Can unemployment track my passport - worried about overseas travel affecting my NYS Department of Labor claim

I'm currently receiving unemployment benefits through NYS Department of Labor and I'm supposed to go on a family trip to Europe next month that was planned before I lost my job. I'm really worried - can the unemployment office track my passport and see that I left the country? Would this automatically disqualify me from benefits even if I'm still looking for work and available to start immediately when I get back? I don't want to mess up my claim but this is my sister's wedding and the tickets are already paid for. Has anyone dealt with this situation before?

You need to be very careful with this. NYS Department of Labor requires you to be available for work and able to accept employment immediately. If you're out of the country, you technically don't meet the 'able and available' requirement. You should report any travel when you file your weekly claim and expect your benefits to be suspended for those weeks you're away.

But do they actually track passports or is it just based on what I report? I'm only going for 10 days.

0 coins

they dont directly track your passport but if they audit your claim for any reason they can request travel records from customs. happened to my cousin - she got caught and had to pay back like $2800 in benefits

Wait, really? How did they find out about her travel? I thought only like criminal investigations could access that stuff.

The honest approach is best here. You should contact NYS Department of Labor before you travel and explain the situation. They may allow you to skip filing weekly claims for those weeks without penalty, but you won't receive benefits for the time you're away. It's better than risking an overpayment determination later. Call their customer service line or better yet, if you can't get through, try using Claimyr at claimyr.com - they help people reach actual NYS Department of Labor agents when the phone lines are jammed. There's a demo video at https://youtu.be/qyftW-mnTNI showing how it works.

This is solid advice. I had to travel for a funeral last year and I was upfront about it. They just told me not to file for those weeks and to resume when I got back.

Thanks for the Claimyr suggestion - I've been trying to call for days and keep getting disconnected. I'll check that out.

Look the system is so backed up they probably won't even notice but if you get audited later you're screwed. I know someone who got hit with a huge overpayment notice two years after the fact because they found undisclosed travel. The interest and penalties made it way worse than just losing a couple weeks of benefits upfront.

0 coins

Yeah but how often do they actually audit claims? Seems like they barely have staff to process regular claims let alone go digging through old travel records.

Just be honest about it. The wedding is a legitimate reason and they understand life happens. You'll lose those weeks of benefits but you won't get in trouble for fraud if you report it properly. The 'able and available' requirement is pretty strict - you can't be on vacation in another country and claim you're available for work in New York.

I went through something similar last year when I had a pre-planned vacation to visit family abroad. The key thing is DON'T try to hide it or continue filing while you're away - that's considered fraud. What I did was call the unemployment office about 3 weeks before my trip (though it took forever to get through) and told them exactly when I'd be leaving and returning. They told me to simply not file my weekly claim for the weeks I was gone, then resume filing when I got back. I lost about $1,200 in benefits for those 2 weeks, but it was way better than risking an overpayment investigation later. The rep actually said they appreciate when people are upfront about travel because it shows you're not trying to game the system. Your sister's wedding is definitely a valid reason - they're not heartless, they just need to follow the rules about work availability.

I'm dealing with a similar situation - I have a destination wedding I'm supposed to attend in 6 weeks and I've been stressed about how to handle it with my unemployment claim. Reading through everyone's responses here has been really eye-opening. It sounds like the consensus is definitely to be upfront about it rather than risk getting caught later. I had no idea they could potentially access travel records during audits - that's honestly terrifying to think about. I'm going to follow the advice here and call the unemployment office this week to report my travel dates in advance. Has anyone here actually used that Claimyr service that Cameron mentioned? I've been trying to get through to a real person for weeks and it's been impossible. Even if I have to lose a week or two of benefits, it's better than potentially owing back thousands later with interest and penalties.

I actually did use Claimyr about 2 months ago when I couldn't get through the regular lines for weeks. It was honestly a lifesaver - I paid like $20 and they got me connected to an actual NYS DOL rep within a few hours. Way better than sitting on hold for 3+ hours just to get disconnected. The rep I spoke with was really helpful and understanding about my situation. Definitely worth it if you're stressed about getting through to report your travel properly. Better to spend $20 to handle this the right way than risk the fraud issues everyone's talking about.

I went through this exact situation about 8 months ago when I had to attend my cousin's wedding in Italy while on unemployment. I was terrified about how to handle it, but after reading horror stories online about people getting caught, I decided to be completely transparent with NYS DOL. I called them about 3 weeks before my trip (definitely use Claimyr if you can't get through - totally worth the $20) and explained the situation. The agent was actually very understanding and told me to simply not file my weekly claims while I was gone (10 days for me too) and resume when I returned. I lost about $2,400 in benefits, which hurt, but the peace of mind was invaluable. When I came back and resumed filing, everything went smoothly with no issues. The agent even mentioned that family weddings are one of the most common legitimate reasons people need to travel, and they much prefer when claimants are upfront about it rather than trying to hide it. Trust me, losing those 2 weeks of benefits is nothing compared to the potential nightmare of an overpayment investigation. Call them now, be honest, and enjoy your sister's wedding without the stress!

