thank you all for the help and advice!!
