How long do you have to appeal unemployment determination from NYS Department of Labor?
I just received a determination letter from NYS Department of Labor saying my unemployment claim was denied. The letter mentions something about an appeal deadline but I'm having trouble understanding exactly how much time I have. Does anyone know the specific timeframe for filing an appeal? I'm worried I might miss the deadline and lose my chance to fight this decision.

You have 30 calendar days from the date the determination was mailed to file your appeal with NYS Department of Labor. This deadline is strictly enforced, so don't wait. You can appeal online through your ny.gov account or mail in the appeal form that came with your determination letter.

•Thank you! The determination is dated January 8th, so that means I have until February 7th right? Should I appeal online or by mail to be safe?

Definitely appeal online if you can - it's faster and you get a confirmation receipt immediately. Make sure you keep a copy of everything you submit. The 30-day rule is no joke, I've seen people lose their appeals just for being one day late.

•This happened to my cousin last year, missed the deadline by 3 days and NYS Department of Labor wouldn't budge on it. File ASAP!

•It's 30 days from the mail date printed on the determination letter, not when you actually received it. That's why it's important to check your mail regularly when you're dealing with unemployment issues.

If you're having trouble reaching NYS Department of Labor to ask questions about your appeal, I had good luck using claimyr.com to get through to an actual agent. They have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me hours of busy signals when I needed to clarify some appeal details.

•Never heard of that service but honestly anything beats sitting on hold for 3 hours just to get disconnected

The whole appeals process is such a mess. Even if you file on time, it takes forever to get a hearing scheduled. I waited 8 weeks for mine last year and by then I had already found a new job. System is broken.

•8 weeks?! That's crazy long. Did you end up winning your appeal at least?
