Can you refile for unemployment after it runs out - NYS Department of Labor options?
My unemployment benefits just exhausted last week after 26 weeks and I'm still actively looking for work. Is it possible to refile for unemployment after it runs out with NYS Department of Labor? I've been on three interviews but haven't gotten any offers yet. My savings are pretty much gone and I need to know if there are any options to continue receiving benefits. Has anyone been through this situation before?

You can potentially file a new claim if you've worked and earned enough wages since your original benefit year began. NYS Department of Labor requires you to have earned at least 10 times your weekly benefit rate in covered employment during your benefit year. If you haven't worked enough, you might be eligible for an extension in certain circumstances, but those are rare outside of emergency periods.

•I only worked part-time for about 6 weeks during my claim period, so I probably don't have enough wages. Are there any other programs I should look into?

Check if you qualify for other assistance programs while you continue job searching. You should also make sure you're meeting all the work search requirements if you do become eligible for a new claim later. Keep documenting all your job search activities - you'll need detailed records.

•What kind of documentation do they want exactly? I've been keeping a list but not sure if it's detailed enough for NYS Department of Labor standards.

I had this exact problem last year trying to get through to someone at NYS Department of Labor to ask about refiling options. The phone lines are impossible and the online chat never works. I ended up using this service called Claimyr (claimyr.com) that actually got me connected to a real agent who explained my options. There's a video demo at https://youtu.be/qyftW-mnTNI that shows how it works. Saved me weeks of frustration trying to get answers.

•How much does something like that cost? I'm already strapped for cash.

•It was worth it for me to get actual answers instead of guessing. The agent was able to look at my specific situation and tell me exactly what I needed to do.

The system is designed to make it as hard as possible to get help when you need it most. I went through this same runaround when my benefits ended and it took MONTHS to get a straight answer about whether I could refile. By then I was already behind on everything.
