NY unemployment benefits expiring next week - can we file a new claim?
Hi everyone, I'm getting really anxious as my NY unemployment benefits are set to expire next week. Does anyone know if we can file a new claim after expiration or are we just out of luck? I've been applying for jobs like crazy but nothing has panned out yet. I haven't received any notification from NYSDOL about what happens after benefits end. Are we entitled to file a new claim or is there another program I should apply for? Really worried about how I'll pay rent next month.

Whether you can file a new claim depends on if you've worked since your original claim began. To qualify for a new benefit year, you need to have earned at least 10x your weekly benefit rate in covered employment since filing your last claim. If you haven't worked at all during your current benefit year, you won't be eligible for a new claim. You might want to check if you qualify for other assistance programs like SNAP or emergency rental assistance.

im in the same boat mine ends next week too. called them yesterday and they said i cant file a new claim cuz i havent worked enough since my last one started. said something about needing to earn 10x my weekly benefit amount. this sucks.

I'VE BEEN TRYING TO FIGURE THIS OUT FOR WEEKS!!! The NYSDOL website is USELESS on this. It just keeps referring me back to the same unhelpful pages. I've called at least 20 times and can never get through to a real person!!! We deserve better than this!!! How are we supposed to know what to do if they won't even answer basic questions???

My sister just went through this last month. She said they automatically review your claim when it expires and if you qualify for a new benefit year they'll send you instructions. If not, you'll get a notice saying your benefits are exhausted. Good luck!

To clarify some confusion here - there are two separate concepts being discussed: 1. Benefit Year Ending (BYE) - This is the 12-month period from when you first filed your claim. When this expires, you need to file a new claim if you've worked during that year. 2. Maximum Benefit Entitlement - This is the total amount of benefits you can receive during your benefit year (typically 26 weeks in NY). If your benefits are expiring because you've reached the end of your 26 weeks, and your benefit year hasn't ended yet, then you've exhausted your regular UI benefits. In this case, check if there are any federal extension programs currently active (though as of early 2025, there aren't any). If your benefit year is ending, you must file a new claim if you've worked since your last claim began. You'll need to have earned at least 10x your weekly benefit rate during your benefit year to qualify.

To add to the great information already shared - if you're close to the earnings threshold for a new claim but not quite there, make sure you're counting ALL qualifying work. This includes any W-2 employment during your benefit year, even small jobs or temporary positions. Sometimes people forget about short-term work they did. Also, if you worked in another state during your benefit year, that employment can count toward your NY claim, but you'll need to make sure NYSDOL knows about it. Keep documentation of all employment ready when you speak with them.

Update: I finally got through to someone at NYSDOL using that Claimyr service someone mentioned. It actually worked! The agent confirmed everything that was said here - need 10x weekly benefit amount in earnings during benefit year to qualify for a new claim. For anyone else struggling, having an actual conversation with an agent was WAY more helpful than trying to figure it out from their website.

Yeah, the agent said if you don't qualify for a new claim, you should: 1. Apply for SNAP benefits if you haven't already 2. Contact your county's DSS about emergency assistance 3. Check with NY Housing for rent assistance programs 4. Visit your local career center for job placement help She also mentioned they have a program to help with retraining if you want to switch industries. I'm looking into that option now.
