Do I have to notify NYS Department of Labor when I get a job - confused about reporting requirements
I just accepted a part-time position that starts Monday and I'm getting mixed information about whether I need to tell NYS Department of Labor right away or just report it on my next weekly claim. The job is only 20 hours a week so I'll still need partial benefits. My cousin said I have to call them immediately but my neighbor said just put it on the weekly certification. Which is correct? I don't want to mess up my claim but also don't want to spend hours trying to get through to someone if it's not necessary.

You need to report the work on your weekly claim certification, not call ahead. NYS Department of Labor requires you to report any work performed during the week you're claiming benefits for. Since you're working part-time, you'll likely still qualify for partial unemployment benefits. Just make sure to report your gross earnings accurately when you file your weekly claim.

•Thank you! So I don't need to call them before I start working? I was really worried about that.

Actually, there's an important distinction here. You don't need to notify NYS Department of Labor before starting work, but you MUST report it accurately on your weekly certification. The system will automatically calculate your partial benefit amount based on your earnings. Just remember that if you earn more than your weekly benefit rate plus the earnings disregard, you won't receive any benefits for that week.

•What's the earnings disregard amount? I keep seeing that term but don't understand what it means.

•The earnings disregard allows you to earn a small amount without it affecting your benefits. In New York, you can typically earn up to 25% of your weekly benefit rate without any reduction. Anything over that gets deducted from your benefits.

I had trouble reaching NYS Department of Labor for weeks when I had questions about partial benefits. If you need to talk to someone about your specific situation, I found this service called Claimyr that helped me get through to an actual agent. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Really saved me from the endless busy signals.

•Interesting, I'll keep that in mind if I run into issues. Hopefully just reporting on the weekly claim will be enough.

Just wanted to add my experience - I've been doing part-time work while on unemployment for about 6 months now. You definitely don't need to call ahead, just report everything accurately on your weekly certification. Make sure you have your pay stubs ready when you file because you'll need to enter your gross earnings (before taxes). The system is pretty straightforward once you get used to it. One tip: file your weekly claim as soon as possible after your benefit week ends to avoid any delays in processing.