This is so reassuring to hear from someone who went through the exact same situation! $2,400 is definitely a significant amount to lose, but you're absolutely right that it's nothing compared to the potential nightmare of fraud allegations. I really appreciate you mentioning that the agent said family weddings are common and legitimate reasons - that makes me feel so much better about reaching out to them. I've been putting off making the call because I was worried they'd think I was being irresponsible or something, but it sounds like they're actually pretty understanding when you're honest upfront. I'm definitely going to look into Claimyr too since I've had zero luck getting through the regular phone lines. Thank you for sharing your experience - it's exactly what I needed to hear to feel confident about doing this the right way!

I'm in a very similar boat - I have a family reunion planned overseas that was booked months before I lost my job, and I've been absolutely stressed about how to handle it with my unemployment claim. Reading through all these responses has been incredibly helpful, especially hearing from people who actually went through this situation. It's clear that being upfront is definitely the way to go, even though losing those weeks of benefits will hurt financially. What really stands out to me is how many people mentioned that NYS DOL agents are actually understanding about legitimate family events when you're honest about them. I think I was expecting them to be harsh or judgmental, but it sounds like they deal with these situations regularly. I'm going to call them this week to report my travel dates - better to lose a few weeks of benefits than risk the nightmare scenarios people have shared about audits and overpayment notices. Thank you everyone for sharing your experiences, especially those who were honest about the tough financial consequences. It's helping me make the right decision even though it's not easy.

I'm so glad this thread has been helpful for you too! I was in the exact same mindset when I first posted - expecting them to be harsh or make me feel bad for even asking. But honestly, every person I've talked to who was upfront about family travel said the agents were pretty reasonable about it. I think they see these situations all the time and they'd much rather have people be honest than try to hide it. The financial hit definitely stings, but after reading Sean's story about owing back over $3K plus penalties for just 4 days, I'm convinced it's the only smart choice. I'm planning to call tomorrow morning and just be completely straightforward about my sister's wedding. Fingers crossed I can actually get through! If not, I'll definitely try that Claimyr service people keep mentioning.

I just want to echo what everyone else is saying here - definitely be upfront with NYS DOL about your travel. I had a similar situation last year with a pre-planned family vacation to Mexico, and I was terrified about how to handle it. After reading stories online about people getting audited and owing back thousands, I decided honesty was the only way to go. I called about 4 weeks before my trip (took forever to get through, but persistence paid off) and explained the situation. The agent was completely understanding and just told me not to file for the weeks I'd be away. I lost about $1,800 in benefits for those 3 weeks, which definitely hurt at the time, but the peace of mind was worth every penny. When I returned and resumed filing, there were zero issues. The agent even mentioned they see family weddings all the time and appreciate when people handle it properly rather than trying to hide it. Trust me, your sister's wedding is exactly the kind of legitimate reason they understand. Call them ASAP, be completely honest, and don't stress about it - you're doing the right thing by asking these questions and planning to handle it properly!

Thank you Isabella for sharing your experience! It's really reassuring to hear from so many people who went through this exact situation and handled it the right way. The consistency in everyone's stories about NYS DOL agents being understanding when you're upfront is giving me so much more confidence about making that call. $1,800 is definitely a significant amount to lose, but after reading all these experiences - especially Sean's audit nightmare - I'm totally convinced that being honest upfront is the only smart move. I've been putting this off because I was scared, but hearing that agents actually appreciate when people handle family events properly rather than hiding them makes me feel so much better. I'm going to call first thing Monday morning and explain about my sister's wedding. If I can't get through the regular lines, I'll definitely try Claimyr like others have suggested. Thank you everyone for being so open about your experiences - this thread has been a lifesaver!

I just went through this exact situation about 3 months ago when I had to attend my best friend's wedding in Ireland. I was absolutely terrified about how NYS DOL would react, but after reading horror stories about people getting audited years later, I knew I had to be completely honest. I called them about 5 weeks before my trip (definitely recommend using Claimyr if you can't get through - saved me hours of frustration) and explained it was a pre-planned wedding I couldn't miss. The agent was actually really compassionate and said family/close friend weddings are some of the most legitimate reasons for travel they see. She told me to simply not file my weekly claims for the 2 weeks I'd be gone and resume when I returned. I lost about $1,600 in benefits, which was painful at the time, but the peace of mind was priceless. When I came back and resumed filing, everything went smoothly with zero issues. The agent even put detailed notes in my file about the approved travel dates. Hannah, I know it's scary to potentially lose those benefits, but after reading all these experiences here, it's crystal clear that being upfront is the only smart move. Your sister's wedding is exactly the kind of situation they understand - call them ASAP and don't stress about it!

Julian, thank you so much for sharing your experience - this is exactly what I needed to hear! Your situation with your best friend's wedding in Ireland sounds almost identical to mine, and knowing that the agent was actually compassionate about it makes me feel so much better. I've been absolutely terrified that they'd make me feel guilty or irresponsible for even asking, but it's incredible how consistent everyone's experiences have been about the agents being understanding when you're honest upfront. The fact that she put detailed notes in your file about the approved travel dates is really reassuring too. $1,600 is definitely a lot to lose, but after reading Sean's audit nightmare and seeing how smoothly things went for everyone who was transparent, I'm 100% convinced this is the right approach. I'm going to call them first thing tomorrow morning and explain about my sister's wedding. If I can't get through, I'll definitely use Claimyr like you and others have recommended. Thank you for taking the time to share your story - it's giving me the confidence I needed to handle this properly!

