NY unemployment approval letter taking too long - applied in November with no response
I applied for NY unemployment back in November 2024 and I still haven't gotten any letter saying if I'm approved or denied. It's been over 4 months now! Isn't there supposed to be some kind of timeline for them to make a decision? My online account just says 'pending review' every time I check. I've tried calling but can't get through to a actual person. Has anyone else waited this long? What should I do?

That's definitely longer than normal. NY unemployment determination letters usually come within 2-3 weeks after filing. After 4 months, something's wrong. Have you checked your spam folder? Sometimes the determination emails get filtered there. Also, check your online account documents section - the letters are often uploaded there before you get the physical mail.

•I checked my spam and there's nothing there. And my online account documents section is empty too - just says 'No documents available' when I click on it. Should I just keep waiting or is there something else I can try?

OMG the same exact thing happened to me last year! Applied in August, didn't hear ANYTHING until JANUARY!! The system is so broken. I called like 50 times and just got hung up on by their stupid automated system. So frustrating!!!!!

•Wow that's crazy! Did you eventually get approved? Did they give backpay for all those months you were waiting?

•Yeah I did finally get approved and they DID give me all the backpay, but I had to fight for it. Make sure you keep certifying every week even though you haven't been approved yet!!!

There are a few things that might be causing the delay: 1. Identity verification issues 2. Employment history verification problems 3. Your previous employer contesting your claim 4. System backlog (especially after holidays) 5. Missing information in your application At this point, you need to speak with someone directly. The fastest way is to use a service called Claimyr (claimyr.com) - they connect you directly to a NYSDOL agent by navigating the phone system for you. Saved me hours of frustration. They have a video showing how it works: https://youtu.be/Rdqa1gKtxuE

•I used Claimyr too when I was stuck in pending for 2 months. Got through to someone in about 20 minutes. Turns out there was a flag on my account because my employer submitted incorrect wage information. The agent fixed it right away and I got my determination letter the next day.

•I've never heard of that service before. Has anyone else used it? I'm willing to try anything at this point, I'm getting desperate.

yea 4 months is way to long. u should try messaging them thru the online portal. go to messages and send them something asking for status update. sometimes they respond in a few days that way. better than calling

•I tried messaging twice already. First time was in December, second time was about 3 weeks ago. Still no response to either message. Just says 'pending' on both messages.

The 4 month delay is COMPLETELY UNACCEPTABLE but also totally normal for NYSDOL these days! They're deliberately understaffed to save money while people suffer waiting for benefits they DESERVE! I waited 3 months last year and only got approved after I contacted my state assembly member's office. CALL YOUR STATE REPRESENTATIVE!!! That's the secret backdoor that actually works.

•This is good advice - contacting your state assembly member or senator can help. Their offices often have direct contacts at NYSDOL who can look into your claim. Just Google "NY State Assembly member [your area]" to find your representative.

I had a similar situation but it was because there was a question about my last job. I quit instead of being laid off and they were investigating if I was eligible. Have you worked at multiple jobs in the past 18 months? Sometimes that causes delays too because they have to verify with each employer.

•I did have two jobs actually - a full-time position and a weekend job. Maybe that's causing the delay. I was laid off from both around the same time when the company downsized.

•Multiple employers can definitely cause delays. The system needs to verify information from each employer, and if any one of them is slow to respond or provides conflicting information, your claim gets flagged for manual review. This is absolutely a case where you need to speak with a claims specialist directly.

After struggling with the same issue (waited 2.5 months for determination), I tried Claimyr that someone mentioned above. I was skeptical at first but it actually worked - got connected to an agent in about 30 minutes when I had been trying for weeks on my own. The agent found that my claim was stuck because of a flag that needed manual review. They removed the flag while I was on the phone and my determination letter came three days later. For multiple employer situations like yours, speaking directly to someone is really the only solution.

•It seems like talking to a real person is the only way forward. I'm going to try both the assembly member route and maybe this Claimyr service if that doesn't work. I'll update here with what happens. Thanks everyone for your help!

•Def update us!! I'm curious if the assembly member thing actually works. Good luck!

One more critical thing - make sure you've been certifying for benefits every week, even without approval. If your claim is eventually approved, you'll only get paid for weeks you properly certified. Many people don't realize this and miss out on thousands in backpay.

•I've been certifying every Sunday without fail! At least I got that part right. Really hoping I can get this resolved soon and get the backpay - I'm getting really low on savings at this point.

•Good! That's the most common mistake people make. When you do get to speak with an agent, be sure to ask them to check if all your certifications were properly recorded in the system. Sometimes there can be technical glitches where the system doesn't save certifications correctly, especially for pending claims.

my cousin works for nysdol (not in unemployment dept tho) and she says they got a huge backlog after the holidays. like thousands of claims backed up. but 4 months is still too long even with backlog

•That's interesting insider info. Maybe the holidays made it worse, but I applied before Thanksgiving, so I would've thought they'd get to mine before the holiday rush. Feels like my claim just fell through the cracks somehow.

Based on everything you've shared, I believe your claim is stuck in what's called 'adjudication limbo' - where it requires manual review but hasn't been assigned to an adjudicator. Multiple employers plus the holiday backlog are likely culprits. The good news is that once you get through to someone, these issues can often be resolved quickly. Please come back and let us know what works for you - it helps others in similar situations.

•Thank you! I'll definitely post an update once I get this resolved. Going to try the assembly member route first thing tomorrow, and if that doesn't work within a week, I'll try other options. Really appreciate everyone's advice!
