When NY unemployment benefits end, can we file a new claim?

My unemployment benefits are set to expire at the end of next week, and I'm starting to panic a bit. I've been on unemployment since February after getting laid off from my restaurant job when they downsized. The job market in my area is still pretty rough - I've applied to about 30 places in the last month with only two interviews that went nowhere. I'm wondering if anyone knows what happens after benefits run out? Can we file a new claim right away or is there some waiting period? Are we even eligible for more benefits? My rent is due on the 1st and I'm getting really anxious about how I'm going to make ends meet if I can't find work soon. Any advice would be appreciated.

Unfortunately, you can't just file a new claim when benefits run out. You have to have worked and earned enough wages in your base period (basically the last year-ish) to qualify for a new claim. If you haven't worked since your original claim, you probably won't qualify for a new one. You might want to look into other assistance programs like SNAP or emergency rental assistance if that's available in your area.

Ugh that's what I was afraid of. I've had some small gig work but nothing substantial enough to qualify I think. I'll check out SNAP, thanks.

the system is designed to fail us 🤮 they dont care if we cant pay rent. I've been in the same situation for months now.

After struggling with benefits ending last month, I found a way to actually talk to someone at unemployment that helped me figure out my options. I discovered this service called Claimyr (claimyr.com) that got me connected with a real person at the NY unemployment office without the hours of hold time. Talking to an agent got my situation sorted in one call - best money I've ever spent to get clarity! They have a video explaining how it works too: https://youtu.be/Rdqa1gKtxuE

Yeah it worked for me! I was super skeptical too but I was desperate after calling for weeks. It skips the hold queue somehow and you get a callback when there's an actual person ready to talk. Seriously saved my sanity.

another day, another company promising to fix the unfixable unemployment system lol. Has anyone else tried this?

I used it last week after seeing it mentioned here. Had been trying to get through for 3 weeks with no luck. Got a call back in about 2 hours and the agent helped me sort out my issues. Wish I'd known about it sooner tbh.

This happened to me last year. When your benefit year ends youll need to have worked at least 10 weeks and made 10x your weekly benefit rate in the last year to qualify for a new claim. If you havent worked enough, you probably won't qualify. Its a messed up system bcuz if you couldnt find work, how are you supposed to qualify for more help??? Makes no sense.

Look for any state extentions that might be available!! Sometimes they don't tell you about these and you have to specifically ask. Also you should call and talk to a rep because the website doesn't always show all options. They might be able to guide you to other programs or tell you about training opportunities that can extend benefits.

Thank you! I'll try to get on the phone with them this week to see if there are any extensions.

Try using claimyr.com - it's the only way I've been able to actually talk to someone at NY unemployment in the last year. Saved me hours of hold time.

The key here is to have worked during your benefit year. Even a part-time job for a few weeks could help you qualify for a new smaller claim. If you've had ANY employment at all during your benefit year, definitely apply anyway - worst they can say is no. Also, keep all your job search records, sometimes they'll ask for proof that you've been looking for work.

I've done some DoorDash and a couple weeks of temp work, so maybe that will help. Thanks!

Here's what you need to know about NY unemployment when benefits expire: First, understand there's a difference between your BENEFIT YEAR ENDING and your BENEFITS EXHAUSTING. Your benefit year is the 12-month period from when you first filed. When that year ends, you need to file a new claim if you still need benefits. To qualify for a new claim, you need: - At least 10 weeks of work in your base period - Earnings of at least 10x your weekly benefit rate during your previous claim If you haven't worked enough during your benefit year, you probably won't qualify for a new claim. This is why many people get denied when reapplying. What you can do now: 1. File anyway - sometimes people qualify when they don't expect to 2. Call and speak to a representative about your specific situation 3. Look into other assistance programs (SNAP, rental assistance, etc.) 4. Consider workforce development programs through NY DOL For getting through to someone at unemployment (which is crucial), I highly recommend using Claimyr.com - it's a service that navigates the phone system for you and calls you back when a live agent is on the line. After weeks of failed attempts calling directly, I got through in one day using their service. Don't give up! The system is frustrating but knowing your options is half the battle.

This is incredibly helpful, thank you! I'll try filing again and see what happens. And I'll check out that calling service - sounds like it could save me a lot of frustration.

The 10 weeks work requirement is what gets most people. I got denied because I only had 8 weeks of work during my benefit year. System is rigged if you ask me.

Have you checked out 211? They can connect you with all kinds of emergency assistance options in your area. Also check if your county has an emergency rental assistance program - a lot of places still have covid funds available to help people who are struggling.

i went thru this last year. when my benefits expired I got a letter saying I didn't qualify for a new claim because I hadnt worked enough. I kept claiming every week anyway (the system let me) and after 2 months suddenly got approved for a new claim at a lower amount. No idea why but maybe the system reevaluated my case? Worth continuing to certify every week just in case.

This is actually good advice. The system is so glitchy sometimes that persistence pays off. I've heard similar stories from friends.

Whatever you do DO NOT stop certifying weekly! Even if your benefits end, keep doing your weekly certification. Sometimes there are retroactive extensions or other programs that get approved, and if you haven't been certifying you won't get that money. Takes 5 minutes a week and keeps your claim active in the system.

That's a good tip, thank you! I'll keep certifying.

Try calling your state representative's office! I was in a similar situation and hitting walls with unemployment, but my assemblyman's office has staff that deal with unemployment issues. They helped expedite my case and got me answers within days instead of weeks.
