NY unemployment payments stopped due to expired work permit - will I get backpay now that it's renewed?
Hi everyone, I'm really stressed out about my situation. My work permit expired about a month ago and the NY unemployment office stopped my benefits for almost 3 weeks now. I just got my work permit renewed yesterday (finally!!) and uploaded the new documentation to my account. Will DOL release those missed payments to me now or am I just out of luck for those weeks? Has anyone gone through something similar with an expired then renewed work permit? The bills are piling up and I really need those 3 weeks of payments.

yes you'll get it. they did same to me last yr when my permit expired. took about 10 days after i uploaded new one to get all the back pay

You should be eligible for those weeks since you now have proof you're authorized to work during that period. Make sure you continue certifying every week even when payments are on hold! The system needs those certifications on file to process backpay. Also double-check that you uploaded the document to the correct section of your account - it should go under 'Work Authorization Documents' not just the general document upload area.

I work with these cases often, and I'd add one important detail: if it's been more than 3 business days since you uploaded your renewed work permit and you don't see any change in your payment status, you should definitely call them. Sometimes the document gets uploaded but doesn't get reviewed by an examiner.

THEY ALWAYS DO THIS!! The DOL system is set up to automatically flag and stop payments the second your work permit expiration date hits! But then when you renew and upload proof they take FOREVER to review and restart your benefits. It's like they're quick to stop money but slow to start it again. So frustrating!

You need to make a phone call. I was in a similar situation in February 2025. My work permit expired and they stopped my payments. I uploaded the renewed document but nothing happened for two weeks. I tried calling every day but couldn't get through until I found Claimyr. They got me connected to a live agent in about 20 minutes (https://claimyr.com). To directly answer your question: Yes, you will receive backpay for those weeks IF: 1. You continued to certify for benefits during those weeks 2. Your new work permit shows no gap in work authorization 3. You meet all other eligibility requirements for those weeks The NY DOL system is designed to automatically stop payments when a work authorization document expires. Once you upload the new document, they should review it and release the held payments, but this doesn't always happen automatically. If it's been more than 5 business days since you uploaded the new permit, I recommend calling the DOL directly. Have your claim ID and the date you uploaded your document ready when you call.
