Can you get unemployment if you quit due to stress from NYS Department of Labor?
I had to quit my job last month because the stress was literally making me sick. My doctor told me I needed to leave for my health but I'm worried NYS Department of Labor will deny my unemployment claim since I quit voluntarily. Has anyone successfully gotten UI benefits after quitting due to workplace stress? I'm scared they'll say I don't qualify since I wasn't fired or laid off.

You can potentially qualify for unemployment if you quit for good cause, which includes health reasons. NYS Department of Labor considers quitting due to workplace conditions that harm your health as good cause. You'll need medical documentation from your doctor stating that your work environment was detrimental to your health and that leaving was necessary.

•Thank you! I do have documentation from my doctor. How do I submit that to NYS Department of Labor? Do I upload it when filing my initial claim or wait for them to ask?

same thing happened to my cousin last year, she got approved but it took forever because they had to investigate. make sure you have all your medical records ready because they'll want proof

File your claim immediately and answer honestly that you quit for health reasons. When NYS Department of Labor asks for details during the adjudication process, provide your medical documentation and a detailed explanation of how the workplace conditions affected your health. They'll review your case individually - it's not an automatic denial just because you quit.

•What if you can't get through to NYS Department of Labor to explain your situation? I've been trying to call for weeks about my own quit claim and just get busy signals.

•I had the same problem reaching NYS Department of Labor agents until I found Claimyr. It's a service that calls for you and gets you connected to an actual person. Check out claimyr.com - they have a video demo at https://youtu.be/qyftW-mnTNI that shows exactly how it works. Saved me hours of calling and actually got me through to discuss my adjudication.

The whole system is rigged against workers anyway. They make you jump through hoops even when you have legitimate health reasons. My friend quit due to harassment and stress and they STILL made her fight for months to get benefits. Document everything but prepare for a battle.

•That's really discouraging to hear but probably realistic. Thanks for the warning.