I'm in a very similar situation and this thread has been incredibly reassuring! I have my niece's wedding in Spain coming up in about 6 weeks and I've been absolutely panicking about how to handle it with my unemployment benefits. Like everyone else here, I was terrified that NYS DOL would be harsh or judgmental about requesting time off for a family wedding, but reading all these real experiences has completely changed my perspective. The pattern is so clear - every single person who was upfront about legitimate family travel had understanding agents and smooth experiences, while those who tried to hide it faced serious consequences later. Sean's audit story especially drove home how risky it would be to not disclose the travel. I'm definitely calling NYS DOL this week to report my travel dates and request to suspend my claim for those 10 days. Losing about $1,500 in benefits will be tough financially, but the peace of mind and avoiding potential fraud investigations is worth so much more. Thank you everyone for being so transparent about your experiences - this thread is exactly what people dealing with this stressful situation need to see. Hannah, I hope your call goes well and that you can enjoy your sister's wedding without worrying!

I've been following this thread closely as someone who's been on unemployment for about 3 months now, and I have to say - this has been one of the most helpful discussions I've seen on this topic. What really strikes me is how consistent everyone's experiences have been when they chose to be transparent with NYS DOL about family travel. Every single person who called ahead and was honest about weddings or family events had positive interactions with understanding agents, while those who tried to hide travel faced serious consequences later. I don't have any upcoming travel myself, but I'm bookmarking this thread because the advice here is gold. The key takeaways seem to be: 1) Call NYS DOL 3-4 weeks before travel, 2) Be completely honest about the family event, 3) Don't file weekly claims while away, 4) Resume filing when you return, and 5) Use Claimyr if you can't get through regular lines. Hannah, I really hope your call goes smoothly - your sister's wedding sounds like exactly the type of legitimate family event these agents deal with regularly. Thanks to everyone who shared their real experiences here, especially those who were honest about the financial impact. This kind of transparent community discussion is invaluable for people navigating these stressful situations.

This thread has been such a lifesaver! I just joined this community because I've been dealing with the exact same stress about upcoming family travel while on unemployment. Reading through everyone's real experiences here has completely changed my approach from panic to confidence about doing the right thing. What really resonates with me is how you've summarized the key takeaways - having that clear roadmap makes this so much less overwhelming. I especially appreciate point #4 about resuming filing when you return, because I was worried there might be complications getting back into the system after a travel suspension. The fact that everyone who handled it properly had smooth transitions back is really reassuring. I have my cousin's wedding overseas in about 2 months and I was honestly considering not going because I was so scared about messing up my benefits. But after seeing story after story of understanding agents and positive outcomes when people are upfront about family weddings, I'm definitely going to call NYS DOL this week to report my travel plans. Thank you for putting together such a helpful summary - and thanks to everyone else who shared their experiences so openly. This community support is exactly what people need when navigating these stressful situations!

I'm dealing with this exact situation right now and this thread has been absolutely invaluable! I have my brother's wedding in the UK coming up in about 4 weeks and I've been losing sleep over how to handle it with my unemployment benefits. Reading through everyone's experiences here - especially the consistent pattern of NYS DOL agents being understanding when people are upfront about family weddings - has given me so much confidence to do the right thing. What really convinced me was seeing the stark contrast between people who were honest (smooth experiences, understanding agents) versus those who tried to hide travel (audit nightmares, owing thousands back). Sean's story about owing $3K+ for just 4 days in Canada was a real wake-up call. I'm calling NYS DOL tomorrow morning to report my travel dates and request to suspend my claim for those 10 days. Yes, losing around $1,400 in benefits will hurt, but the peace of mind and avoiding potential fraud issues is worth infinitely more. The fact that multiple people mentioned agents saying family weddings are common legitimate reasons they handle regularly makes me feel so much better about reaching out. If I can't get through the regular lines, I'll definitely try Claimyr like others have recommended. Thank you everyone for being so transparent about your experiences - this thread should be required reading for anyone on unemployment facing family travel decisions!

QuantumQuester, I'm so glad this thread has been helpful for you too! Your brother's wedding in the UK sounds wonderful, and you're absolutely making the right decision by planning to be upfront about it. What really stands out to me from reading everyone's experiences is how the anxiety beforehand was always worse than the actual conversation with NYS DOL. It seems like once people got through to an agent and explained the family wedding situation, the agents were consistently understanding and professional about it. Your timeline of 4 weeks ahead seems perfect based on what others have shared - that gives them plenty of time to note it properly in your file. I know losing $1,400 is tough, but after seeing Sean's audit nightmare and how smoothly things went for everyone who was transparent, you're definitely choosing the smart path. The peace of mind of knowing you handled it correctly will make your brother's wedding so much more enjoyable. Good luck with your call tomorrow - I have a feeling it's going to go much better than expected based on all the positive experiences shared here!
